Subject: Legal Notice under Section 41 of the 1882 Act for the Recovery of Money
Dear Sir/Madam,
4. OLX Autos ceased its operations in 2023. My client requested the refund of the
security deposit on October 29, 2023.
5. My client transferred all cars purchased from your platform to their name,
following all guidelines.
6. Despite my client's payment of Rs. 10,000 as a security deposit for running their
OLX Autos account, you have failed to refund the amount.
8. My client has made several requests through telephonic messages and personal
messengers to your office for the release of the outstanding payment. However,
you have continuously delayed the payment without any valid reason.
Therefore, through this notice, I demand that you pay my client Rs. 10,500 along
with future interest at 14% per annum from the date of this notice until actual
realization of the said amount, together with a notice fee of Rs. 2,000. Payment
can be made either in cash, by demand draft, or by cheque, within a clear 30 days
from the date of receipt of this notice. Failure to comply will result in my client
pursuing civil and criminal lawsuits for recovery and other miscellaneous
proceedings against you in the competent court of law. You shall be fully
responsible for any consequences arising thereof.
A copy of this notice has been preserved in my office for record and future course
of action.
