Furniture Protection

HOW DOES IT WORK?


XCover.com's Furniture Protection protects your items against accidental stains or damage for
1 year from the plan purchase date. This includes spills, breakage, cracks, tears, rips, and other
damages caused by you, a pet, or anyone else. It also protects your product against structural
damage, such as timber frames, plastic, and finishes.

This protection also expands the manufacturer's warranty and extends it after expiry for an
additional 3 years (up to a maximum of 6 years, including your existing manufacturer
warranty). On the extended warranty, a depreciation schedule applies.

At the time of claim. . .

A 10% depreciation applies if your item is 2 years old.


A 20% depreciation applies if your item is 3 years old.
A 30% depreciation applies if your item is more than 3 years old.

In case the manufacturer warranty has a higher depreciation than above, then the higher
depreciation will be applicable.

You are protected up to the amount you have paid for the item. If you make a claim, there
may be an excess (as shown in the certificate). This will be deducted from any payment to you
for repairs or replacement.

To allow for shipping, you will receive your plan details via email 14 days from your
purchase date, or the date you receive your product, whichever comes first.

You can cancel via Flipkart within 10 days of purchase.

YOUR ITEMS ARE PROTECTED IF...

- They malfunction and are inoperable
- There's a manufacturer defect

WE'LL ALSO COVER...


- Defects to frames caused by breakage or becoming warped.
- Cracking of solid wood furniture.
- Peeling of the finish on solid wood.
- Bending and breakage to metal components.
- Excessive loss of resilience.
- Defects of mechanical, electric recliners and components.
- Bending and breakage of metal components.
- Broken zips, castors, and buttons, separation of seams and stitching.
- Lifting or peeling of the hide on leather furniture.
- Loss of resilience to foam and fibre interiors.

YOU'RE NOT PROTECTED IF...

- The damage is caused by:


=> The delivery process.These are handled by Flipkart.
=> Your items being used for rental/sublet or commercial purposes, or furniture in storage or
transit damage.
=> Misuse, mishandling, abuse, neglect, violence or vandalism.
=> Deliberate damage by any person, including children.
=> Any spill or stain not attended to in a manner described by the administrator.
=> Fire, fibre damage, smoke, ash, flood, wind, lightning, the act of sunlight, oxidisation, or
any other natural disaster.
=> Colour loss or any change in colour because of usage or wear and tear (for example the
fabric fraying or buttons loosening over time.)
- Any stains (or removal of odors caused by a stain) or damages that are consistent with wear
and tear or anything that happens gradually.
- Your failure to comply with the manufacturers, suppliers, or protection or service providers
instructions, including damage caused by incorrect use of cleaning substances.
- The natural characteristics of leather, such as brands, bites, tick marks and opened scars.
This includes damage caused by insects, non-domestic animals, or wild birds.
- Any failed repairs carried out under the manufacturer warranty or repairs carried out by a
technician not assigned by the service provider.
- Any payout requests resulting from fading, the effect of sunlight or non-colour fast
materials.
- Variations in batches of dyes, where a part is replaced the colour match will be within a
commercial tolerance.
- Structural defects first discovered during the manufacturer warranty period.
- Damage that is not consistent with the original payout request or misrepresentation of an
occurrence.
- Any service costs where having arranged for the attendance of a service provider, they are
unable to gain access to the furniture. In such instances, you will be responsible for the cost of
the service request to the service provider before they will re-attend.
How we process claims and make payments...

Visit xcover.com/claim to start your claim / service request.

You can authorise another person to handle a claim on your behalf, however, the item must be
the one shown on your certificate.

- Provide your documents and a detailed description of the event.

For all claims, we require, as a minimum, a detailed description of the event. We may request
documents, such as proof of ownership or police reports, during the claims process. If
required documents are not provided to us, the claim may be denied or the status changed to
pending. Repairs must be authorised by us in advance of any work being carried out.

- When your claim is approved

When a claim is approved, you will be notified and given details of how to settle your claim.
We reserve the right to settle your claim as we see fit (repair, replace or provide credit). If we
replace your item then we may arrange for the collection of the damaged item.

KEY DEFINITIONS

The following keywords or phrases have the same meaning wherever they appear in this plan
unless stated below.

Damage the sudden and unforeseen damage to the protected item(s)


or the sudden and unforeseen contact between the protected
item(s) and a substance resulting in a stain or damage to the
protected item(s).

Administrator Xcover.com, a trading style of Cover Genius Limited.

Certificate the document which names you as the customer and lists the
protected item(s) protected under your plan. It will confirm
the period of protection, the protection level you have
chosen, and the payout request limit. Your certificate will be
replaced whenever you make any changes to your plan. The
certificate and this wording combine to create your plan.

Consequential Loss any other costs that are directly or indirectly caused by the
event which led to your payout request unless specifically
stated in this plan. For example, the loss of use while a
repair is carried out.

Depreciation your item will reduce in value over time due to general use
or wear and tear. Depreciation is the monetary amount your
item's value will be reduced by when you make a claim.
Manufacturing Defect any damage or breakdown caused by a manufacturing
process issue, which is covered under the warranty provided
by the manufacturer.

You/Your the person(s) whose name and address shown on the


certificate.

Provider/We/Us/Our Cover Genius India Private Limited.

the item or items detailed on your invoice and listed on your


Protected Item(s) certificate.

Period of Protection the period between the start date and the expiry date which
is shown on your certificate and that the plan will be in
force for.

Start date the date the protection commences as shown on your


certificate.

Transit damage damage caused to the protected item when it is moved


between properties.

COMPLIANCE & REGULATORY


GOVERNING LAW & JURISDICTION
The construction, interpretation and meaning of the provisions of this Terms of Service shall
be determined in accordance with laws and shall be resolved by the courts of India.

PLAN ISSUER
This plan is owned and issued by Cover Genius India Private Limited.

DUAL COVER
If at the time of any incident which results in a payout request under this plan, there is another
cover or service, such as government program, public transport carrier, travel agent or any
other provider of transportation and/or accommodation, covering the same damage, expense
or liability we will not pay more than our proportional share.

INFORMATION FOR THE ENTIRE PLAN

Your most recent certificate sets out the information we were given when we agreed to
provide you with the cover and terms of your plan.

Your plan provides cover for the sections and the period of coverage shown in your
certificate. You must read your plan and certificate as one single contract. Please read all
documents to make sure the cover provided meets your needs. If this is not the case, please
contact us as soon as possible.
If any of your information is incorrect or changes please contact our partner. If we have wrong
information this may result in an increased plan cost and/or claims not being paid in full, or
your plan may not be valid and claims will not be paid.

You should keep a record (including copies of letters) of all information supplied to us in
connection with this plan.

THIRD-PARTY RIGHTS

Except where otherwise required by law, you and we have agreed that:

- it is not intended for any third party to this contract to have the right to enforce the terms of
this protection.
- you and we can rescind or vary the terms of this contract without the consent of any third
party to this plan, who might seek to assert that they have rights under this plan.

DATA PROTECTION & PRIVACY

We are committed to protecting your personal information and we are committed to the
principles of data security in the configuration of our services. As a data controller, we collect
and process information about you and we also receive personal information from the partner
including your email address, name and phone number, risk details and other information
which enables us to issue and modify plans and process claims, detect, investigate and prevent
activities which may be illegal or could result in your product being cancelled or treated as if
it never existed and protect our legitimate interests. We may share that data from time to time
with our partners or investigators, crime prevention organisations. We will never share your
data with external marketing services. Our Privacy Policy outlines how we process your data,
the data that we collect and the processes to undertake should you either wish to request a
copy of your data, or remove consent for us to retain your data. We will store and process
your personal information in accordance with the applicable data protection laws of India.

We may monitor and record phone calls to help maintain our quality standards and for
security purposes.

By submitting your information, you agree to send it to Cover Genius India Private Limited
who will process it and use it according to the privacy policy. Further, Flipkart does not
review, monitor, approve, endorse or interfere with respect to processing and usage of the
information provided by you to Cover Genius India Private Limited and Flipkart shall not be
held liable for any breach in this regard. The processing and usage of such information shall
be under the control of Cover Genius India Private Limited. Flipkart shall also not be
responsible or be held liable for the accuracy of the information provided by Cover Genius
India Private Limited and the quality of the products sold/displayed by Cover Genius India
Private Limited.
COMPLAINTS/DISPUTES

You can contact our Claims Complaints Team (complaints@xcover.com) for a formal review
of your claim or if you have other concerns.

We will respond within 5 business days.

DISCLAIMER

All the claims and/or disputes arising out of the plan/product must be raised with Cover
Genius alone. Cover Genius India Pvt Limited shall be solely responsible for settlement of
disputes, whether such dispute relates to the protection plan or default in servicing the covered
member/ protection plan holder for/ under such plan or any claim arising from such plan or
rejection of claims of covered member under the plan.
