POINTS OF LAW Whether during life time of Ranajit Sardar @ Ranjit Sardar, Shibani Sardar was his wife and in the year 2006 Assembly Election Voter List their name were enlisted there and no objection was raised at that point of time by said Ranajit Sardar. So the respondent authority at this stage could not revoked the legal heir certificate of the self same person i.c. Jate Ranjit Sardar. So on that context the order dated 29.09.2022 issued by the respondent no.2 is nonest in the eye of law. Whether the Government of India and the Government of West Bengal issued all the papers during life time of Ranjit Sardar and all those documents the name of Ranjit Sardar has written as husband of the petitioner, nobody can deny those documents except the husband of the petitioner. All the denial will not be permissible in the eye of law. Whether the respondent no2 biasly passed the impugned order of revocation of legal heir certificate of late Ranjit Sardar issued earlier. The respondent no.2 have not gone through the enquiry report submitted before him before issuance of legal heir certificate. The respondent no.2 with an arbitrary manner fasion with the respondent no.4 passed by the impugned ler of revocation of legal heir certificate of late Ranjit inc ore Sardar. Petitioner states that in a love and effection petitioner got married with said Ranjit Sardar and peaceful conjugal relationship was Ne Raegeeny estedbtished . Mercontinuing with her husband and residing with the address of her husband at Jadabnagar, South 24-Parganas. In the year 2006 a Voter List was published of Kulpi Assembly Election and the name of the petitioner was enlisted along with her husband’s name. Petitioner states that unfortunately the husband of the petitioner has died on 21.06.2009 during employment and since then the hard days has come in her life. Xerox copy of Dead Certificate of late Ranjit Sardar @ Ranajit Sardar is annexed herewith and marked as Annexure-“P/2”, 5. Petitioner states that petitioner is living at the residence of her husband and all the documents in resyect of identity of the petitioner were already been issued during life time of her husband. In the life time of the father in law of the petitioner, petitioner was getting her essential needs of her livelihood from her father in law. Petitioner states that after demise of her husband petitioner prayed for death benefit of her husband and also prayed for compassionate a-harness ground, Petitioner also prayed before appointment under died. the Bank Authority SBI, deposited sum amongst to the legal heirs of late Ranajit Sardar. But the mother-in-law of the petitioner by the insistence of the respondent no.4 filed several objection for not granting the benefits to the petitioner and Karanjali Branch for disbursement of theso that petitioner is not getting any pensionary benefit as well as any financial benefits in respect of the deccased husband of the petitioner. 7. Petitioner submits that after contesting in all concern the Block Development Officer, Kulpi Block made an enquiry through the Secretary Ramkrishnapur Gram Panchayat under Kulpi Police Station and issued a certificate of legal heirs of late Rangjit Sardar @ Ranjit Sardar on 12.03.2015 stating that the legal heits of late Sardar are i) Shibani Sardar, wife and ii) Jyotsna Sardar, Mother. certificate of late Ranjit Sardar as well as Xerox copy of legal heii all enquiry report are annexed herewith and collectively marked as Annexure-"P/4”, 8. Petitioner states that the Sub-Divisional Officer, Diamond Harbour and District Magistrate & Collector, South 24-Parganas also issued certificate in favour of the petitioner after satisfied the enquiry report submitted by the Block Development Officer, Kulpi Block. Xerox copy of Certificate issued ty the Sub-Divisional Officer’s District Magistrate are annexed herewith and collectively marked as Annexure-“P/5’, 9. Petitioner states that the identity of the petitioner she is the wife of late Ranajit Sardar and in the Voter List also reflected that the petitioner is living at the residence of her husband. Petitioner also states that the office of the Deputy Director, Animal Resources, Government of West Bengal after considering the prayer of the petitioner issued. a Memo No.2564 dated Alipore 09.10.2015 requesting to submit some documentsregarding family pension case of late Ranjit Sardar Ex. LDA under BL DO, Kakdwip, Xerox copy of Voter Lists under K:lpi Legislative Assembly in 2013 +& 2016 as well as Memo No.2564 dated 09.10.2015 are annexed herewith and collectively marked as Annexure-“P/6? & “P/7”. 10. Petitioner submits that the mother-in-law of the petitioner Smt. + = @ dyotsna Sardar has died on 7% March, 2018 and after her demise the petitioner is the only legal heirs of late Ranjit Sardar @ Ranajit Sardar and she is entitled to get all legitimate claim of deceased Ranjit Saidar. Xerox copy of Death Certificate of the mother-intaw of the petitioner is annexed herewith and marked as Annexure-*P/8”. 11, Petitioner states that before demise Jyotsna Sardar by insistence with her younger son, the respondent no.4 herein made a complaint claiming that the petitioner is not the wife of late-Ranjit Sardar most illegally before the Office of District Magistrate, South 24-Parganas. On the basis of the complaint the office of the Additional District Magistrate issued notice of hearing on 22.05.2017 and 30.06.2007. Both days petitioner was present before the authority concerned and submitted all the papers. But at that time the concerned office was satisfied and associates not to file this type of werned the private respondent and hi petition. After waiting tong time petitiorer made a representation on 06.12.2018 before the Office of District Magistrate to supply the copy of order. Xerox copy of application dated 06.12.2018 is annexed herewith and marked as Annexure-“P/9°,12. Petitioner submits that after laps of long time the private respondent no.4 by managing the office personal of the District Magistrate for rehearing the matter and notice was served to the petitioner from the office of the District Magistrate, South 24-Parganas by fixing the date of hearing on 07.06.2022 petitioner was surprised by receiving the notice again and having no other alternative petitioner again appeared before the authority concerned and submitted all the papers +which were submitted in previous occasion. Since the date of death petitioner is not getting any benefit from the Government Authority only on the reason of objection made by the private respondent and petitioner is in starvation by not getting any benefits and any financial support from anybody. 19, Petitioner submits that the private respondent no.¢ br managing someone claiming that the petitioner is not the wile of tame Rape the authority. The brother-in-law of the petitioner, ie. the respemdent no.4 herein with an intention to grab the entire claim of late Ranaiit Sardar a conspiracy was made with the office personal of the District Magistrate & Collector, who already issued certificate in favour of the petitioner, 14. Petitioner submits that all on a sudden petitioner received one notice vide Memo No. 1 dated 02.01.2023 supplying the copy of order of = the hearing dated 29.09.2022 whercin the Additional Dis: " (General), South 24-Parganas revoked her legal heir certificate issted in her favour on the death of her husband la:e Ranjit Sardar most illegally and motivatedly. The Additional District Magistrate(General), South 24- 1 MagistrateParganas without following the relevant documents in support of the ficate petitioner straightway passed an onder that the legal heir cer issued on 30.04.2015 is factually in correct and further ordered that a rectified legal heir certificate of late Ranjit Sardar will be issued the entire acts and activities of the Additional District Magistrate (General), South 24-Parganas is illegal, inhuman and on that acts and attitude petitioner wil suffer irreparable loss and injury and also will be deprived to get all legitimate claim of her deceased husband. So, the order dated 29.09.2022 is required to be set aside for the ends of justice. For that the respondent no.2 also not considered the Voter list but of 2013 & 2016 submitted before him for his fair justic he by collusion with the private respondent and his appointed Person most illegally passed an impugned order of revocationof legal heir certificate of late Ranjit Sardar only for their of person interest. For that for the interest of fair justice the respondent no.2 should have given the priority of the several documents submitted in several occasion in support of the claim of the petitioner as the wife of Jate Ranjit Sardar and should have accepted the enquiry report submitted before the authority vie concerned and on that context the impugned order dated 29.09.2022 is required to be set aside. va. For that the acts and action of the respondent no.2 is unjust, improper and also violation of principle of natural justice.
