873(अ).—िननिलिखत ा प िनयम िजह क सरकार मोटर यान अिधिनयम, 1988 (1988 का 59)

क धारा 88 क उप-धारा (9) के साथ पठत उप-धारा (14) !ारा द# शि%य का योग करते &ए बनाने का (ताव

करती है, को इस अिधिनयम क धारा 212 क उप-धारा (1) के !ारा यथाव*यक इसके !ारा भािवत होने क संभावना

वाले सभी ,ि%य क जानकारी के िलए एतद!ारा कािशत -कया जाता है; और एतद!ारा नोटस -दया जाता है -क इन

ा प िनयम को उस तारीख से प1तालीस -दन क अविध समा3 होने के बाद िवचाराथ5 (वीकार कर िलया जाएगा िजसको

सरकारी राजप6 म यथा कािशत इस अिधसूचना क ितयां जनता के िलए उपल8ध करायी जाती ह1।

इस कार िविन@दA अविध समा3 होने के भीतर उBत ा प िनयम के संबंध म -कसी भी ,ि% से ा3 होने वाली

-कहC आपि#य या सुझाव पर क सरकार !ारा िवचार -कया जाएगा।

1. संि त नाम, याि

ारंभ और रयायत:-
(1) इन िनयम को मोटर यान (अिखल भारतीय पय5टक यान ािधकृित और परिमट) िनयम, 2018 कहा जाएगा

तथा मोटर यान (पय5टक परवहन संच ालक के िलए अिखल भारतीय परिमट) िनयम, 1993 को ित(थािपत कर ग।

(2) ये पूरे भारत म लागू हगे।

(3) ये िनयम सरकारी राजप6 म उनके अंितम काशन क ितिथ को लागू हगे।

2. परभाषाएं
(1) इन िनयम म, जब तक संदभ5 म अयथा अपेिKत हो,-

(क) “अिधनयम” से अिभाय है मोटर यान अिधिनयम, 1988.

(ख) “पय5टक वाहन के िलए अिखल भारतीय ािधकृित” इसम इसके प*चात “ािधकृित” के प म उि?लिखत

है, से अिभाय है -कसी परवहन ािधकरण !ारा -कसी पय5टक वाहन संचालक को जारी -कया गया िजसके !ारा

संबंिधत राNय/संघ-राNय Kे6 िजनम वाहन चलाया जाएगा, !ारा िनधा5रत परिमट भार के भुगतान के

अOयधीन उसे भारत के संपूण5 Kे6 म वाहन चलाने का अिधकार दान -कया जाता है।

(ग) “अिखल भारतीय पय5टक परिमट” इसम इसके प*चात “परिमट” के प म उि?लिखत है, से अिभाय है

-कसी वाहन को दान -कया जाने वाला परिमट िजसके !ारा उसे -कसी राNय/संघ-राNय Kे6 !ारा परिमट के

वा(तिवक उदगृहीत -कसी अितरBत भार का भुगतान -कए िबना संपण

ू 5 भारत म चालन के िलए ािधकृत -कया

जाता है।

(घ) “परवहन ािधकरण” से ऐसा ािधकरण अिभेत है िजसे अिधिनयम के तहत पय5टक वाहन के संबंध म

परिमट दान करने के िलए अिधकृत -कया गया है।

(ड.) “प6” से अिभाय है इन िनयम म िविन@दQट प6।

(च) “िनयम” से अिभाय है कीय मोटर यान िनयम, 1989 के िनयम।

(छ) “धारा” से अिभाय है अिधिनयम क धारा।

(झ) “पय5टक वाहन संचालक” से अिभाय है पय5टक परवहन वाहन को उपल8ध कराकर पय5टन को बढ़ावा देने

के Uयवसाय म लगी कोई कंपनी या फम5 या कोई UयिBत।

(ञ) “पय5टक वाहन” से अिभाय है एक संिवदा कैरज िजसे इस पK म यथा-िविनधा5रत िविनदXशन के अनुसार

िनYमत -कया गया है या अपनाया गया है और सुसिNजत एवं अनुरिKत -कया गया है।

(2) ािधकृित/परिमट केवल पय5टक वाहन के संचालक को दान -कया जाएगा।

3.
ािधकृ ित/परिमट का
प, िवषय-वतु, अविध आ#द:-

(1) ािधकृित/परिमट को जारी/नवीकरण के िलए ;येक आवेदन-प6 Kे6ािधकार परवहन ािधकरण को प6 1 म

इलैB[ािनक फाम5 म (तुत -कया जाएगा।

(2) ािधकृित और परिमट \मश: प6 2 और प6 3 म जारी -कया जाएगा तथा यह 1 वष5 या अिधक वष5 य-द

पय5टक वाहन के संचालक !ारा लंबी अविध हेतु चयन -कया जाता है, क अविध के िलए वैध होगा।

4.
ािधकृ ित/परिमट जारी करने के िलए फ*स:-

ािधकृित/परिमट जारी करने के िलए ;येक आवेदन प6 के साथ िननिलिखत तािलका के अनुसार समे-कत परिमट

फस को पूरे भारत के Kे6 म चालन के िलए परिमट जारी करने हेतु अिखल भारतीय ािधकरण पय5टक वाहन परिमट खाते

म जमा -कया जाएगा।

पंरतु यह -क जहां -कसी संचालक ने परिमट जो ािधकृत नहC है, के िलए आवेदन -कया है तो ािधकृित के िलए

फस का भी भुगतान -कया जाएगा:-

सरकार !ारा अनुरिKत और सरकारी राजप6 म अिधसूिचत -कया जाने वाला खाता।

5. समे#कत
ािधकृ ित/परिमट फ*स का रा+य, और संघ-रा+य े, म- िवतरण:-

िवतरण:-

ािधकृित के िलए भुगतान क गई फस को Kे6ािधकार राNय को मािसक आधार पर संिे षत -कया जाएगा। इन िनयम के

िनयम 4 म िविन@दQट “अिखल भारतीय पय5टक वाहन परिमट अकाउं ट” म एक6 क गई परिमट फस का राNय और संघ-

राNय Kे6 म िवतरण िननिलिखत सू6 के अनुस ार -कया जाएगा:-

एसआरएन = एसएसएन x (देश के िलए मािसक वा(तिवक राज(व)

एसआरएन = राNय के िलए मािसक वा(तिवक राNय राज(व

= िपछले 3 िव;तीय वषf के िलए ;येक राNय हेतु कुल राज(व

िपछले 3 िव;तीय वषf के िलए सभी राNय/संघ-राNय Kे6 का कुल राज(व

नोट: कुल राज(व राNय/संघ-राNय Kे6 !ारा अंतर-राNयीय परिमट शु?क क वसूली से एकि6त कुल राज(व होना चािहए ।

6.
ािधकृ ित /परिमट का काय.-े और वैधता:

ािधकृित/परिमट पूरे देश के िलए माय होना चािहए । इसका उपयोग अपने िनजी सामान के साथ UयिBतगत या

समूह म याि6य के परवहन के िलए -कया जाना चािहए । इस ािधकृित/परिमट क मायता, एक वष5 या इससे अिधक,

अगर पय5टक वाहन परचालक !ारा ऐसी लंबी अविध के िलए िलया जाता है, होनी चािहए । कोई भी UयिBत या UयिBतय के

समूह को पय5टक वाहन का इ(तेमाल तब तक नहC करना चािहए जब तक अंतर-राNयीय या6ा के िलए वाहन संचालक के पास

UयिBतगत या एक समूह के प म इलेB[ॉिनक या अय प म माय अनुबंध न हो ।

7.
ािधकृ ित/परिमट जारी करने के िलए आवेदन
#0या:

(1) ािधकृित/परिमट के िलए ऐसे परवहन ािधकरण म आवेदन करना चािहए, िजनके Kे6ािधकार म वाहन का

पंजीकरण -कया गया हो या राNय/संघ-राNय Kे6 !ारा अिधकृत अय ऐसा ािधकृ त ािधकरण हो । राNय/संघ-

राNय Kे6 !ारा ािधकृत ऐसे अय अिधकृत ािधकरण के पास इन िनयम के अंतग5त परवहन ािधकरण क

भूिमका और उह सhपी गई िजमेदारयां िनभाने के अिधकार ह1 ।

(2) परवहन ािधकरण वाहन क जांच कर सकते ह1 ता-क यह सुिनि*चत -कया जा सके -क वाहन सभी िनयम के

अनु प और सड़क के अनुकूल ह ।

(3) परवहन ािधकरण ऐसे सटीक और पया5jत कारण के आधार पर उप-िनयम (1) के तहत -कए गए आवेदन को

अ(वीकृत कर सकते ह1, िजह िलिखत म देना होगा । हालां-क, -कसी आवेदन को अ(वीकृत करने से पहले आवेदक को

अपने आवेदन क पुिQट करने का अवसर -दया जाना चािहए ।

(4) अगर आवेदन करने के 30 -दन के भीतर परवहन ािधकरण !ारा कोई िनण5य नहC िलया जाता है तो उस परिमट

को (वीकृत माना जाएगा और इलेB[ॉिनक पkित के जरए इसे तैयार -कया जाएगा ।

(5) आवेदन करने, ऑनलाइन भुगतान और परिमट जारी करने को सुकर बनाने के िलए एक वेब आधारत इलेB[ॉिनक

णाली िवकिसत क जानी चािहए ।

8. परिमट का हतांतरण
तरण

(1) उप-िनयम (2) म अय (व प म िनिहत, ािधकृित/परिमट जारी करने वाले परवहन ािधकरण क अनुमित को

छोड़कर -कसी UयिBत !ारा अय UयिBत को ािधकृित/परिमट का ह(तांतरण नहC -कया जा सकता है ।

(2) जहां ािधकृित/परिमट द;त सं(वीकृत वाहन के (वािम;व म, वाहन क िब\ या (वामी क मृ;यु के कारण परवत5न

होता है, नया (वामी/उ;तरािधकारी, जैसा भी मामला हो, िब\/मृ;यु जैसा भी मामला हो, के एक माह के अंदर अिधकारता

परवहन ािधकरण को (वािम;व परवत5न को संसिू चत करने के अOयधीन ािधकृित/परिमट का उपयोग कर सकेगा ।

बशतX, परवहन ािधकरण अगर संतुQट होता है -क आवेदक को िवशेष अविध के भीतर आवेदन करने से रोका गया

था तो वह बताई गई एक महीने क अविध समाjत होने के बाद -कए गए आवेदन पर िवचार कर सकता है ।

9. वाहन का
ितथापन –
ािधकृित/परिमट धारक अिधकारता परवहन ािधकरण क अनुमित से ािधकृित/परिमट !ारा कवर -कए &ए -कसी भी

वाहन को एक ही कृित के -कसी अय वाहन से ित(थािपत कर सकता है।

(पAीकरण- इस िनयम के योजनाथ5 के िलए अिभUयिBत ‘उसी कृित के’ वाहन का अथ5 है एक ही बैठने क Kमता िजसके

िलए परिमट -दया गया है तथा समn शु?क चुकाया गया है तथा ऐसा ित(थापन वाहन -कसी भी अय मेक या मॉडल का हो

सकता है।

10. अपील -

-कसी भी Uयि% का परवहन ािधकारी !ारा क गई िननिलिखत कार5 वाई के ित असंतुQट होना:

(क) ािधकृित/परिमट जारी करने से इनकार करने पर, या

(ख) ािधकृित/परिमट का िनरसन या िनलंबन अथवा उसक ि(थित म -कसी कार क त8दीली, या

(ग) इन िनयम के िनयम 8 या िनयम 9 के तहत ािधकृित/परिमट के ह(तांतरण से मना करने का आदेश, या

(घ) ािधकृित/परिमट का नवीनीकरण करने से मना करने का आदेश, या

(ङ) परिमट से संबंिधत -कसी अय आदेश पर आवेदक !ारा उBत आदेश ाjत करने क ितिथ से तीस -दन क अविध के

भीतर राNय परवहन ािधकरण के समK अपील क जा सकती है। इसके बाद यह ािधकरण ऐसे Uयि% और

परवहन ािधकरण को अपना अपना पK रखने का अवसर देने के बाद िनण5य लेगा और दोनो पK को इस िनण5य का

पालन करना होगा।

11. पय.टक वाहन क* आयु –

वाहन को -दए गए परिमट के बारह वष5 पूरा होने क ितिथ से ािधकृित/परिमट को अमाय समझा जायेगा।

(पQटीकरण- इस िनयम के योजन के िलए संबंिधत पय5टक वाहन के पहले पंजीकरण क ितिथ से बारह वष5 क अविध तक

परकिलत -कया जायेगा।

12 . िवशेषता सूचक िच8ह-

इन िनयम के तहत जारी ािधकृित/परिमट के अंतग5त आने वाले ;येक वाहन के पीछे और बाo ओर नीले वृ;त म सफेद रं ग

से ऐसे ािधकृित/परिमट क वैधता के साथ श8द ‘अिखल भारतीय पय5टक ािधकृित’ या ‘अिखल भारतीय पय5टक परिमट’ जो

भी मामला हो, िलखा होना चािहए।

13. पय.टक, क* सूची-

ािधकृित/परिमट के अंतग5त चल रहे पय5टक वाहन म हर समय इलेB[ॉिनक प म या कागज पर पय5टक क एक सूची होनी

चािहए, िजसम ;येक या6ी क या6ा के आरंभ और गंतUय (थान के बारे म िव(तार से जानकारी हो। अिधिनयम के तहत या

इसके अंतग5त बनाए गए िनयम के तहत अिधकृत अिधकारी !ारा कागजात क मांग करने पर उह यह सूची उपल8ध कराई

जानी चािहए।

14. यािय, का बीमा-

ािधकृित/परिमट के अंतग5त चल रहा ;येक वाहन या6ी देयता कवर के िलए बीिमत होगा । बीमा म चालक क देयता भी

शािमल होनी चािहए ।

15.

ािधकृ ित/परिमट धारक =ारा अपने पास रखी जाने वाली जानकारी :-
ािधकृित/परिमट वाले पय5टक वाहन के ;येक परचालक को या6ा के 8यौरे सिहत याि6य का रकाड5 कम से कम एक वष5

क अविध तक अपने पास रखना चािहए । अिधकारता परवहन ािधकरण !ारा मांगे जाने पर ये रकाड5 उपल8ध करवाए

जाने चािहए।

16.
ािधकृ ित/परिमट वाले पय.टक वाहन, के िलए अितर?त शत@:-

(i) वाहन म एक फा(टैग (थािपत होना चािहए ।

(ii) वाहन म आपातकाल चेतावनी णाली के साथ ही वाहन [ैeकग उपकरण लगा होना चािहए जैसा-क एआईएस-140

म िविन@दQट -कया गया है ।

(iii) वाहन म िननिलिखत कागजात इलेB[ॉिनक प म या कागज पर हर समय उपल8ध होने चािहए और अिधिनयम के

तहत या अिधकृत अिधकारी !ारा मांग करने पर उनके समK यह (तु -कए जाने चािहए । ये कागजात ह1:-

(ख) बीमा माणप6

(ग) पंजीकरण माणप6

NOTIFICATION
New Delhi, the 12th September, 2018

G.S.R. 873(E).—The following draft rules, which the Central Government proposes to make in
exercise of the powers conferred by sub-section (14) read with sub-section (9) of section 88 of the Motor
Vehicles Act, 1988 (59 of 1988), are hereby published as required by sub-section (1) of section 212 of the
said Act for information of all persons likely to be affected thereby and notice is hereby given that the said
draft rules will be taken into consideration after expiry of a period of forty-five days from the date on which
the copies of this notification, as published in the Gazette of India, are made available to the public;

Objections or suggestions, if any, may be sent to the Joint Secretary (Transport), Ministry of Road
Transport and Highways, Transport Bhawan, 1, Parliament Street, New Delhi-110 001;

Any objections or suggestions, which may be received from any person with respect to the said draft
rules before the expiry of the period aforesaid, shall be considered by the Central Government.

Draft Rules

1. Short title, extent, commencement and exemption. -

(1) These rules may be called the Motor Vehicles (All India Tourist Vehicles Authorisation and Permit)
Rules, 2018 and shall substitute the Motor Vehicles (All India Permit for Tourist Transport Operators)
Rules, 1993.

(2) They shall extend to the whole of India.

(3) They shall come into force on the date of their final publication in the official Gazette.

2. Definitions. -
(1) In these rules, unless the context otherwise requires, -

(a) “Act” means the Motor Vehicles Act, 1988.

(b) “All India Authorisation for Tourist Vehicle” hereinafter referred to as “Authorisation” means an
authority issued by a transport authority to a Tourist Vehicle operator authorizing him to operate
the vehicle throughout the territory of India subject to payment of permit charges set by the
respective States/ UT through which it would ply.

(c) “All India Tourist Permit” hereinafter referred to as “permit” means a permit granted to a vehicle
authorizing it to operate in whole of India, without payment of any additional charge levied by
any state/ UT on account of the permit;

(d) “Transport authority” means the authority which is authorised under the Act to grant a permit in
respect of a tourist vehicle;

(e) “Form” means a Form specified in these rules;

(f) “rule” means rule of the Central Motor Vehicle Rules, 1989;

(g) “section” means section of the Act;

(h) “Tourist Vehicle Operator” means a company or firm or an individual engaged in the business of
promotion of tourism by providing tourist transport vehicles;

(i) “Tourist Vehicle” means a contract carriage, constructed or adapted and equipped and
maintained in accordance with such specifications as may be prescribed in this behalf.

(2) The Authorization/ Permit shall be issued only to the Operator of Tourist Vehicles.

3. Form, contents, duration etc. of the Authorisation/ Permit. -

(1) Every application for the issue/ renewal of an Authorization/ Permit shall be made in electronic form to
the jurisdictional Transport Authority in Form-1.

(2) The Authorization and the Permit shall be issued in Form 2 and Form 3 respectively, and shall be valid
for a period for one year or more, if opted for such longer period by the operator of the tourist vehicle.

4. Fee for issue of Authorisation/ Permit. –

Every application for the issue of an Authorisation/ Permit shall be accompanied with a consolidated
permit fee as per undermentioned table to be deposited in the All India Authorization Tourist Vehicle
Permit account for issue of a permit to operate throughout the territory of India.

Provided that where an Operator has applied for issue of a permit, which does not have an
authorisation, the fee for authorisation shall also be payable.

Explanation: For the purpose of this rule, the expression “All India Tourist Vehicle Permit account”
means an account to be maintained by the Central Government and notified in the Official Gazette.

5. Distribution of consolidated Authorisation/ Permit fee among States and Union Territories. -

The fee paid towards authorisation shall be remitted on a monthly basis to the jurisdictional State. The
distribution of Permit fee collected in the “All India Tourist Vehicle Permit account” specified in rule 4
of these rules, among the States and Union territories, shall be as per the formula given below:

SRn = SSn x (Actual revenue for the month for the country)
SRn = Actual State Revenue for the month for nth State
SSn = State share of nth State
= Total revenue for each State for preceding three financial years
Total revenue of the all the states/ UTs for preceding three financial
years

Note: Total revenue shall be the total revenue collected by the state/ UT from levy of Inter-state
permit charges.

6. Scope and Validity of the authorisation / permit. –

The authorisation/ permit shall be valid for the whole of India. It shall be used for the transport of
passengers individually or in a group, along with their personal luggage. The validity of the
authorisation/ permit shall be one year or more, if opted for such longer period by the tourist vehicle
operator. No individual or a group of individuals, shall use the tourist vehicle, unless they have a valid
contract in electronic form or otherwise, with the vehicle operator for the inter-state travel, individually
or as a group.

7. Procedure of applying for issue of Authorisation/ Permit. —

(1) An application for an Authorisation/ Permit may be made to the Transport Authority under whose
jurisdiction the vehicle is registered or any other authority authorised by the state/UT in this behalf.
Such other authority, if so authorised by the State/ UT, shall have powers to discharge all the roles and
responsibilities assigned to the Transport Authority under these rules.

(2) The Transport Authority may inspect the vehicle to ensure that it is compliant with the regulations and
is road worthy.

(3) The Transport Authority may reject the application made under sub-rule (1) for good and sufficient
reasons to be recorded in writing. However, before rejecting an application, an opportunity shall be
given to the applicant to substantiate his application.

(4) If no decision is taken by the Transport Authority within 30 days of the application, the permit shall be
deemed to have been granted and generated through electronic system.

(5) A web based electronic system shall be developed to facilitate the filing of application, online payment
and issue of permits.

8. Transfer of Permit. —

(1) Save as otherwise provided in sub-rule (2), an Authorisation/ Permit shall not be transferable from
one person to another except with the permission of the Transport Authority which issued the Authorisation/
Permit.

(2) Where the ownership of the vehicle granted an Authorisation/ Permit changes due to the sale of the
vehicle or death of the owner, the new owner/ successor, as the case may be, shall use the Authorization/
Permit, subject to intimation of the change of ownership to the jurisdictional transport authority within a
month from the sale/ death as the case may be.

Provided that the Transport Authority may entertain an application made after the expiry of the said
period of one month, if it is satisfied that the applicant was prevented from making an application within the
specified time.

9. Replacement of vehicle. —

The holder of an Authorisation/ Permit may, with the permission of the jurisdictional Transport
Authority, replace any vehicle covered by the Authorization/ Permit by any other vehicle of the same nature.

Explanation. — For the purpose of this rule, the expression “the vehicle of same nature” means having the
same seating capacity for which permit has been granted and composite fee paid and such a
replacement vehicle could be of any other make or model.

10. Appeals. —
Any person aggrieved by the action of the Transport Authority against:
(a) the refusal to issue an Authorisation/ Permit; or
(b) the revocation or suspension of the Authorisation/ Permit or any variation of the condition
thereof; or
(c) the order of refusal to transfer the Authorisation/ Permit under rule 8 or rule 9 of these rules; or
(d) the order of refusal to renew an Authorisation/ Permit; or
(e) any other order which may be made in connection with the Permit,

may within a period of thirty days from the date on which the said order is received by the applicant,
appeal to the State Transport Authority, who shall give a decision thereon after giving such person and
the Transport Authority an opportunity of being heard, and such decision shall be binding on the
parties.

11. Age of the Tourist Vehicle. —

An Authorisation/ Permit shall be deemed to be invalid from the date on which the Vehicle covered by
the said permit completes twelve years.

Explanation.— For the purpose of this rule, the period of twelve years shall be computed from the date
of initial registration of the tourist Vehicle concerned.

12. Distinguishing mark. -

Every Vehicle under the Authorisation/ Permit issued under these rules shall exhibit the words ‘All
India Tourist Authorisation’ or ‘All India Tourist Permit’ as the case may be, along with the validity of
such Authorisation/ Permit, on the rear and left side of the vehicle, in white letters in a blue circle.

13. List of Tourists. —

A Tourist Vehicle plying under the Authorisation/ Permit shall at all times carry a list of passengers in
electronic or in paper form, which shall include the details of origin and the destination of each
passenger. The list shall be produced on demand by the officers authorised to demand production of
documents by or under the Act or the Rules made there under.

14. Insurance of Passengers. -

Every vehicle operating under the Authorisation/ Permit shall be insured for Passenger Liability cover.
The insurance shall also include the liability for driver.

15. Information to be kept by every Authorisation/ Permit Holder. —

Every operator having tourist vehicles with Authorisation/ Permit shall keep a record of the passengers,

including journey details, for a minimum period of one year. These records shall be made available to
the jurisdictional Transport Authority on demand.

16. Additional Conditions for Tourist vehicles having Authorisation/ Permit -

(i) The vehicle must have a Fastag installed.

(ii) The vehicle should have a Vehicle Tracking Device installed along with Panic alert mechanism
as specified in AIS-140.

(iii) The vehicle shall at all times carry the following documents in paper or in electronic form and
these shall be produced on demand by an officer empowered to demand documents by or under
the Act, namely: —

(a) Certificate of fitness,

(b) Certificate of insurance,
(c) Certificate of registration,
(d) National permit/ Authorisation.
