Legal Process
Section 107 of the Land Act
provides that the National or
County Government should
submit a request for compulsory
acquisition of land to the NLC,
which will effect the acquisition
on behalf of the acquiring body.
The Land Regulations 2017
Legal Notice 280 of 2017
provides the following steps after
submitting the request.
i. The Acquiring body shall confirm in writing that it has sufficient funds to acquire the land and the
NLC shall ensure that georeferencing on the land has been undertaken.
ii. The NLC should the publish a thirty-day notice of intention to acquire the land in the gazette and
two newspapers of nationwide circulation, a local newspaper, and affix notices in the County and

The notice should also be served on the affected parties and the registrar of titles. The Land

The NLC shall in collaboration with the affected parties collect details on the land, such as, its
location, area, current use and proposed use.

days the NLC shall conduct the inquiry to hear and determine proprietary issues and claims for
compensation.

xi. Where only a part of the land is being acquired, the NLC shall cause the land to be surveyed and a
cadastral map and plan prepared before payment of compensation.
xii. The acquiring body deposits compensation funds together with survey, registration fees and all
other incidental costs with the NLC, which in turn pays the entitled persons within ninety (90) days.
xiii. After payment of compensation, the proprietor delivers shall within fifteen (15) days deliver the title
to the NLC which prepares transfer documents to be executed by the proprietor and forwarded to
the registrar.
