Software once installed cannot be returned / reimbursed under any circumstance.. Quotation is valid for one month only. Please

TERMS & CONDITIONS

1) SOFTGUN (hereafter referred to as the software) once installed, cannot be returned / refunded under any
circumstance. You cannot sell, resell, rent, lease or exchange the Software for anything of value.
2) No attempt should be made to pirate / install SOFTGUN to unauthorized computers.
3) We will not be liable to recover / re-enter / modify data corrupted due to any reason like bad sectors / power
interruptions, disk corruption of any sort of hardware / software problem.
4) Support will be provided over phone, email or through remote connection vide internet.
5) Onsite training period per session will be for a maximum of 6 hours. Proportionate charges to be paid if training
is taken in excess to that.
6) The overall speed of the data processing depends basically on hardware configuration, LAN settings, operating
system and the volume of data. We do not have any option to increase the speed through software.
7) The problem of hanging of computer is due to virus / corruption of operating system / fault in hardware. We do
not have any solution for that and it may not be caused by our software.
8) In case of formatting / transfer of computer, the software must be unregistered and the unregistration
information should be sent to us prior to it. The formatting / transfer process should be carried out only after
you receive consenting reply from us. We will not be liable to provide you new registration in absence of the
same.
Fresh registration will be provided only if you are under AMC contract.
9) Any dispute arising out of this agreement will fall under the jurisdiction of Kolkata Court only.
10) The maximum amount refundable in case of any jurisdiction imposed on us will not be more than the software
cost and will not include training/installation charges.
11) We only provide a link between you and SMS service provider and we are not liable for any issue in regards to
SMS delivery, delay, non-reaching, network problem or in any other matter related to SMS service. SMS
charges are separate. If Govt/TRAI levies any extra charge on sms sending during the year then the same will
be levied on your balance sms pack.
12) Software prices do not include upgrades, new versions, changes or modifications.
13) The charges for modifications, visit, training, updates, AMC etc. may change from time to time, without prior
notice or information.
14) After purchasing the software and prior to its installation, you need to send us a stamped and signed
registration form which will have your complete details along with our terms and conditions.
15) The RAMC due date is calculated from date of purchase of software and not from last RAMC payment date.
16) In case of Online Training, the sessions must be completed within 1 month from the date of installation
else they will be forfeited.
17) The software is provided on an "as is" basis. Your use of the software is at your sole risk. (i) The Software may
meet not meet all your specific requirements (ii) the Software may not be compatible with some platforms.
18) You expressly understand and agree that we shall not be liable for any direct, indirect, incidental, special,
consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use,
data or other intangible losses related to the software, including, for example: (i) the use or the inability to use
the Software; (ii) the cost of procurement of substitute goods and services resulting from any goods, data,
information or services purchased or obtained or messages received or transactions entered into through or
from the Software; (iii) unauthorized access to or alteration of your transmissions of data; (iv) statements or
conduct of any third-party on the Software; (v) or any other matter relating to the Software.
