This deed of Trust made and executed on is made and executed on this 5th day of
February 2018 on behalf of “ SHREE SHIRIDI SAI BABA DHYANA MANDIRA
ASHRAMA CHARITABLE TRUST” hereinafter called as TRUST by the flowing
signature the terms signatories here inafter refferred as the Trustees. Which terms shall

NOW THIS TRUST WITNESSETH AS DECLARES AS FOLLOWS:


This Trust shall be called “SHREE SHIRADI SAI BABA DHYANA
MANDIRA ASHRAMA CHARITABLE TRUST” GENNERAHALLI VILLAGE &
POST, BANGARPET TALUK, KOLAR DISTRICT.

This deed of Trust hereinafter called Trust made on the 5th day of
February 2018 by the persons mentioned above as the authorize of the Trust
and in favour of “SHREE SHIRADI SAI BABA DHYANA MANDIRA
ASHRAMA CHARITABLE TRUST”.

This Trust shall be constituted and administrated accordance with the terms and
Conditions of this deed of Trust and the rules and regulations framed there under.
Wherever the covenants in this deed of trust do not specificallu define the rules and
regulations shall always be in accordance with the previsions of Indian Trust Act 1882
and rules made there under from time to time.

The Trust shall have the Registered Office at GENNERAHALLI VILLAGE & POST,
BANGARPET TALUK, KOLAR DISTRICT.

Area of Operation : Entire KARNATAKA STATE.

The Trust shall not have any immovable properties.

a) A sum of Rs.1,001/- donated by the each initially.

b) Land and Building that may bi acquired in future by lease, License, Mortgage or
Purchases and such contributions, donations, endowments, settlements, made by
public and the like for purpose of advancement and implementation of the
objects and purposes of the Trust

c) Such acquisitions and accretions to the estate of the Trust as may be made by the
Trustees.

The properties, the assets, effects, funds and the like of the Trust shall vest upon
the Trust, the Trustees perpetually fulfillment and effectuation of the object, and the
purpose of the “SHREE SHIRADI SAI BABA DHYANA MANDIRA ASHRAMA
CHARITABLE TRUST” GENNERAHALLI VILLAGE & POST, BANGARPET TALUK,
KOLAR DISTRICT.

1. All the donations, gifts, etc., shall be taken over possession only in the name of
the Trust by the President or the Secretary in his official capacity as a true
representative of the Trust and can never be in his personnel capacity.

2. First Board of Trustees, who is its founders shall enjoy powers of managing the
affairs of the Trust and they shall have powers to co-op. Others to fill up the
vacancies on the Board of the Trustees.

3. AIMS AND OBJECTS:-

a) To promote, establish and maintain Educational institutions i.e., Abacus


Classes, Other Education Related Classes, Technical Education, I.T.I
Polytechnics, T.C.H.
T.V. Training Institute, Computer Training Institute, Nursery, Primary, Middle
& High School, Pre-University, Degree, Master Degree, School and College of
Nursing and Medical, and Engineering Colleges, Ayurvedic College, Diploma
Courses, Job Oriented Courses, Pharmacy College and Blind School.

b) To start and maintain, Orphan Home, Children’s homes orphanges, creches,


women and old persons homes and also to construct homes for the poor
handicapped and destitute and make outright grants to the poor and needy
olf persons, widows and orphans.

c) To establish maintain, run, develop, improve, extend grant, donate for and aid
in the establishment, maintenance, improvement and extension of schools,
colleges, universities, Polytechnics and other educational institutions,
Software Institutions, including vocational training centers, research centers
and audio educational centers, and hostels for students pursuing their studies
& General Publicity awareness.

d) To protect the interest of the Scheduled Caste & Scheduled Tribes peoples.
And help the poor Scheduled Caste & Tribes peoples who are leaving below
poverty line. Creae awareness in the field of Judicial, Health and in social
activities. To work for the human rights among the peoples in Karnataka.

e) The Trust studentship, scholarship, stay funds, medal, prizes, etc., to help and
encourage deserving students and and to provide monetary aid to students,
schools and teachers for pursuing their education.

f) To establish, maintain, develop and donate for the establishment,


maintenance and development of Books Banks and Libraries.

g) To organize conduct and assist in the organizing and conduct of lectures,


seminars and symposis or arts, science, commerce and other subjects of
general and specific academic interest to students.

h) To raise loans for carrying out activities of the Trust from individuals,
institutions, banks, financial institutions, governmental and non-
governmental agencies, corporae business houses and other on suitable
terms and conditions.

i) In future To purchase, acquire, built, sell, manage and other deal with any
movable and immovablr property for earning income for the trust for and in
furtherance of the aims and objects of the Trust. At Present the Trust
does not have any immovable Property.

j) To promote Tailoring schools and Woman Training centers.

k) Promote Sport activities and establish Physical Education centers for physical
welfare. And Construct Indoor Stadium for Indoor Games and encourage the
sports activities and conduct Sports Tournaments National & State Level
games. And to collect donations funds for the Sports activities. And also open
Sports Hostel.

l) To establish educational institutions of all kinds based on the above ideals,


both residential and non-residential including crafts.

m) To teach humanities and sciences so as to bring out the distinctive qualities


inherent in each young individual to enable him to do greatest good to the
society and become its worthy member. And awareness of eco friendship, like
Trucking, Mountaining, rapping, family companying and Nature maintenance
camps.

n) In future properties To improve the Educational institutions and Rural


Development Programmes in Rural Area.

o) To undertake all nutrition programmed in various rural villages for women


and children.

p) To organize health camps, Yoga Classes, rural water supply sanitation,


environment, protection, and ecology in order to uplift the Rural and urban
areas.

q) To create memorials and monuments in the field of Culture, Literature,


Education, Science, Sports and other fields of public lift.

r) To create and promote awareness in the field of social and preventive


medicine especially with reference to AIDS and other communicable and
epiemic diseases.

s) To promote and conduct programmes of social and economical development


in rural and backward areas, and to Government and other agencies in the
implementation of such programmes and providing necessary feed back.

t) To provide various types of Technical, Non-technical, Cottage industries, Self


employment training programms like A) Automative repairs, B) Banking and
accounting. C) Pottery, D)Painting, E) Leather, F) Khadi, G)Carpentry, H)
Carpet making, I)Beauty culture and hairdressing, J) Chemicals, K) Electrical,
M) Electronics, N) Garment making O)Gems and Jewellery, P) Hospitality, Q)
Information and technology, R) Medical and Nursing S) Plastic processing, T)
Printing U) Process Information, V) To making, W) Food processing X)
Security services, Y) Agriculture, Z) Travel and tourism, AA) Fabrication,
AB)Production and manufacturing, AC) Refrigeration and air conditioning,
AD) Retailing.

u) The benefits of the society shall be open to all irrespective of caste, creed or
religion.

v) To print, publish and sell or gratuitously distribute books, periodicals, leaflets


and papers and also to maintain libraries and reading rooms for the
promotion of the objects of the Trust. Not violating the promises of Sec 11(4
A) RWS 80g (5) OF THE Income Tax Act 1961.

w) To establish and run Hospital, Yoga Room, Meditation Hall, Nature Care
Center.

x) To undertake the activities of publishing of newspaper, magazines, booklets,


periodicals for the propaganda of the objectives of the trust.

a. To provide and establish centre/s to promote fellowship, goodwill and


understanding India.
b. To encourage members of the community to participate in voluntary,
philanthropic, humanitarian and charitable services to assist the
disadvantaged, poor, elderly, needy and the underprivileged;

c. To facilitate the participation of younger members of the society in youth


camps or similar undertakings or projects to enable them to recognize
and develop their full potential, abilities and talents for their own
individual wellbeing and that of the advancement of the larger
community;
d. To organize spiritual, philosophical, recreational and cultural activities for
the younger members of the society to develop their self-esteem, self-
respect and self-confidence and to mould them into caring,
compassionate, discipline, law-abiding and responsible members of the
community;

e. To recognize and honour the contributions and sacrifices of the elderly in


the society by facilitating and encoraging their participation in religious,
cultural, recreational and social activities;
f. To promote greater awareness, better understanding, mutual respect,
unity, harmony and co-operation amongst peoples of diverse, ethnic,
racial, spiritual, cultural and religious backgrounds;

g. To organize and convene meetings, gatherings, classes, discoursed,


seminars, lectures to promote, foster, advance and enhance the
knowledge, understanding, respect, and appreciation of the priniciples
philosophy and the teaching of the Hindu faith, spiritual and religious
beliefs;

h. To print, publish, sell, distribute, scriptures, booklets, publications,


newspapers, materials which promote, foster, advance and enhance the
knowledge understating of the principles, philosophy practices and
teaching of the Hindu faith, spiritual and religious beliefs;

i. To organize, facilitate, hold, functions and events to mark, publicise and


celebrate religious and cultural festivals and to demonstrate their
significance in a multi-cultural and multi-religious society;

j. To advance and promote educational, religious and cultural activities in


the community for the well-being of the people of diverse and different
spiritual, religious beliefs and cultural backgrounds;

k. To build, erect and establish community centers, libraries, temples for


worship and prayer.

l. To establish contact, liaise, communicate, co-operate and maintain


regular and on-going contacts with bodies, organization and institutions
which have similar aims and objectives as the Trust.
m. To carry out such other charitable purposes as the Trustees of the Trust
shall determine from time to time and/or which may be lawfully carried
out under the laws of New Zealand.

n. In future properties to Construct Building for the use of Yoga &


Meditation & also construct Temples.

4. MEDICAL RELIEF-1: To establish, maintain, run, develop, improve, extend,


grant, donate for and to aid in the establishment, maintenance, running,
development, improvement and extension of hospitals, clintor, Poly-clinics,
dispensaries, medical laboratories, research, units with special emphasis on
medical research in modren medicine including Indian Systems of medicine like
Ayurvedic and similar institutions affording treatment, cure, rest, re-cooperation
and other medical relief to the public including relief to the old and physically
handicapped the aged and mentally retarded.

a. To organize, run and assist in the organizing and running of free medical
camps in rural areas.

4 For the furtherance of all or any of the aforesaid objects, the board of trustees
shall have authority:-
a) To solicit, obtain or accept, subscriptions, donations subsidiesm gifts from
any person, firm local bodies or corporate, gifts from any person, firm,
local bodies, or corporate bodies like industries, board/ commissions,
state or central govt., nationalized banks or any other recognized funding
agencies of welfare boards.

b) To acquire by gift, purchase, excharge, lease or hire or otherwise


howsoever any landm building, easemenets or any properties, moveable
or immoveable for furtherance of all or any one of the objectives of the
turst.
c) To sell, manage transfer, exchange mortgage, demolish, dispose off or
otherwise deal with the properties moveable or immoveable belonging to
the trust.

d) To built to construct and maintain houses or building, alter extend,


nimprove, repair, enlarge or modify the same including any existing
building with light water, drainage furthers for the use of which each
building is put up or held.

e) To borrow money or raise loans with or without securing or on the


secutrity of mortgage, change by hypothecation or pledge over all any of
the immovable properties belonging to the trust.

f) The Profit of the trust shall not be distributed among trustees, but shall be
utilized for the objectives of the trust.

5. RELIEF TO THE POOR:-


a) To assist and provide for the poor by constructing Communiry Halls, Rest
Houses, etc., and conduct feeding to the poor and to give good, clothing, Cash
grants to the poor, and to grant donations for the support of the inmates of
orphanages, rescue and rehabilitation centers and similar institutions. The
poor may also be assisted by way of teaching of Crafts, Entrepreneurship
Courses, Engineering and similar skills and Industrial training including job
training.

b) To provide relief by giving cash grants in time of natural calamities like Earth
Quakes, floods, famines etc.,

c) To do all that is necessary and incidental for the purpose of achieving the
objects.

6. OTHER OBJECTS OF GENERAL PUBLIC UTILITY:

a) To establish, run and aid free Public Reading Rooms and Libraries.

b) To create employment opportunities in the Animal Husbandry field.

c) To establish, run and aid prayer halls to which all sections of the public will
have access, provide credit facilities to entrepreneurs.

7. NAME:- The name of the Trust shall be “SHREE SHIRADI SAI BABA
DHYANA MANDIRA ASHRAMA CHARITABLE TRUST”.

8. OFFICE:- GENNERAHALLI VILLAGE & POST, BANGARPET TALUK, KOLAR


DISTRICT. The Working hours shall be from 10.00 AM to 4.00 PM and subject to
changes at the discretion of the Board of Trustees from time to time.

9. BOARD OF TRUSTEES:- The Board of Trustees shall consist of 06 members.

10. VACANCY:_ If any of the Trustees dies or resigns or desirous to retire or


absents himself from three consecutive meeting without leave or refuses or
becomes incapable to act in the trust hereof or acts in a manner detrimental to
the interest of the trust, then and in every such case it shall be lawful for the
surviving of continuing’s to appoint new Trustees instead.

11. MEMBERSHIP:- The Board of Trustees shall be the Trutees for life.

12. MEETING AND QUORUM:- The Board of Trustees shall meet at least once
in a month or more of often, if need be to transact the business of the Trust, Five
days notice shall be given of such meetings. The Quorum for a meeting shall be
2/3rd a meeting of the Trustees shall ordinarily be called by the Secretary General
but in extraordinary circumstances the chairman or Secretary may call such a
meeting.

13. POWERS OF THE BOARD:-


s. The Trustees shall settle and determine all matters arising in the course of or
incidental to the administration, management and execution of the Trust by a
vote of majority. If the votes are equally divide the PRESIDENT of the meeting
shall have a Second or Casting vote.

t. The Board of delegates any or all of their powers to any one of more of more
of the Trustees for such time and purpose as they deem fit.
c. The management and the controlled of the properties and affairs of the Trust
shall be vested in the Board of Trustees. The Trustees by themselves or
through an agent or agents employed by them manage and deal with the
Trust’s property in such a manner as may be most beneficial to the interest of
the Trust.

14. DONATIONS & CONTRIBUTIONS:- The Trustees shall have powers and
discretion to accept, upon such terms are they may think fit, any donations or
contributions (whether such donations or contribution always that the terms
upon which such donations or contributions are accepted shall not, in any way,
be inconsistent with or repugnant to the objects of this Trust and that no other
name shall associated with the name of this Trust. Such of the contributions
donations gifts etc., received from individuals private bodies, institutions/

organizations, are except from Income Tax under the provisions of Indian
Income Tax Act of 1961 under Sec 80-G 35-A, 35A-c 35(1)& (2) 35(1) and (3).

15. BANK OPERATION:- The Trustees shall open and maintain in the name of
the Trust a Banking Account or Account with such bank of banks as may from
time to time to determined by the Trustees and shall forth with pay or cause to
be paid the Income, Profits, Intrests, Rents, Dividends, Donations, Contributions,
and all other money belonging to the credit of any such account or accounts. Such
account or accounts shall be operated upon.

By such of the Trustees as may from time to time be authorized to do so by a


resolution of the Trust. These Trustees would be authorized to draw, make accept,
endorse and discount cheques, notes or other negotiable instrument and for his purpose
to sign, execute and deliver such assurances and deeds as may be necessary for the
purpose of the Trust.

16. AUDIT & ACCOUNTS OF THE TRUST: - The accounts of the trust shall be
audited by chartered accountant.

17. ACCOUNTING YEARS:- The Accounting year of the Trust shall be 1 st APRIL
to 31st MARCH of the succeeding year.

18. FUNCTIONS:-

A) PRESIDENT:- He shall preside over all the meetings of the Trust and transact
the business. And he is having full control over the Institution.

B) VICE PRESIDENT:- In the absence of President, he will discharge the duties


of President.

C) SECRETARY:- He shall be in charges of and responsible for the safe custody


of all records relating to the administration for the Trust and its properties.
He shall commence the meetings of the Board of Trustees under the direction
of the Chairman and maintain regular records of all the proceedings of such
meetings.

All correspondence and all financial statements and returns required in


connection with the management of the Trust will be carried on prepared by
the Secretary.

D) TREASURER:- He shall receive and disburse all the money of the Trust and
maintain or cause to be maintained proper accounts of the same. All legacies,
donations and subscriptions shall be paid to the Treasurer whose receipt will
be valid and binding on the Trust.

19. AMENDMENTS AND RULES:-


a. The Trustees shall have the power to amend, alter or rescind any of the
provisions of the Trust in a manner not consistent with the subjects of the
Trust any to interpret. Their meaning whenever the rules and regulations
framed do not cover any emergency or are ambiguous, provided that such
interpretation does not conflict with the aims and objects of the Trust. (If any
difficulty arises in giving effect to the provisions of the ‘Deed of Trust’ the
majority of the Trustees may be circulation or otherwise make such
provisions not consistent with the deed or trust as appears to be necessary or
expedient for removing the difficulty.

b. The Trustees shall form time to time make, after or mend the rules and
regulations with regard to the administration of the trust.

20. 80G INCOME TAX ACT:- a) INVESTMENT CLAUSE: The funds of the society
shall be invested in the modes specified under the provisions of the section 13(1)
(d) read with section 11(5) of the Income Tax Act 1961 as amended from time to
time.

21. AMENDMENT CLAUSE:- No Amendments to Memorandum of Association /


Bye-Laws / Rules and Regulations shall be made which prove to be repugnant to
the provisions of the Sections 2(15). 11, 12, 13 & 80G of the Income-Tax Act
1961, as amended from time to time. FURTHER NO AMENDMENT SHALL BE
CARRIED OUT WITHOUT THE PRIOR APPROVAL OF THE COMMISSIONER OF
INCOME TAX.

22. DISSOLUTION CLAUSE:- In the event of dissolution of winding up of the


Societies, the assets remaining as on the date of dissolution shall under no
circumstances be distributed among the members of the Managing committee /
governing body but the same shall be transferred to another charitable society
whosr objects are similar to those of Trusts.

23. BENEFICIARY CLAUSE:- The benefits of the Trust shall be open to all
irrespective of caste, creed or religion.

24. DISQUALIFICATION:-
a. Any who become a lunatic , convicted of a criminal offence, involving moral,
Turpitude, or physically incapacitated shall cease to be a.
b. Any may retire on giving notice of one Fourteen days Notice in writing of his
intention to do so.
25. DISSOLUTION CLAUSE:- In the event of dissolution or winding up of the
Trust, the assets remaining as on the date of dissolution shall under no
circumstances be distributed among the Trustees / Members of the managing
committee / governing body but the same shall be transferred to another
charitable trust / whose objects are similar to those of this trust which enjoys
recognition U/S. 80G of the I.T. Act 1961 as amended from time to time.
The funds and the income of the trust shall be soleyl utilized for the achievement
of the objects and no portion it shall be utilized for payment to / members by
way of profit, interest, dividend etc.,

26. The are wholly indemnified against any expenses and losses incurred or
suffered or any payments made by them in the administration of Trust and such
expenses, losses and payments shall borne by the Trust and non of the Trustees
shall in any manner be personally liable or responsible for the same.

27. All Deeds and others documents to be executed by or on behalf of the Trust
shall be done by the Chairman of the Trust and that the Trust may sue or sued in
the name of the Chairman General of the Trust.
