Nixon R, Aranas : City Councilor Justified Proposed Ordinance No. 511, series of 2019 CITY ORDINANCE NO. 2019-927 AN ORDINANCE AMENDING SEVERAL PROVISIONS OF CITY ORDINANCE NO. 2018-879 ENTITLED THE 2019 ANTIPOLO CITY REVENUE CODE, AND FOR OTHER PURPOSES. ON WAYS AND MEANS WHEREAS, the Sangguniang Panlungsod of the City of Antipolo enacted City Ordinance No. 2018-879 entitled “2019 Antipolo City Revenue Code”, Scanned with CamScanner APPROVED: ANDREA i g WHEREAS, the said Ordinance took effect on 01 January 2019 after its Publication in a newspaper of local circulation. WHEREAS, after due deliberation with the different departments and offices of the City Government of Antipolo and to be consistent with the current situation Prevailing in the locality, there is a need to amend/supplant certain provisions in the 2019 Antipolo City Revenue Code. WHEREAS, it is also the policy of the City of Antipolo to ensure that concems of its citizens are fairly resolved to the end that existing ordinances do not unduly burden the lives of its people, and that the effect of the provisions of these ordinances do not create an adverse impact on its citizenry, without sacrificing the economic and social vitality of and viability of the City, WHEREAS, after a careful deliberation and review of the 2019 Antipolo. City Revenue Code, the Sanggunian Panlungsod resolved to amend certain provisions of the same. NOW THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED by the SANGGUNIANG PANLUNGSOD of ANTIPOLO CITY, in session duly assembled, that: SECTION 1. Section 1C.01 is hereby amended to read as follows: Section 1C.01. Definitions - When used in this Code: (a) mx (p) Primary Tourism Enterprises refer to travel_and_tour services: lan air transport services exclusivel for__tourist_u mmodati lishments, vent exhibition organizers; tourism estate management services; and such other enterprises as may. be identified by the Tourism Office. (q) Rental means the value of the consideration, whether in money, or otherwise, given for the enjoyment or use of a thing. (®) Residents refer to natural persons who have their habitual residence in the province, city, or municipality where they exercise their civil rights and fulfill their civil obligations, and to juridical persons for which the law or any other provision creating or recognizing them fixes their residence in a particular province, city or municipality. (w) Wholesale means a sale where the purchaser buys or imports the commodities for resale to persons other than the end user regardless of the quantity of the transaction. SECTION 2. A new section designated as Section 2A.12 is hereby inserted to read as follows: Section 2A.12, Compromise Agreement. The City Treasurer, 5 with prior approval of the City Mayor and subject to Department of Finance-Bureau of Local_Government Finance (DOF-BLGP) circularls issued for the said purpose, is granted the authority to enter into compromise agreement of delinquent realty tax with the owner of the real propert or the person having legal interest therein without prejudice to the right of the City Government to resort to judicial andlor administrative remedies should the taxpayer violate the contract or default iu installment payments. SECTION 3. Section 3A.01 is hereby amended to read as follows: Section 3A.01. Mayor's Permit. All persons doing business within the City of Antipolo are required to obtain a Mayor’s Permit for the privilege of conducting such business.The BPLO is hereby authorized to close down or lock up Dusinesses operating without a business permit, without prejudice to the imposition of penalties in Section 3A.07 hereof. Section 3A.05. (b) is hereby amended to read as follows: (b) Application for Mayor's Permit: False Statement, Requirement and liability for an application for a Mayor's Permit shall be filed with the City Government of Antipolo through the Business Permit and Licensing Office (BPLO). The form for the Purpose shall be issued by the same Office and shall set forth the requisite information including the name and residence of the applicant, the description of business or undertaking that is to be conducted, and such other data or information as may be required.
