EXECUTIVE SUMMARY
This report covers the status of the project roads under the Upgrading to Bitumen Standard Of
Mogonga-Kenyenya-Riokindo-Nyabitunwa/Riokindo-Magenche-Kenyenya/Mariba-Nyagancha-
Eberege-Daraja/Riokindo-Kenyenya TTC- Magena Roads Project of contract number as RWC 217 as
at June 2024. The tender was awarded to M/s KIU Construction Company Limited on 9th May 2016 at
a tender sum of Kshs. 1,926,696,196.18 for upgrading works and Kshs. 271,749,079.68 for
Performance Based Routine Maintenance.. The Project commenced on 5th August, 2016.The current
physical progress is at 70.29% against 259.01% (93.3 months) time elapsed.

An amount of Ksh 1,990,160,455.21 (including advance) has been expended to date and an amount of
Ksh. 192,669,619.62of the advance payment has been recovered. The Contract sum has been
exhausted and the Contractor has not been able to construct Riokindo – Magenche road link of 5.35km
and the approach roads on section for construction of the Box Culverts.

The contractor has substantially handed over parts of the completed road sections which are under
defect liability period effective 17 th August 2023.The state of the contract roads currently is
summarized in the table below;

The Contractor has also not installed road furniture for the completed sections and other concrete and
drainage works. The Contractor has been able to complete approximately 40.3km of the project road
to black top against 47.0km of the project length and has equally installed 3No. Concrete Box
Culverts against the 7No. Instructed on the Project Road. The Contractor has not installed quite a
number of major and public access culverts along the completed sections of the project road.

The project cost appraisal was done to compare the quantities of the works carried out and the
projected quantities in order to ascertain whether the quantities provided will be adequate for the
intended scope of works. The analysis considered scope of works and inspection of other
topographical features on site. It is projected that an additional amount would be required over and
above the original Contract Sum in order to complete the Project Works. The amount covering the
increased quantities of works on the Project Road and the Nature of Works that were not evident at the
time of tender.
1 PROJECT OVERVIEW AND DESCRIPTION
1.1 Project Location

The project road is located in Kisii County and is approximately 47km long. The first section starts off
at Mogonga, B3/C883 junction and runs in a westerly direction traversing through Kenyenya, and
Mariba markets and ends at Magenche Market. The second section starts at Kenyenya Market passing
through Riokindo and terminates at Nyabitunwa at the border with Narok County. The third section
starts at Magenche Market passing through Riokindo Shopping Centre traversing through Kenyenya
TTC and terminates at Magena Market on Road B3. The other section starts at Mariba market passing
through Nyagancha Market and traversing through Eberege Tea Factory and Ends at Daraja.

The Project Road comprises of various road links which adds up to approximately 47.0 km as
summarized in the table,

1.2 Extent of Contract


The project roads are to be improved to bitumen standard. The major works to be executed comprises
mainly of but are not limited to the following:
i. Site clearance and top soil removal,
ii. Earth works,
iii. Construction of standard pipe culverts, box culverts a bridge and the improvement other
drainage and soil erosion protection works,
iv. Construction of improved subgrade ,
v. Construction of 200mm gravel sub-base of minimum CBR of 30% (G30) on carriageway
and shoulders,
vi. Construction of 125mm thick cement/lime improved gravel base of minimum CBR 160%
(CIG160) on carriageway and shoulders,
vii. Application of double seal surface dressing of 80/100 penetration grade bitumen and
14/20 mm and 6/10 mm pre-coated chippings on carriage way and shoulders,
viii. The carriage way shall be 6.0m wide with shoulders of 0.5m wide on either sides
constructed with the material and thickness for sub-base and base as above,
ix. Installation of road furniture,
x. Maintenance of works during construction and during the defects liability period, and
xi. Maintenance of passage of traffic through and around the works
1.3 Physical Work Progress

The contractor substantially completed all major works and handed over to the employer on 17 th
August 2023 after inspection of the works. The completed sections are under defect liability period
effective from 17th August 2024. The status of the work is summarized in the table below;

ACTIVITY

The Contractor stopped site operations on 1st November, 2023 and resumed site operations on 9th
January, 2024 vide a notice through a letter Ref. No. KIU/MKR/RE-125 dated 9th January, 2024. The
Contractor suspended works again as from 1st March 2024 and has not resumed to site to date.

1.4 Defects and Snag List

The following outstanding works and defects on the snag list has not been effected to date.

1. Access Culverts at isolated locations along the completed sections


2. Stone pitching and scour checks at isolated Locations
3. Road furniture and Road marking
4. The 2nd Seal Surface Dressing from Km 1+000 –km 10+384 along Mariba-Nyagancha-Eberege
–Daraja Road section has not been provided.
5. Guardrails at box culverts locations have not been installed
6. Concrete lining from km 0+000 to km 0+360 LHS along Mogonga - Kenyenya – Daraja has not
been installed
7. The Concrete Box Culverts along the Road Links outlined in the table below have not been
constructed;

3 CONCLUSION
The Contract sum has been exhausted and therefore the Contractor has not been able to execute the
following outstanding works in the contract;
i. Construction of Riokindo – Magenche road link of 5.35km
ii. Construction of approach roads on sections where Box Culverts have not been installed.
iii. Construction of four No. Concrete Box culverts.
iv. Installation of road furniture for the completed sections.
v. Installation of assorted access culverts and constructions of access roads along the completed
sections of the project road.
