Subject: - Submission of request for the amendments in conditions of contract, rental prices and
confirmation of our mobilization of camps, smaller TNP.

Dear Sir,

This is with reference to your E-mail received by us on 17 th of June 2024, we would like to confirm
our investment for the smaller equipment’s like jackhammer, loose tools, camps, labor deployment etc. &
mobilization from our end, we propose to submit a request for a meeting to finalize the work contract, & work
contract price with reference to the price submitted by us for the individual items.

We would like to draw your attention towards our amendment request of few clauses as mentioned below: -

1. Clause no. 5.1 (Performance Security)

It is requested to please deduct 6% as a retention or performance security from our running bills till the
completion of work contract. as a contractor we need funds to manage site adequately, and which is very
important for the smooth operation of site and work contract. our half of the performance security shall be
released after 3 months from the date of submission of completion certificate of contract and remaining 50% after
6 months from the date of submission of completion certificate of work.

2. Clause no. 19 safety Appendix (6)

As per the Appendix (6) Point no. 28 (Health care facilities) it is requested by us to please provide us a clinic,
ambulance & Operational staff of clinic from your end, at your own cost. Charges for any medicinal usage,
ambulance fueling & driver wages shall be deducted from us.

3. Clause no. 25 Construction equipment.

Please refer point no. 25.6 “Employer’s Construction Equipment” The rental submitted by us as Annexure B which
is enclosed with this letter is requested to be accepted by you as we have made the revised rental deductions
keeping the outcome & expenditures of site in consideration, which seems out to be budgetary to us also keeping
the smooth operations of project in mind.

As per your mail received & input given by your good self-regarding the rentals of Boomer, JCB, Truck & Bobcat.
We would like to submit some clarifications with context to the Annexure B of revised rental attached.

1. Boomer: we can afford maximum Rupees 12 lakhs as a rental of Boomer, which includes the cost of operator.
2. JCB: we cannot afford Rupees 2 lakh as a monthly rent for a JCB, in case if it does not seem viable, we can
arrange the particular equipment on rental basis on our own also.

3. Truck: 6 Tired prices as 1.5 lakh to 2 lakh is for 400 cft capacity truck, we will be requiring 200 cft capacity
truck which is also a 6 tired but its rental is half of the rental of 400cft truck, as per the dimensions of our HRT
we will be requiring small 6 Tired Truck.
4. Bobcat: The average price on market for small bobcat IR 450 is Rupees 80000, as we can afford Rupees
120000.
5. Repairing, servicing, lubricants: shall be born by you as the equipment is on rental basis, in case of boomer
we will only bear the cost of drill rods and drill bits, other cost of servicing any part replacement of boomer or
drifter shall be born by you, replacement of tires of the equipment, excavator or JCB bucket teeth shall also be
borne by you.
6. Wages: of movable equipment operators shall be born by you, fooding may be deducted from their wages &
reimbursed to us, we will only provide lodging free of cost to these operators or drivers.
7. Transportation: of machinery or any repairable part, replaceable part, service material shall be born by you
as the machinery is on rental basis, as machinery will be used for more than 6 months freight charges till the
site TO & FRO shall also be born by you as per common rental terms.

4. Clause no. 30 Defect Liability Period

During Defect liability period we will deploy our one quality control employee at our own cost for risk analyzation
after the submission of completion certificate of work, defects shall be jointly examined, signed and repaired by us.
The lodging & fooding shall be provided by you at free of cost.

5. Clause no. 40 Taxes & Royalties

As per point number 40.2, The Principal employer should be responsible for paying royalties (for mining as per
extraction from tunneling) as the extraction will be used in gabions, Rcc walls, & backfilling for contractual use
only.

6. Clause 43.3 Advance payments

Please consider our request to make the advances & recovery of ESM as interest free as the advances and ESM shall
be used for the construction of project only.

7. Clause no. 32, 33 & 88 Identify defects through quality assurance and inspection, Tests & Quality control
records.
As records shall be kept jointly, quality control records, labs & test shall be in your scope, lab & its operations shall
be operated and maintained by you at your own cost.
Please consider our request for the amendments in terms of contract as mentioned above and confirm the same or
discuss regarding the above amendments in our next meeting for finalizing the work order.
