BETWEEN
Resident

(“Seller”) which expression shall where the context so admits include and mean
his legal representatives, succcessors-in –interest and assigns, of First Part;
AND
Resident
Of____________________________________________________________________
(“Buyer”) which expression shall where the context so admits include and mean
his legal representatives, successor-in-interest and assigns, of the Second Part;
AND WHEREAS the Seller agress to sell and the Buyer agrees to buy the right
of membership/plot/file of Sellers’ in property situated in Defense Housing
Authority, Peshawar having membership No.________ dated _____________,
File/Plot No.___________________ Street No.__________, Defense Authority
(Alloted/transferred vide DHA Peshawar Allotment letter no._________________
dated _______________), hereinafter referred to as “Property”
1. That the Seller undertakes that the Property is free from all claims, liens
encumbrances and charges of whatsoever nature, and the Seller is seized
and possessed of and otherwise well and sufficiently entitled to transfer and
sell his rights therein.
2. That the Seller has agreed to sell and the Buyer has agreed to purchase the
Property described hereto above, at a mutually agreed price of
Rs.___________/(Rupees __________________________ only) as total
consideration/sale amount of the aforesaid Property.
3. That the buyer has paid to Seller a balance amount of
Rs.________________/(Rupees_____________________________) in cash
which the Seller acknowledges receiving.
4. That the Seller confirms having handed over all the original
title/allotment/transfer documents to DHA Peshawar to enable the Buyer to
finalize the sale/transfer in his and Buyer also confirms taking the aforesaid
letters/documents.
5. That all expenses incurred upon transfer including all limited to all the
applicable expenses, taxes, cesss etc with DHA till the date of registration of
sale deed.
6. That the Seller shall, when called upon by the DHA Peshawar, make himself
available and do all such further acts, things and deeds, as may be necessary
for further assuring and transferring the title of Property in favour of the Buyer.
7. That the Seller or his legal heirs absolutely no claim with respect to the
Property and the Seller transfer his absolute tenancy to the Buyer.
IN WITNESS WHEREOF both the Parties have set hands to this Agreement
on the date place first mentioned above.
