7.

The contractor(s) shall adopt all precautionary measures to safeguard, life,


property, structures, environment etc. and the rates include cost of all such
measures.
8. The contractor(s) shall have no claim for compensation in case of
delay/disruption in work due to obstruction on work by local
people/villagers/local authorities that may take place during the progress of
work.
9. Contractor(s) shall, at his/their expense, comply with all labour laws and keep
MG Contractors indemnified in respect thereof.
10. The manpower/labour employed by you for the execution of the awarded work
shall always remain under your supervision and control.
11. The contractor(s) shall do all liasoning work required for completion of the
work.
12. All accommodation transportation of the contractor’s personal shall be
arranged by the contractors.
13. You shall not under any circumstances further sub contract the work to any
other contractor.
14. You shall not indulge in any fraudulent activity with our site personal or client
or any other sub-contractor on site. A professional decorum and discipline
expected from your team on site.
15. Any correspondence required to be made by you shall be done in writing to
our site office.

16. We reserve the right to terminate the Sub contract in whole or in part in case:
a. When the performance is not up to your commitment.
b. When you fail to carry out your works regularly and diligently or unable to
keep up the pace according to the work programme as per the requirement
of the project.
c. When you further sub contract the work without taking our approval and
clarifying your position and situation, as such an act would constitute
breach of contract on your part.

17. Unsatisfactory performance of the contractors or failure to adhere to any of the


conditions stipulated in the tender/contract document shall attract for failure of
the retention money. In addition, MG Contractors reserve right to terminate the
entire contract or a part of it and take action as deemed fit.
18. In case of any dispute, the same shall be referred to arbitration, under the
provision of arbitration and conciliation Act, 1996 and the arbitration shall be in
Panchkula court.
