ARCHT.

PROFESSION
FROM RA 545
TO RA 9266
- "Republic Act No. 545: Regulation of the
Practice of Architecture" is a Philippine
Jurisprudence case that establishes a
Board of Examiners for Architects, sets
registration and certification requirements,
and imposes penalties for the practice of

RA 545 architecture by unregistered individuals.

- The purpose of the Architecture
Regulation Act is to regulate the practice
of architecture in the Philippines.
- It aims to ensure the qualifications and
ethical conduct of architects.
- The Act also seeks to protect the public's

RA 545 -
welfare, life, health, and property.
Entities Involved
- Board of Examiners for Architects
- Secretary of Public Works and
Communications
- Court of First Instance
- Commissioner of Civil Service
- Secretary of Justice
RA 545 TO RA 9266
- Republic Act No. 9266 otherwise
known as the "Architecture Act of
2004" was signed into law by then
President Gloria Macapagal Arroyo.
RA 545 RA 9266 reiterated what was
already stated under RA 1581 and

TO RA RA 545 and even under RA 1582 i.e.

that the practice of architecture is

9266
vested only on registered/ licensed
architects and on no one else. It is
now time for the rightful regulated
professionals to do the job and to
render services to a public that has
long been deprived.
- “Architectural Documents” are not
defined in RA 544, 545, 9266 or PD
1096.
- “Architectural Documents” are only
RA 545 defined in the IRR of PD 1096,
however…

TO RA
9266
- IRRs “are confined to details for
regulating the mode or proceedings
to carry into effect the law as it has
been enacted”
RA 545 - IRRs “cannot be extended to
amend or expand the statutory

TO RA requirements”

9266
- IRRs cannot be used to “embrace
matters not covered by the
statute”
- IRRs must always be in harmony
RA 545 -
with the law, therefore…
The definition of “Architectural

TO RA Documents” in the IRR of PD 1096

do not count.

9266
- The actual law itself can be focused
to protect the core principles and
intent for creating the law;
- By delegating the specifics to the
IRR, and having the IRR be part and
HAVING parcel of the power of the law, the
law itself can be as comprehensive

RA 9266
as it can possibly be;
- Through the IRR, the law can be
dynamic and responsive to a
climate (certainly in the
construction industry) wherein the
context changes very quickly,
bypassing the years it takes to even
actually pass a law.
- Defining what “architectural
documents” are is precisely a
means for “regulating the mode or
proceedings to carry into effect the
DEFINING law as it has been enacted”,
because otherwise, how else are

ARCHT. you going to implement all the

clauses in the three laws above (RA

DOCS
9266, RA 544, PD 1096) that refer
to “architectural documents”?
