AFFIDAVIT IN SUPPORT OF CHAMBER SUMMONS/APPLICATION.

I, GODWIN BEATUS NGONGI, Adult, Christian, Resident of Dodoma Municipality in
Dodoma Region, do hereby taking an OATH and STATE as follows:-

(1) That, I am an Advocate of the High Court and the Courts subordinates thereto other than
Primary Courts dully instructed by the Applicant herein to depose to the facts of this
affidavit hence conversant with the same.
(2) THAT, the Applicant herein was the Applicant in the suit/Application filed at Singida
District Land and Housing Tribunal, where the said Tribunal decided on favour of
Respondent herein as per annexure E1 and the Applicant craves leave to this Honourable
Court to refer it as part of this Affidavit.
(3) THAT, the Applicant was aggrieved by the decision of said Tribunal and now he
deciding to Appeal to this Honourable Court.
(4) THAT, after pronouncing the Judgement, the trial Tribunal delayed to furnish a copy of
Judgment to Applicant herein.
(5) THAT, the Applicant herein attempted several times to ask the said copy of Judgment to
Tribunal but unsuccessful as per annexure E2 and E3 and the Applicant craves leave to
this Honourable Court to refer it as part of this Affidavit..
(6) THAT, even after the Applicant herein obtained such copy of Judgment; it seems the
Applicant’s right to appeal has been retained by the trial tribunal.
(7) THAT, the Delay in filling his Appeal is neither Deliberate nor negligence as stated
herein above.
(8) THAT, as leave to file an Appeal is not made the Applicant will be denied his
fundamental right of being heard.
