BAC RESOLUTION RECOMMENDING TO THE HEAD OF PROCURING ENTITY

(HOPE) TO RESORT TO ALTERNATIVE METHOD OF PROCUREMENT

WHEREAS, the Department of Education (DepEd), Division of Northern

Samar, through its Bids and Awards Committee (BAC), has to undergo
“Emergency Procurement of Supply and Delivery of Materials for Division
Office Rewiring of Electrical Service Entrance;

WHEREAS, as a general rule, the Procuring Entities shall adopt competitive

bidding as the general method of procurement. However, subject to the prior
approval of the HOPE, and whenever justified by the conditions provided in
accordance with Republic Act (RA) 9184 and its IRR, the Procuring Entity may, in
order to promote economy and efficiency, resort to any of the alternative methods of
procurement.

WHEREAS, there is an approved Purchase Request (PR) No. 2022-06-0089

with a total Approved Budget for the Contract (ABC) of One Hundred Eighty-One
Thousand Pesos Only (P 181,000.00) for the emergency procurement of materials
for division office rewiring of electrical service entrance;

WHEREAS, said items are included in the Supplemental Annual

Procurement Plan of DepEd, Division of Northern Samar for 2022;

WHEREAS, Section 53.2 of the IRR of RA 9184 states that the Procuring
Entity may resort to Negotiated Procurement under Emergency Cases in case of
imminent danger to life or property during a state of calamity, or when time is of
the essence arising from natural or man-made calamities or other causes where
immediate action is necessary to prevent damage to or loss of life or property, or to
restore vital public services, infrastructure facilities and other public
utilities;

WHEREAS, on July 4, 2022, due to extensive tripping-off of electricity

caused by the faulty breakers, the library hub building-HRM office has ignited
electrical wirings causing danger to life and government property;

WHEREAS, the BAC, after having considered the urgency of the

procurement as stated in Section 53.2 of the IRR of RA 9184, and the approved
purchase request also attached herewith, finally decided to adopt the Alternative
Method of procurement specifically through Negotiated Procurement-Emergency
Cases;

NOW THEREFORE, We, the Members of the Bids and Awards Committee,
hereby RESOLVE as it is hereby RESOLVED, to recommend for the approval of the
Head of Procuring Entity, to implement this project through Negotiated
Procurement –Emergency Cases as its Alternative Mode of procurement.

RESOLVED, at the Conference Room, Library Hub, DepEd Division of

Northern Samar, this 1st day of July, 2022.

WHEREAS, the Department of Education (DepEd), Division of Northern

Samar, through its Bids and Awards Committee (BAC), has to undergo
procurement of “Supply and Delivery of 10 pieces Multi-Storage Box 60 Liters
for the use of the Office of the OIC-Assistant Schools Division
Superintendent”;

WHEREAS, as a general rule, the Procuring Entities shall adopt competitive

bidding as the general method of procurement. However, subject to the prior

approval of the HOPE, and whenever justified by the conditions provided in

accordance with Republic Act (RA) 9184 and its IRR, the Procuring Entity may, in
order to promote economy and efficiency, resort to any of the alternative methods of
procurement.

WHEREAS, there is an approved Purchase Request (PR) No. 2020-06-0049

with a total Approved Budget for the Contract (ABC) of Six Thousand Pesos Only (P
6,000.00) for the procurement of Multi-Storage Box 60 Liters;

WHEREAS, said items are included in the Annual Procurement Plan of

DepEd, Division of Northern Samar for 2020;

WHEREAS, the BAC, opted to adopt Alternative Method of procurement

specifically Negotiated Method-Small Value Procurement after having determined
the urgency and importance of providing said services needed so as not to hamper
various office transactions;

WHEREAS, Section 53.9 of the IRR of RA 9184 states that in order to

consider the procurement under Negotiated Method-Small Value Procurement, the
procurement of goods, infrastructure projects and consulting service, shall be
where the amount involved does not exceed the threshold prescribed in Annex “H”
of this IRR (does not exceed One Million Pesos): Provided, that in case of goods, the
procurement does not fall under shopping in Section 52 of this IRR;

WHEREAS, the BAC through Small Value Procurement (SVP) mode of

procurement, shall prepare and send Request for Quotations (RFQ) to at least three
(3) suppliers, contractors or consultants of known qualifications;

NOW THEREFORE, We, the Members of the Bids and Awards Committee,
hereby RESOLVE as it is hereby RESOLVED, to recommend for the approval of the
Head of Procuring Entity, to implement this project through Negotiated
Procurement-Small Value Procurement as its Alternative Mode of Procurement.

RESOLVED, at the Conference Room, Library Hub, DepEd Division Office,

Division of Northern Samar, Catarman Northern Samar, this 3rd day of June 2020.
