PART II: LIST OF DOCUMENTS SUBMITTED BEFORE ME/US FOR SCRUTINY AND
LEGAL OPINION: (SPECIFY THE DOCUMENTS ARE ORIGINAL OR XEROX)
The said Mr.Azhagarsamy vide Settlement Deed dated 30/10/2007 have settled the property to one
Mrs.Mariyammal and the said document mortgaged as Doc No.8115 of 2007.
The said Mrs.Mariyammal had sold the property at Chathirapatti Village, Idaiseval Village – II,
KovilpattiPanchayaat union S.No.612/2, Hectare 0.06.5 and S.No.613/1 Hectare 0.61.5 and S.No.613/2B
Hectare 0.04.5 Hectare in total 0.72.5 Hectare to Mr.Rengasamy.
It is observed that vide Sale Deed dated 12/02/2008 1) Azhagarsamy 2) Rengasamy have both sold their
property situated at Chathirapatti Village, Idaiseval Village – II comprised S.No.612/1 Hectare 0.69.0 and
S.No.613/2 A0.13.5 Hectare to Mr.Rengasamy.
It is observed that the said Mr.Rengasamy vide Sale Deed dated 27/03/2008 had sold the schedule
mentioned property to 1) P.Subbaiah and 2) Mr.Mariyappan and the document registered as Doc No.2893
of 2008 on the SRO of Kovilpatti.
It is observed that the 1) P.Subbaiah and 2) Mr.Mariyappan vide Sale Deed dated 16/06/2008 had sold the
schedule property to one M/s.NVR Estates a the document registered as Doc No. 5316 of 2008 on the
SRO of Kovilpatti.
It is observed that M/s.NVR Estates has mortgaged the property to M/s.Thirumeni Finance Private
Limited for an amount of Rs.40,00,000/- vide MODT Doc No. 982/2017 on the SRO of Kovilpatti. The
said Mortgaged was released by M/s.Varthana Finance Private Limited formerly known as
M/s.Thirumeni Finance Private Limited on 12/05/2024 vide Release Deed Doc No. 3892 of 2024 on the
SRO of Kovilpatti.
It is observed that the Patta No.2234 stands in favour of M/s.NVR Estates for S.No. 612/2, 613/1, 613/2B,
612/1 and 613/2A at Idaiseval – 2, Kolvipatti Taluk, Tuticorin.
The submitted online EC did not reveal any subsisting encumbrance to the schedule property.
PART IV: EVIDENCE OF THE TITLE OF PROPERTY:
Under the Sale Deed dated 16/06/2008registered as Document No.5316 of 2008 on the sub registration
district of Kovilpatti the said M/s.NVR Estates is the absolute owner of the schedule property.
In view of the foregoing, I/We certify that the title deeds intended to be deposited, relating to the property
and offered as security by way of registered/equitable mortgage and the documents of title referred to
above are perfect evidence of the title and that if the said registered/equitable mortgage is created in the
manner required by law, it would satisfy the requirements of creation of registered/equitable mortgage.
I/We further certify that M/s.NVR Estateshas a valid, clear, marketable and unencumbered title to
schedule property.
The mortgage if created will be available to ICICI HFC for the liability of the intending Borrower / Co
borrower M/s.NVR Estates
The following original documents to be collected by ICICI HFC for creation of registered/equitable
mortgage of the said property: -
