A. Anthony Jayaraj S/o. J. Arokiadoss, Hindu aged about 40 years residing

at No.C/32, 8th Cross Street, Kurinji Nagar, Ramapuram, Chennai – 600 014 do
hereby solemnly and sincerely states as follows;.

I am the petitioner herein and also Respondent in the main Petition and
interim maintenance petition.

I states that the respondent/Wife has filed the interim maintenance petition
with false allegation against me, the petition averments are false and imagine story
of the respondent, during the wedlock no child born to us, but the
respondent/wife stated in her petition that we having child and claiming
maintenance herself and unborn child also, the respondent file the
maintenance and D.V. petition for the purpose of harassing me, the
respondent having well financial support and lead luxuries life with her
family, she have to maintain herself and she having good education
qualification and working but everything is concealing by the respondent to
this Hon'ble court and we are separated past five years, during the separation
period the respondent nothing to claim from me, the respondent not approach
with clean hand to this Hon'ble court, furthermore the respondent/wife side not
served any notice or petition copy to me and without heard to my side evidence
and not consider about my finical status the Hon'ble court was passed exparty
order against me, last hearing only I came to knowledge about the interim
maintenance petition and immediately I file this petition.

I further states that I am not having capacity to pay maintenance to the

respondent, because I am depending on my sister daughter, brother and friends and
relatives, past three years due to my poor health condition unable to went to job
and I am daily wager, furthermore without consider financial capacity of me, the
Hon'ble court was passed exparty order to pay Rs.5,000/- to the respondent/wife,
hence the Hon'ble court may be give me an opportunity to prove my financial
capacity and present financial status of me and my main courter may be treat part
and parcel of this affidavit. Hence this Petition.

I therefore pray that this Hon'ble court may be pleased to modify, revoke, or
reduce an order passed by this Hon'ble Court and thus render justice.
