Petition under Section 11 read with Section 5(i) of the


Hindu Marriage Act, 1955

The Petitioner humbly submits as under:

The Petitioner is Mrs.Meena, Daughter of Ravi, Hindu, aged about 25


years, residing at No.48/27A, Singa Perumal Kovil Sannathi Street,
Kancheepuram, Tamil Nadu – 631 501.

The address for service of all notices and processes on the petitioner is
at the address stated above.

The Respondent is Mr.Perumal, Son of Seenivasan, Hindu, aged


about 34 years, residing at D.No.2, Ground Floor, Vimal Chand Street, Sri
Parasnath Nagar, Iyyapanthangal, Chennai – 600 077.

The address of the respondent for service of all notices and process is
at the address stated above.

The petitioner is instituting this petition seeking a decree of nullity


declaring the marriage between the petitioner and the respondent
solemnized in accordance with Hindu Rites on 26-04-2019 at Shri
Panchamuga Vinayagar Kovil Aarupadai Murugar Thirukoil, Omalur Main
Road, Yercaud Adivaram, Salem – 636 008 as null and void.

The relevant facts are as under:

1) The petitioner submits that the marriage between the petitioner and
the respondent was solemnized on 26-04-2019 at Shri Panchamuga
Vinayagar Kovil Aarupadai Murugar Thirukoil, Omalur Main Road,
Yercaud Adivaram, Salem – 636 008 as per the Hindu rites and
customs. The respondent herein exchanged garland with the
petitioner and tied the sacred thread (Thaali) around the
Respondent’s neck with three knots in the presence of friends. The
said marriage was a love marriage conducted by the petitioner and
respondent on their own.

2) The petitioner submits that after the marriage, both set up their
matrimonial residence at Salem. Out of their wedlock, they were
blessed with a male child named Prathyush born on 12-02-2020.

3) The Petitioner submits that she was looking forward to a happy


married life. Unfortunately, her married life became a nightmare. The
Respondent was in the habit of swindling the money of other people
by fraudulent and dishonest means. Later, both of them shifted to the
respondent’s house at Kancheepuram during the month of July 2019.
The petitioner submits that she came to know about the misdeeds of
the petitioner only subsequent to her marriage with him. The
petitioner submits that the respondent had falsely stated that he was
working in ICICI Prudential as a Sales Manager and thereby swayed
her to marry him. Even before their marriage, the respondent, in fact,
got Rs.6,00,000/- from the petitioner’s father by deceiving him that
he would invest the same in shares and would fetch him profits by
preparing a fake IDFC Investment Bond document. He persuaded the
petitioner that he would return back the money and married her. He
further obtained 71/2 sovereigns of gold from the petitioner’s family
and sold the same and gave the petitioner only Rs.50,000/-.

4) Most importantly, the Respondent even suppressed the fact that he


did not dissolve the marriage with his first wife namely Latha @
Hemalatha, D/o. Thambaiah, residing at No.40/32, Sangusahpettai
Street, Kancheepuram -631 501. He disclosed to the petitioner that
he was a divorcee and married her. But to the petitioner’s shock and
surprise, the respondent herein divorced his first wife only
subsequent to the marriage with the petitioner. It is pertinent to note
that the said petition for divorce was filed as late as 04-07-2019
thereby being in a bigamous relationship until the dissolution of
marriage with his first wife on 05-03-2020 by decree passed by the
Learned Principal Subordinate Judge, Kancheepuram in O.P.
(H.M.O.P). No.190 of 2019. Therefore, the respondent concealed the
fact that he was having a spouse living at the time of marriage with
the petitioner.

5) The petitioner submits that once she came to know about the true
colours of the respondent herein, she agreed to the marriage arranged
by her parents with another person. During that time, the respondent
created a Facebook account in the name of the petitioner and
uploaded her intimate pictures taken along with the respondent
herein and thereby forcing the petitioner herein to stop her marriage.
Further, when the petitioner avoided the respondent, he emotionally
blackmailed her by saying that he would commit suicide if the
petitioner does not pay heed to the respondent.

6) The Petitioner submits that when the petitioner came to know that
the Respondent was not working as a Sales Manager in ICICI
Prudential and questioned him regarding the same during the month
of June 2019, she was assaulted by the respondent. The Petitioner
further submits that she came to know that the Respondent was
remanded to Salem Central Jail in the month of September 2019 for a
Cheating case registered at Sooramangalam Police station for 45 days
when the petitioner was pregnant. Subsequent to his release, the
petitioner came to know that a picture of her with her husband was
forwarded in WhatsApp that both of them were involved in Cheating
and Forgery thereby tarnishing her reputation and causing mental
agony. Enraged by being defamed and accused of an offence of which
she was innocent, she questioned the respondent about the same. At
that time, the respondent slapped the petitioner on her cheeks and
kicked her in stomach. It is further submitted that during the month
of October 2019, the respondent pushed away the petitioner and
snatched away her sacred thread (Thaali) to accomplish his vices.

7) The petitioner and the respondent were having constant quarrels


daily. Thinking that physical intimacy with him would improve the
matrimonial bond, the petitioner had sexual intercourse with him at
every possible opportunity to please him. However, once their sexual
intercourse concluded the mental torture and physical torture
resumed. This continued till early September 2020. The petitioner
further submits that when she realised that having physical intimacy
with him would not be of any avail, she stopped doing so and was
reluctant toward the respondent’s sexual demands. At that time, the
respondent high-handedly sexually abused her by having sexual
intercourse against her consent. The respondent frequently indulged
in the commission of various offences including ATM thefts and
robberies for which he was remanded to Kancheepuram Sub-Jail for
a criminal case filed at Walajabad Police Station in November 2020
for 23 days.

8) The petitioner further submits that when the petitioner and


respondent started to reside in Chromepet during the end of the year
2019. At that time, the respondent indulged in various fraudulent
activities defrauding the owner of the house in which they lived as
tenants, of which the petitioner had no knowledge, to the tune of
Rs.9,00,000/-. Later, during the month of March 2020, the petitioner
found out that that the respondent sent money to his 1 st wife and he
divorced her only a week earlier. When the petitioner questioned the
same, the respondent herein physically abused the petitioner by
kicking her stomach.

9) The petitioner submits that when the petitioner was carrying the
second child and suffering in pain, without paying heed to the
petitioner’s needs, the respondent-husband deserted her for almost a
fortnight from 06th May 2021 to 19th May 2021. He came to visit her
only after the death of the 2nd baby which died in womb stillbirth on
20-05-2021. This averment is made only for the purpose of placing on
record the detriment suffered by the petitioner and to show the
recklessness of the respondent herein.

10) Both of them shifted their matrimonial residence to


Guduvanchery during the 1st week of July 2021. The wife of the
abovementioned defrauded house owner (Chromepet Residence) came
to Guduvancherry residence and harried the petitioner herein that
she would implicate the petitioner in her complaint and would obtain
her child if she does not return the crime proceeds gained by the
petitioner’s husband. When the petitioner enquired the respondent
regarding the same and what he did with the crime proceeds during
the month of August 2021, the respondent assaulted her mouth and
made her mouth to swell. When the petitioner started to wail after his
beating, the respondent kicked the stitches in her stomach and
further tore her cloth and choked her neck using it when she tried to
scream and alert the neighbours. He also threatened her that he
would throw their first baby away if she continued to wail and
thereby subjected her to physical cruelty. This happened just few
months after the petitioner had a C-Section delivery. Later, due the
failure of the persistent demands, the wife of the abovementioned
victim-house owner lodged a complaint against the respondent herein
and a First Information Report in Crime No.51 of 2022 was registered
against the respondent herein.
11) Later, the respondent acted as if he regretted the way in which
he treated her and said that he would start a new business and
thereby persuading her to settle his dues. The petitioner still under
the belief that she could salvage their failed marriage pledged her car
to settle some of the dues of the respondent.

12) Both the petitioner and respondent shifted their matrimonial


residence to D.No.2, Ground Floor, Vimal Chand Street, Sri
Parasnath Nagar, Iyappanthangal, Chennai – 600 077 on 02-11-2021
which is their last matrimonial residence. The respondent was
arrested by Dindivanam Police during the month of February 2022.
Subsequent to his release, the respondent deserted the petitioner for
most of the days and was not looking after the family. Since the
respondent did not give any money towards running the family, the
petitioner’s friend named Saravanan offered some money for help.
This infuriated the respondent who abused the petitioner with filthy
words and subjected her to mental agony by saying that she had an
illicit relationship with the said Saravanan. He further frequently
stated that the petitioner was a promiscuous and licentious woman of
easy virtue having illicit relationship with unknown men whenever
she tried to go to some other place and thereby subjected her to
mental trauma. This finally persuaded the petitioner to come to a
conclusion that she cannot live with him any further. Therefore, the
petitioner left the matrimonial home on 01-05-2022 unable to bear
the mental agony suffered by her due to the cruelty on the part of the
respondent as well as to protect herself and her 2-year-old child from
any further physical and emotional injuries.

13) It is submitted that the aforesaid incidents referred to in the


paragraphs supra are not exhaustive but are illustrative of the
respondent’s character and behaviour. The petitioner suffered very
frequent verbal, mental, physical and emotional abuse at the hands
of the respondent virtually every single day of their married life .

14) The petitioner due to the acts of cruelty on part of the respondent
suffered severe mental trauma and lack of peace, apart from physical
injuries and therefore she came away to Kancheepuram in May 2022
to her parent’s home to recover emotionally and also to institute this
petition for divorce.

15) It is submitted that very recently on 01-06-2022, the respondent


came to the petitioner’s current residence when she was not at home
and abused her parents with filthy words and further threatened
them dire consequences if they do not give him the petitioner’s son.
He further defamed her by abusing her family in public place in their
locality and thereby harassing the petitioner herein. He further tried
to change the mobile number linked with her Yes Bank Account and
further accessed her E-Mail and changed the password thereby
accessing her mails unauthorizedly. Even when the petitioner tried to
retrieve her mail account, the petitioner found that the verification
code is set up to be sent to the respondent’s mail account. The
petitioner apprehends that the respondent will not her alone until she
is granted a decree of nullity.

16) It is submitted the petitioner has not in any manner connived or


condoned the aforesaid acts of cruelty on the part of the respondent.
This petition is not filed after any unnecessary or improper delay in
approaching the Court. The petitioner or either of them has not
approached any other court seeking any matrimonial reliefs.

17) The petitioner submits that there was no force, fraud or undue
influence in filing this petition.
18)It is submitted this Honourable Court has jurisdiction to entertain
and decide this petition as the last matrimonial residence D.No.2,
Ground Floor, Vimal Chand Street, Sri Parasnath Nagar,
Iyappanthangal, Chennai – 600 077 where the petitioner lastly
resided together with the respondent falls within the jurisdiction of
this Honourable Court.

19) The petitioner submits that no similar petition is pending before any
other Court in India.

20) The cause of action for this petition arose on 26-04-2019 when the
marriage was solemnized between the petitioner and respondent in
accordance with Hindu rites at Shri Panchamuga Vinayagar Kovil
Aarupadai Murugar Thirukoil, Omalur Main Road, Yercaud
Adivaram, Salem – 636 008 and thereafter on 05-03-2020 when the
respondent obtained a decree of divorce dissolving the marriage
between him and his first wife named Latha and thereafter virtually
every day when the petitioner was subjected to acts of cruelty both
physical and mental due to which the petitioner has suffered
irreparable harm to her psychological and physical wellbeing and
thereafter.

21)The petitioner values this original petition for the purpose of Court
fees under Schedule II Article 1 of Tamil Nadu Court Fees Act and
pays a sum of Rs.50 as Court fee.

22) It is therefore prayed that this Honourable Court may be pleased to


pass judgment and decree as under

a) Decree of nullity declaring the marriage held between the petitioner


and the respondent on 26-04-2019 at Shri Panchamuga Vinayagar
Kovil Aarupadai Murugar Thirukoil, Omalur Main Road, Yercaud
Adivaram, Salem – 636 008 as null and void under Section 11 read
with Section 5(i) of the Hindu Marriage Act, 1955.
b) For such other relief or reliefs as this Hon’ble Court may deem fit and
proper in the circumstance of the case and thus render justice.
