1. Exemption allowed, subject to all just exceptions.
2. The application stands disposed of.
BAIL APPLN. 2389/2024 (under Section 483 of BNSS, 2023 filed by the
petitioner for grant of extension of interim bail on medical ground)

Sanhita, 2003 has been filed on behalf of the petitioner for three months.
5. It is submitted that the accused had a fall on 09.01.2024 and since
then he has suffered serious injuries. He has been operated in January, 2024
and again has to undergo the surgery, which was postponed on account of
his medical condition. He has been advised to undergo the medical surgery
after about three months, which latest medical records have been placed on
record. The extension of interim bail is sought by three months.

6. Learned APP appearing on behalf of the State has opposed the bail
application on the ground that earlier, he had taken interim bail from
17.11.2023 on the ground of surgery of his wife. He was supposed to
surrender on 21.12.2023, according to the learned counsel for the petitioner,
he surrendered on 26.12.2023. He was again granted bail on 31.12.2023 on
the pretext of surgery of his wife. He had a fall on 09.01.2024 and since then
he is under medical treatment. Further extension is sought.
7. The Medical Record of the petitioner shows that he has got spine
complication and his surgery was scheduled but could not be undertaken
because of his medical complication. The surgery has been postponed for
about three months as per his Discharge Summary dated 05.07.2024. He has
been discharged from the hospital in stable condition. However, as per
special instructions, it has been recommended that he should not be left
alone.
8. Considering the medical condition of the accused, his interim bail is
extended by three months, with the following conditions:-
i) The applicant/accused shall furnish a bail bond in the sum of
Rs.30,000/- with one surety in the like amount to the satisfaction of
the Ld. CMM/MM/Duty MM/Link.
ii) The applicant/accused shall not tamper with evidence nor
otherwise indulge in any act or omission that is unlawful or that
would prejudice the proceedings in the pending matter.
iii) The applicant/accused shall furnish to the Investigating
Officer/SHO a cell number on which the applicant may be contacted
at any time and shall ensure that the number is kept active and
switched on at all times.

iv) The applicant/accused shall not utilize the liberty of interim bail
except for his medical treatment.
v) On completion of extended period of interim bail, the
applicant/accused shall surrender before the Jail Superintendent
concerned.
9. The application stands disposed of.
10. Copy of this order be sent to the Jail Superintendent and to the learned
trial court.
