ADDENDUM TO THE MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

LAND BANK OF THE PHILIPPINES, a government financial institution

created and existing under and by virtue of the provision of Republic Act No.
3844, as amended, with principal office at LANDBANK Plaza, 1598 M. H. del
Pilar comer Dr. J. Quintos Streets, Malate, Manila, Philippines, represented in this
Act by its President and Chief Executive Officer, CECILIA C. BORROMEO,
through her duty authorized representative, (Name of Branch Head), (Designation
of Branch Head). (Name of Branch), hereinafter referred to as "LANDBANK",

- and –

APAYAO STATE COLLEGE, a government agency created and existing under

and by virtue of Philippine law, with principal office address at Malama, Conner,
Apayao, represented by its College President JOHN N. CABANSAG Ph.D.
hereinafter referred to as “ASC”.

WITNESSETH: that

WHEREAS, on __________________the parties hereto entered into a

Memorandum of Agreement (herein referred to as the (“Agreement”) whereby
LANDBANK has agreed to extend ATM Payroll System/Facility in favor of ASC under
the terms and conditions specified therein, which document was acknowledged by the
parties before (Name of Lawyer), Notary Public for and in_____ City and entered into
her notarial register as Doc. No._____ Page No._________, Book No.____ Series
of_______.

WHEREAS, the Bureau of the Treasury (BTr) granted clearance to

LANDBANK to allow opening of "pass-through" accounts for National Government
Agencies (NGAS) to be used specifically as source account of NGAs for the agency's
payroll uploading and payment of utilities/statutory deductions via the LANDBANK's
WeAccess Facility;

WHEREAS, ASC has requested to open a pass-through account at LANDBANK

Luna Branch for payroll uploading/payment of utilities and statutory deductions of GAs
via LANDBANK's weAccess Facility.

NOW THEREFORE, for and in consideration of the foregoing premises and of

the terms, conditions, covenants hereinafter set forth, the parties have mutually agreed to
include the following on top of the existing arrangement:
1. ASC shall open/maintain with LANDBANK- Luna Branch, a checkless
current account under the name as Apayao State College, in accordance
with LANDBANK's existing policies and guidelines and as prescribed by
the following specific terms and conditions of the BTr.

o no initial deposit maintaining balance

o zero balance at end-of-day
o No over-the-counter deposit withdrawals
o Transactions limited to be used as source account in
the payroll uploading and payment of Utilities/statutory
deductions via LANDBANK' WeAccess facility

2. ASC shall fund the pass-through account from its MDS account either thru
List of Due and Demandable Accounts Payable - Authority to Debit
Account (LDDAP - ADA) or Electronic Modified Disbursement System
(eMDS). The LDDAP-ADA shall bear the name of the NGA as payee and
the pass-through account as the destination account, over-the-counter
transactions shall not be allowed.

3. ASC shall enroll in the LANDBANK's weAccess Facility subject to the

submission of the required documentary requirements.

4. ASC shall initiate payroll-uploading via weAccess after it has verified the
availability of (Name or NGA) pass-through account balance in the
LANDBANK'S weAccess Facility.

5. In case of LANDBANKs WeAccess Facility system downtime,

LANDBANK servicing branch of ASC shall accommodate ATM payroll
uploading thru the use of the Financial Data Entry System (FinDES)
Facility and Bills Payment shall be done through any available channels or
onColl Facility subject to the standard documentary requirements.

6. ASC shall strictly observe the specific terms prescribed by the BTr in
handling the pass-through account enumerated under item No. 1 of this
Agreement.

7. In accordance with RA. 10173 (Data Privacy Act), Parties shall ensure that
appropriate organizational, physical, and technical measures are in place to
maintain the confidentiality, integrity and security of all personal data that
may come to its knowledge or possession by reason of any provision of this
Agreement and that its employees, agents, representatives, or any person
acting under its authority shall hold personal information under strict
confidentiality at all times.
All terms and conditions of the Memorandum of Agreement dated_____________ shall
continue to be valid and binding upon the parties, except those terms and conditions
which are inconsistent with this Agreement.

Said instrument refers to Addendum to the Memorandum of Agreement consisting

of four (4) pages including this page whereon the Acknowledgement is written, signed by
the parties and their witnesses on the signature page hereof, and initialed on the other
pages and sealed with the notaries seal.
