MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement executed by and between:

The BALAWING ELEMENTARY SCHOOL, a public secondary institution, with

the office address of Balawing, Aroroy, Masbate, represented herein by its School
Head, RHYAN M. LLAGUNA, herein after referred to as “FIRST
PARTY”;
- and -

The BARANGAY LOCAL GOVERNMENT UNIT OFFICIALS in the Municipality

of Aroroy, an association with the address at Balawing, Aroroy, Masbate,,
represented herein by its Barangay Captain,
_______________________________________, herein referred to as
“SECOND PARTY”.

WITNESSETH: That,

WHEREAS, with hundreds of Filipinos infected, tens of deaths, and many more
in danger of infection, the Philippines is affected by COVID-19 which was declared by
the World Health Organization as a pandemic on 11 March 2020;

WHEREAS, President Rodrigo Roa Duterte, through Proclamation No. 922 dated
8 March 2020, enjoins all government agencies “to render full assistance and
cooperation and mobilize necessary resources to undertake critical, urgent, and
appropriate response and measures in a timely manner to curtail and eliminate the
COVID-19 threat”;

WHEREAS, on 16 March 2020, the President, through Proclamation No. 929,

declared a state of calamity for a period of six months and further reiterated the call for
government agencies to mobilize necessary resources to curtail and eliminate the
COVID-19 threat;

WHEREAS, the Department of Education (DepEd), along with the President’s

decision, will not have face-to-face classes to prevent students and teachers from being
infected with the virus until further notice;

WHEREAS, the DepEd offers Modular Distance Learning Modality (MDLM) and
Online Distance Learning Modality (ODLM) for the continuity of learning delivery to the
students;

WHEREAS, the FIRST PARTY recognizes that there is a need to provide

Modular Distance Leaning to the SECOND PARTY in order to maintain the learning
delivery to the students in their respective barangays;

WHEREAS, the FIRST PARTY helps lessen the burdens of the SECOND
PARTY by scheduling a weekly distribution and retrieval of Self-Learning Modules
(SLMs) to be given to the parents in their barangay;

WHEREAS, the SECOND PARTY will voluntarily provide assistance and other
resources to address their needs in the Modular Distance Learning implementation;

WHEREAS, the resources/SLMs shall be taken cared by FIRST PARTY

including the retrieval of students’ outputs to ensure that the MDL can be used to the full
extent by the greater majority of the students of this institution;

NOW THEREFORE, for and in consideration of the foregoing premises, the

parties hereto hereby agree as follows:

I. ROLES AND RESPONSIBILITIES OF THE PARTIES

1. The FIRST PARTY shall:

1.1 Through its Barangay Learning Cell Facilitators, provide a

weeklyschedule of distribution and retrieval of the self-learning modules;

1.2 Through its Barangay Learning Cell Facilitators, provide a

budgetarymatrix of the students’ assigned modules per week;

1.3 Through its Barangay Learning Cell Facilitators, distribute and

retrievemodules and students’ outputs on schedule.

2. The SECOND PARTY shall:

2.1 Provide assistance with the FIRST PARTY to ensure the proper
dissemination of this activity;

2.2 Help the FIRST PARTY in maintaining the observance of the health
protocols;

2.3 Issues Certificate of Appearance in every weekly schedule of

distributionand retrieval of outputs.

II. EFFECTIVITY OF THE AGREEMENT

This Agreement shall take effect upon the final date of the resumption of classes
and/or the first scheduled day of distribution and shall be in effect until the day of
classes for the S.Y. 2020-2021 and/or the last scheduled day of retrieval made by the
Learning Cell Facilitators.

IN WITNESS WHEREOF, the parties hereunto have affixed their respective

signatures this 6th day of October 2020, at Balawing, Aroroy, Masbate, Philippines.
