EXTRA JUDICIAL SETTLEMENT WITH ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS;


We, RESTITUTA M. LIMA, VIRGILIO JR. M. LIMA, ROWENA L.
CUBA, HERBERT M. LIMA, CANDELARIO M. LIMA, DENNIS M. LIMA,
ARNEL M. LIMA, VINA L. CAPUL, NANNETE M. LIMA, and CIRILO M.
LIMA, are of legal age, Filipino citizens, with residents of Poblacion, Compostela,
Cebu, Philippines, do hereby WITNESSETH;
That we are the surviving heirs of the late VIRGILIO LIMA who died
intestate at Compostela, Cebu on ______________ a declared owner;
That said decedent died intestate, without Will or Testament, and without
any outstanding debt in favor of any person or entity;
That aforesaid decedent left a parcel of land hereinbelow-described:
A PORTION parcel of land declared under Tax Declaration No. 01482 Lot
No. 020 Cadastral Lot No. 38 situated at Poblacion Compostela, Cebu, Bounded
on the NORTH by Lot 43,42 on the SOUTH by Lot 35 on EAST Lot 39 and on
the WEST by Lot 37 with an area of (879) square meters, more or less.’
That pursuant to Rule 74. Sec. 1 of the Revised Rules of Court of the
Philippines, and both being with all capacity to contract, we do hereby adjudicate
unto ourselves the said Real Property in equal shares.
SALE
That for and in consideration of the sum of FIFTY THOUSAND PESOS (P50,
000.00) Philippine Currency, to us in hand paid to our great satisfaction from
SPOUSES EDWIN L. CALO & VIRGINCITA C. CALO, likewise both of legal
age and respectively, Filipino citizens, with residence and postal address at
Poblacion Compostela, Cebu, Philippines, we do hereby SELL, CEDE, CONVEY
and TRANSFER by way of ABSOLUTE SALE unto the said SPOUSES EDWIN L.
CALO & VIRGINCITA C. CALO, to their heirs, executors, successors,
administrators and assigns of Portion parcel of land described below:
“A PORTION parcel Land of the above described under Tax Dec. No.
01482 Lot # 020 Cadastral Lot # 38 containing an area of (60) square meters, more
or less SHARE of DENNIS M. LIMA, bounded on the North by Lot 43,42 ; on the
Southby Lot 35 on the East by Lot 39 and on the Westby Lot 37 with an area of
Sixty (60) square meters;
That Article 1623 of the New Civil Code of the Philippines as well as the
provision of Tenancy Law has been faithfully observed and complied with prior to
the execution of this instrument
That subject parcel of Land has not been registered under Act 496 nor under
the Spanish Mortgage Law but the parties hereto have agreed to register this
instrument in accordance with the provision of Section 194 of the Revised
Administrative Code as amended.
