CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT TO SELL, made and executed by between:
BENJAMIN ASIS MARI, of legal age, Filipino, widower, and a resident of 472 Pluto
St. Phase2B Block 26 Lot 21 V & G Subdivision, Brgy. 109-A, Tacloban City, hereinafter called
the SELLER;
and
JOBEN MARC BAUTISTA MARI, of legal age, Filipino, married and a resident of
Block 26 Lot 21, Phase 2B, V & G Subdivision, Tacloban City, represented by REAGAN
ALDANA SICOY , of legal age, Filipino, and a resident of Zone 6 Purisima Street,
Guindapunan, Palo Leyte, hereinafter called the BUYER:

WITHNESSTH: THAT ---


The SELLER agrees to sell his real property covered by TCT No. 122- 20113001000,
situated in Barangay Caibaan & MArasbaras, Tacloban City, Island of Leyte, bounded and
described as follows:
“A parcel of land designated as Lot 21, Block 26, PCS-08-000191, portion of consolidation
subdivision of Phase II-B, Area VI-A & Area VIII, Cad-220, Tacloban Cadastre, situated at
Barangay Caibaan & Marasbaras, City of Tacloban, Province of Leyte, Island of Leyte.
BOUNDED ON THE
NE, ALONG LINE 1-2 BY LOT 19, BOCK 26
PCS-08-000191 OF THIS SUBDIVISION; ON THE
S. ALONG LINES 2-3-4 BY ROAD LOT 15, BLOCK 26,
PCS-08-000191 OF THIS SUBDIVISION, ON THE
SW. ALONG LINE 4-5 BY LOT 13, BLOCK 26,
PCS-08-000191 OF THIS SUBDIVISION; ON THE
NW. ALONG LINE 5-1 BY LOT 20, BLOCK 26,
PCS-08-0000191 OF THIS SUBDIVISION.
x-x-x, registered in the name of BENJAMIN A. MARI, containing an are of ONE HUNDRED
TWENTY EIGHT (128) SQUARE METERS x-x-x.”
Further, the SELLER agrees to sell said property from the loan proceeds from PAG-IBIG
FUND under the following terms and conditions:
1. The consideration of the sale is P2,500,000.00 to be paid under the following
scheme, to wit:
a. The buyer shall pay 20% of the consideration upon the execution of this
contract, or in the amount of P500,000.00 only;
b. The remaining balance of P2,000,000.00 shall be paid by the buyer upon
release of his PAG-IBIG loan. In the event that the actual loan proceeds
released by the latter to the former are lower than the amount initially applied
for and agreed upon in this contract, the Buyer shall be responsible for
covering the difference between the applied loan amount and the actual loan
proceeds;
c. All taxes and fees shall be borne by the buyer.
The SELLER shall execute the corresponding Deed of Absolute Sale in favor of
BUYER upon the fulfillment of the above conditions, while the BUYER shall shoulder all
necessary costs for the transfer of title.
IN WITNESS WHEREOF, we have hereunto set our hands this at Tacloban
City, Philippines.
