    9 Hynix's Motion for Summary Judgment for the Prevention of Double Damages Relating to

    10 Hynix’s Sales of DDR2, DDR3, gDDR2, and GDDR3 (“DDR2+”) Products came on for hearing on

    11 December 2, 2008.

    12 Having read and considered all of the pleadings and documents filed in support of and in

    13 opposition to Hynix's motion, and having heard and considered the arguments of counsel, the Court

    14 hereby GRANTS Hynix's Summary Judgment motion.

    15 IT IS HEREBY ORDERED:

    16 ___ that Hynix’s pre-2006 sales of DDR2+ products be excluded from any damages

    17 calculations in the present case and that Rambus seek damages for Hynix’s post-2005 sales of DDR2+

    18 products only in the present case; or

    19 ___ that Rambus is prohibited from recovering damages in this action for any sales or

    20 manufacturing activities regarding products accused in this action for which Rambus seeks damages in

    21 Case No. 00-cv-20905.
