(e) Take all other actions consistent with the mission of

10engaging the Mayors office in the critical task of advancing the 11state of public schools in Duval County. 12

Sec. 22.101. CHAPTER 22 MILITARY AFFAIRS, VETERANS AND DISABLED SERVICES DEPARTMENT Military Affairs, Veterans and Disabled Services

The Military Affairs, Veterans and Disabled Services

22Department is created and shall be responsible for: 23


(a) Military affairs and veterans services. Performing

24services related to military affairs and veterans for the City of 25Jacksonville. While each function has distinct responsibilities, 26combining the oversight under one Department is designed to help 27Jacksonville achieve its goal to become the finest host city for 28the military in the nation. 29
This Department will work closely with the leadership of the

30Department of Defense facilities in Northeast Florida to enhance 1

1the partnership which exists between the citizens of Jacksonville 2and those persons serving in the armed forces. This Department will 3also encourage and support the expansion and growth of military 4missions conducted from local military bases; sponsor events which 5recognize and dignify the patriotic service of those in uniform; 6serve as a liaison to civic groups working to support military 7members; serve as the City representative on Chamber of Commerce 8task forces involved in military matters; work closely with federal 9and
state elected officials on issues involving the military

10community; and seek federal and state grants which improve the 11infrastructure surrounding the military bases. 12
The Department will also have the responsibility to provide

13uncompromised service to veterans and their dependents. Veterans in 14Jacksonville will receive timely and competent assistance in filing 15appropriate claims, receiving social services, and applying for 16vocational training and employment opportunities. The Department 17will work closely with veterans organizations created to support 18the needs of those who have served in the armed forces, promote the 19general welfare of these veterans, and apprise the community of 20their

Sec. 23.102 Deputy Director Established; Qualifications

11and Duties of Deputy Director. 12


There is hereby created a position known as the Deputy

13Director of the Central Operations Department. The Deputy Director 14of the Central Operations Department shall have a bachelors degree 15or higher from an accredited college or university and at least 16five
years of experience in an administrative or executive

17position.

PART 4. INFORMATION TECHNOLOGIES DIVISION Sec. 23.401. Establishment; functions. There is created an Information Technologies Division. The

21Division shall be responsible for, as the case may be, executing, 22managing and implementing the selection, procurement, development, 23operation, maintenance and inventory of the following functions and 24services: 25
(a) all data processing systems and applications, centers,

26installations and equipment owned, leased or operated by the City; 27


(b) all communication systems (telephones, cell phones,

28radios, computer networks, wireless devices, and any associated 29infrastructures, cabling etc.) owned, leased, or operated by the 30City; 1

the technology component of all personnel access systems

2for facilities owned, leased, or operated by the City; 3


(d) all video surveillance and monitoring systems and

4equipment for the City; 5


(e) information and data processing systems to insure maximum

6efficiency in and effectiveness of the flow of information and data 7required for the management and operation of all agencies of the 8City; 9
(f) all Geographic Information Systems and related licensing

10(GIS) owned, leased, or operated by the City, and shall establish 11and
maintain standard practices for GIS that ensure seamless

12interoperability; 13
(g) all software and hardware licensing for the City, and

14coordinate all funding requests for all of the above-referenced 15information processing or communications systems resulting in all 16approved funding being placed in the Divisions index codes, and 17procurement shall be accomplished by the Division in coordination 18with the Procurement Division; 19
(h) coordinating all funding requests for the next fiscal

20year for all of the above referenced information processing or 21communications systems for constitutional officers and the Citys 22independent 23annually

16centers, and any other facility or venue specifically assigned to 17the Economic Development Board. The Director, or designee, and may 18execute agreements with sponsors, promoters, exhibitors, performers 19and other persons for the use of the facility, including agreements 20with
renters of the facility to staff and maintain restroom

21facilities at the facility through contractual services, volunteers 22or through a nominal gratuity system approved by the Director. 23
(b) The Director, or designee, shall participate in and make to the Mayor and the Council concerning the

The Employee Services Department is authorized to 26enter into, and the Director of the Employee Services Department, 27or his or her designee, is authorized to execute and deliver, on 28behalf of the City, a volunteer services agreement between the 29City and a public or private agency (Agency) desiring to 30provide volunteer workers to the City, provided that the volunteer

agreement has been reviewed and approved by the Office 2of General Counsel, and provided further that the terms and 3conditions of such volunteer services agreement provide, at a 4minimum, that: 5 (a) the term of the agreement shall be of no more than one 6(1) years duration; 7 (b) the volunteer worker supplied by the Agency is not 8presently employed by the City; 9 (c) to the extent compensation to the volunteer worker is 10contemplated from sources other than the City, such compensation 11will be paid by the Agency, and the City will have no obligation to 12provide compensation of any kind to the volunteer worker, with 13the exception of workers compensation insurance coverage; 14 (d) the volunteer worker shall be under the supervision and 15control of the City, which shall direct the day-to-day work 16assignments of the volunteer worker and the means by which such 17work assignments shall be accomplished; 18 (e) the volunteer worker may not perform work for the City 19for more than eight (8) hours a day or 40 hours a week; 20 (f) the volunteer worker shall be subject to the Citys 21Volunteer Background Screening procedure; 22 (g) the City may terminate the agreement and dismiss the 23volunteer worker at any time with or without cause; 24 (h) the Agency will agree to hold harmless, indemnify and 25defend the City, including, without limitation, its officers, 26representatives, agents and employees, from any and all claims, 27demands, actions, losses, damages and liabilities, including 28reasonable attorneys fees, arising directly or indirectly out of any 29negligent acts or omissions of the volunteer worker performed in 30connection with the agreement, and to have in effect insurance

which adequately underwrites this promise of indemnity 2and which names the City as an additional insured; 3 (i) the Citys remedies against the Agency or volunteer 4worker for damages, and the form of action, are not limited, 5except as otherwise provided by law; 6 (j) the City is not required to indemnify or limit the 7liability of the Agency or volunteer worker, except as otherwise 8required by law; 9 (k) the agreement will be governed by and construed in 10accordance with the laws of the State of Florida and venue for 11litigation of the agreement shall be in courts of competent 12jurisdiction in Jacksonville, Duval County, Florida; 13 (l) the Agency shall not discriminate against any person on 14the basis of race, creed, color, sex, religion, national origin, age, 15marital status or disability in its selection and provision of 16volunteer workers; and 17 (m) the Agency shall at all times comply with laws, 18ordinances, requirements, orders, directions, rules or regulations 19of any federal, state or local governmental authority. 20 (n) All agreements with outside Agencies as described in 21subsection (a) shall be approved by the Director of the Employee 22Services Department; however, nothing contained herein shall 23prohibit a director of a department of the City from otherwise 24accepting volunteer services from individuals upon the approval 25of the Office of Volunteer Services (or any successor function 26within the Department). 27 PART 2. TALENT MANAGMENT DIVISION 28 Sec. 33.201. Talent Management Division; establishment; 29functions. 30 There is created a Talent Management Division. The

of the Division shall include, but not be limited to, the 2following: 3 (a) Establish and maintain a roster of all employees of all 4offices, departments, and boards of the Consolidated Government, 5which shall reflect such data and information as may be deemed 6necessary by the Mayor regarding personnel organization and 7management and as may be required by the personnel rules and 8regulations. 9 (b) Prepare and maintain an up-to-date record of the 10authority, duties and responsibilities of each position, including 11those in the classified civil service as well as exempt and 12unclassified positions. 13 (c) Develop, manage, deliver, and evaluate programs for 14employee development and training, and develop or contract for 15retraining facilities and programs for employees affected by 16changes in their employment resulting from merger or elimination 17of units of the Consolidated Government. 18 (d) Develop and implement strategic human resources 19consulting services and support to departments and agencies of the 20government, to include recruitment and selection tools, job 21evaluation and pricing, and work force planning. 22 (e) Develop and prepare job specifications for the various 23classes of positions in the classified civil service and for positions 24not under civil service. 25 (f) Conduct examinations as required by the civil service 26and personnel rules and regulations to determine qualifications for 27jobs covered by the civil service, and freely advertise job 28placement opportunities and requirements in connection with the 29administration of examinations. 30 (g) Establish a listing of eligible persons as a result of

Division Chief. 5 The Chief of Talent Management is the division chief of the 6Talent Management Division. The Chief shall have a bachelors 9degree from an accredited institution, proven administrative 10ability, and at least five years of experience in the field of 11employee recruiting, training, and employee services 12management. 13 PART 3. COMPENSATION AND BENEFITS DIVISION 14 Sec. 33.301. Compensation and Benefits Division; 15establishment; functions. 16 There is created a Compensation and Benefits Division. Sec. 35.502. Chief of Municipal Code Compliance 24Division. 25 The Chief of the Municipal Code Compliance Division 26shall be the head of said division. The Chief of the Municipal 27Code Compliance Division shall: 28 (a) Have a bachelors degree or higher from an accredited 29college or university and at least five years of experience in an 30administrative or management position;

(b) Be appointed by the Mayor, subject to confirmation by 2the Council, shall serve at the pleasure of the Mayor; 3 (c) Be responsible for managing the operations of the 4Municipal Code Compliance Division; and 5 (d) Report directly to the Director of the Environmental 6and Compliance Neighborhoods Department. 7 *** 8 PART 7. HOUSING AND COMMUNITY 9 DEVELOPMENT DIVISION 10 Sec. 35.701 Establishment; functions. 11 There is hereby created a division within the executive 12branch of the City to be known as the Housing and Community 13Development Division. The Division shall be responsible for: 14 (a) Housing services, including but not limited to: 15 (1) Affordable Housing Coordinator. The Affordable 16 Housing Coordinator shall have a bachelors degree and at 17 least five years experience in housing development. The 18 Affordable Housing Coordinator shall: 19 i. Serve as a central resource of information 20 regarding all processes required to bring an affordable 21 or workforce housing development to completion; and 22 ii. Proactively assist developers of affordable 23 and workforce housing developments with the 24 different processes required to bring an affordable or 25 workforce housing development to completion; and 26 iii. Communicate with other City Departments 27 to ensure that affordable and workforce housing 28 developments are not delayed within processes 29 managed by other City Departments; and 30 iv. Where appropriate, act as a liaison between

developers of affordable and workforce housing 2 developments and all permitting agencies to expedite 3 the permitting processes; and 4 v. Provide other necessary support to ensure 5 that affordable and workforce housing developments 6 are completed to meet the housing needs of the 7 citizens of Jacksonville. 8 (2) administration and operation of affordable 9 housing program(s) to preserve and enhance the supply of 10 affordable housing within Duval County. With the 11 exception of those matters that are the responsibility of the 12 Jacksonville Housing Authority, the Housing and 13 Community Development Division is hereby designated as 14 the City agency for housing initiatives and all matters 15 relating to affordable housing, 16 (b) Community development (including Community 17 Development Block Grant funds, town center initiatives, and 18 the administration of the Northwest Quadrant Economic 19 Development Fund); including but not limited to: 20 (1) To serve as a liaison to the Jacksonville 21 Economic Development Commission (d/b/a Economic 22 Development Board). 23 (2) To provide a program for the relocation of 24 displaced persons. 25 (3) To effectively provide for the rehabilitation, 26 conservation and redevelopment of slums and blighted 27 areas in the city. 28 (4) To prevent the growth and recurrence of slums 29 and blighted areas in the city.

(c) All other matters related thereto, including but not 2limited to the planning, development, supervision, and 3implementation of programs and projects funded by State of 4Florida funds (including but not limited State Housing Initiatives 5Partnership funds), and funded by Housing and Urban 6Development funds (including but not limited to Emergency 7Shelter Grant funds, Housing Opportunities for Persons with 8Aids funds, HOME Investment Partnership Program funds, 9Community Development Block Grant funds, and 10Neighborhood Stabilization Program funds). It is the intent of 11Council that the funding and utilization of these program funds 12should be consistent with past practices and subject to applicable 13law. 14 (d) The Division shall also serve as the liaison for the 15Jacksonville Human Rights Commission (with respect to 16housing matters only). 17 Sec. 35.702. Chief of the Housing and Community 18Development Division. 19 There shall be a Chief of the Housing and Community 20Development Division. The Chief shall: 21 (a) Have a bachelors degree or higher from an accredited 22college or university and at least five years of experience in 23affordable housing or in community planning, and have proven 24administrative experience; 25 (b) Be appointed by the Mayor, subject to confirmation by 26the Council, and shall serve at the pleasure of the Mayor; and 27 (c) Manage all operations of the Housing and Community 28Development Division. 29 Sec. 35.703. Jacksonville Housing and Community 30Development Commission; Commission Members.

(a) There is hereby established a Commission to be known 2 as the Jacksonville Housing and Community Development 3 Commission, which shall be comprised of 11 members, all of 4 whom shall be residents of Duval County. It is hereby 5 determined that all persons serving on the Jacksonville Housing 6 and Community Development Commission prior to the 7 effective date of this chapter have continued in their offices 8 notwithstanding this ordinance code transfer. Six members 9 shall be appointed by the Mayor and confirmed by Council, and 10 five members shall be appointed by the Council. Pursuant to the 11 requirements of section 420.9076, Florida Statutes (as amended 12 from time to time) the Commission shall be deemed the 13 advisory committee as required by state law. The 14 Commission membership shall consist of the following persons 15 (each of whom is actively engaged in her/her respective 16 activity): (1) residential home building industry in connection 17 with affordable housing; (2) banking or mortgage banking 18 industry in connection with affordable housing; (3) areas of 19 labor in home building in connection with affordable housing; 20 (4) advocacy for low-income persons in connection with 21 affordable housing; (5) for-profit provider of affordable 22 housing; (6) not-for-profit provider of affordable housing; and 23 (7) real estate professional in connection with affordable 24 housing. With respect to the foregoing specific requirement in 25 any of the above seven activities of an affordable housing 26 connection, if a finding is made regarding the presence of a 27 conflict of interest or other reasonable factor that would result 28 in an appointment not otherwise being made, then a member 29 may nonetheless be appointed in that activity without the 30 specific requirement of the affordable housing connection. The

Commission shall also consist of the following additional 2 persons: (1) a representative also actively serving on the local 3 planning agency pursuant to section 163.3174, Florida Statute, 4 and if the local planning agency is comprised of the governing 5 board of the municipality, then the appointment of a person 6 knowledgeable in the local planning process; (2) a 7 representative of employers in Duval County; and (3) a 8 representative of essential services personnel (as defined in the 9 Local Housing Assistance Plan as adopted from time to time). 10 The statutory only qualification for the last Commission 11 member is residency in Duval County. Each member shall 12 serve a term of four years; provided, however the initial 13 appointments shall be as follows, four (4) members shall serve 14 terms of four (4) years each, four (4) members shall serve terms 15 of three (3) years each, and three (3) members shall serve terms 16 of two (2) years each. Thereafter, all members appointed to the 17 Commission shall serve terms of four (4) years. Commencing 18 with the effective date of this chapter, no member may serve for 19 more than two consecutive terms. Members shall serve for the 20 term of their respective offices until they are reappointed and 21 confirmed, or until their qualified successors have been 22 appointed and confirmed, or such member resigns, whichever 23 occurs first. The Mayor shall appoint the Chairman from the 24 eleven member board, for a term of two years of the 25 Commission, and the Commission members shall elect the 26 remaining officers. 27 (b) A quorum for the Commission shall consist of a 28simple majority of appointed members. 29 (c) The Chairman may create such committees as he 30deems necessary.

(d) The Commission, acting as the advisory committee, 2shall conduct any required public hearings, undertake the 3review, take any and all required actions for compliance, and 4make recommendations to the Council for adoption (and 5authorize the transmittal) as required by section 420.9076, 6Florida Statutes. 7 (e) The Commission shall conduct any required public 8hearings, undertake the review, take any and all required actions 9for compliance, and recommend to the Council for adoption 10(and authorize the transmittal) a Consolidated Plan as required 11by 24 CFR Part 91. 12 Sec. 35.704. Jacksonville Housing Finance Authority. 13 The Council finds, pursuant to F.S. 159.604, that there is 14a need for a housing finance authority, as there is a need to 15alleviate a shortage of housing and capital investment for the 16people of Duval County. Accordingly, there is hereby created 17within the Housing and Community Development Division a 18separate board to be known as the Jacksonville Housing Finance 19Authority ("JHFA"). The JHFA shall ensure compliance with 20F.S. 159.601, et seq. The JHFA shall be comprised of five 21board members, three of whom shall be members appointed by 22the Mayor and confirmed by Council, and two of whom shall be 23appointed by Council. It is hereby determined that all persons 24serving on the Jacksonville Housing Financing Authority prior 25to the effective date of this chapter have continued in their 26offices notwithstanding this ordinance code transfer. Each 27member shall serve a term of four years; provided, however that 28to provide for staggered terms, of the members first appointed, 29two (2) members shall serve terms of four (4) years each, two 30(2) members shall serve terms of three (3) years each, and one

member shall serve a term of two (2) years. Thereafter, all 2members appointed to the Commission shall serve terms of four 3(4) years. Commencing with the effective date of this chapter, 4no member may serve for more than two consecutive terms, and 5members shall serve for the term of their respective offices until 6they are reappointed and confirmed, or until their qualified 7successors have been appointed and confirmed, or such member 8resigns, whichever occurs first. It is the intent that the existence 9of the JHFA as a legal entity continues without lapse, 10termination or interruption as the JHFA existed prior to the 11enactment of this chapter. A quorum for the JHFA shall consist 12of three members present. The Mayor shall appoint the 13Chairman of the JHFA from the five member board, for a term 14of two years, and the JHFA members shall elect the remaining 15officers. The Mayor is authorized to take all necessary actions in 16structuring this five-member board to ensure compliance with 17state law. At least three of the five members shall represent one 18of the following organizations: labor, finance or commerce. 19 Sec. 35.705. Scope of Authority. 20 Among its powers, the Housing and Community 21Development Division shall operate with all the powers and 22authority of a housing finance authority under F.S. Ch. 159, Pt. 23VI; provided that to the extent necessary as a matter of law, the 24Housing and Community Development Division shall operate in 25conjunction with the Jacksonville Housing Finance Authority, 26which shall have those rights and duties necessary under F.S. 27Ch. 159, Pt. IV, to preserve outstanding debt, issue new debt and 28to shield the City from financial liability and is authorized to 29function throughout all of the territorial limits of the City. 30 Sec. 35.706. Creating Chapter 55 (Economic 4Development), Ordinance Code. 5 Chapter 55 (Economic Development), Ordinance Code, is 6hereby created to read as follows: 7 Sec. 55.101 Economic Development 8 There is created and established as additional functions 9within the Jacksonville Economic Development Commission 10(d/b/a Economic Development Board) the following: 11 Sec. 55.102. Purpose. 12 The purpose of this Chapter is limited to the reorganization 13of the executive branch of government. 21codification of the legislation to effectuate the purposes of this 22Ordinance as recommended by the Council Committees and enacted by 23Council, without further Council action, provided such changes and 24amendments are limited to "technical amendments" and do not change 25the fiscal impact and, further provided, that all such amendments 26shall be subject to appropriate legal review and approval by the 27General Counsel, or designee, and all other appropriate official 28action required by law. 29
