ORDINANCE NO. ____ AN ORDINANCE AMENDING THE VILLAGE CODE REGARDING VARIOUS FEES WHEREAS, the Village of Island Lake is an Illinois municipal corporation; and WHEREAS, from time-to-time, the Village reviews its fees and charges to determine whether the fees and charges need to be updated; and WHEREAS, the Mayor and Board of Trustees find that it is in the best interest of the Village to amend various fees in the Village Code, as more fully set forth in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE Mayor and Board of Trustees of the Village of Island Lake, Lake and McHenry Counties, Illinois, as follows: Section 1. Section 2. The above stated recitals are incorporated herein by reference. Section 1-14-3 of the Village Code is hereby deleted in its entirety:

1-14-3: PAYMENT OF FEES BY CARD USERS OR CARDHOLDERS: The village may impose a convenience fee or surcharge upon the cardholder making payment of authorized obligations by credit card but said convenience fee or surcharge shall not exceed the amount of any discount or processing fee incurred by the village. No convenience fee for the issuance of any license, sticker, or permit may exceed the lesser of twenty dollars ($20.00) or five percent (5%) of the principal amount charged for the authorized obligation. No convenience fee for the payment of any administrative fine may exceed the lesser of five dollars ($5.00) or five percent (5%) of the principal amount charged for the authorized obligation. All other authorized obligations not specifically stated in this section may be charged a minimum of one dollar ($1.00) as a convenience fee.
Section 3. Section 3-4-3F of the Village Code is hereby amended as follows:

F.

Permit Fees: Permit fees, which shall be paid at the time the permit application is filed with the village clerk, shall be: Basic fee (per 3 day permit): $500.00 Additional fee for each person soliciting (per 3 day permit): $200.00 Notwithstanding the above, no permit fee shall be required for an organization that provides evidence to the Village of registration with the state of Illinois as a non-profit organization.

Section 4.

Section 3-5-5C of the Village Code is hereby deleted in its entirety:

In the event such certificate or emblem shall be lost or destroyed, the village collector shall, upon application and payment of a fee of five dollars ($5.00), issue a replacement certificate or emblem expressly marked as such.
Section 4-4-9A3 of the Village Code is hereby amended as follows:

Street Opening: A fee security deposit of ten dollars ($10.00) for each square foot of opening will be required with each permit issued to connect or reconnect to any water system lying within a public street. The fee security deposit shall pay the cost of restoration and repair of any damage to public property. The deposit may be refunded at completion of the project, in the sole discretion of the Village.
Section 5-1B-6 the Village Code is hereby amended as follows:

Section 6.

5-1B-6: PENALTY: Any person(s) violating any of the provisions of this Article shall be fined as follows: first offense, not less than ten dollars ($10.00) seventy-five dollars ($75.00) nor more than one hundred dollars ($100.00), and not less than twenty five dollars ($25.00) one hundred dollars ($100.00) nor more than two hundred dollars ($200.00) five hundred dollars ($500.00) for each offense thereafter. Section 7. B. Section 5-2-6B the Village Code is hereby amended as follows:

The garbage collection service charge to be paid quarterly by each dwelling unit or residence within the corporate limits of the village shall be as follows: $49.00 per quarter, except for those eligible for the 20% discount provided to senior citizens pursuant to Section 5-2-6C Quarterly Service Charge

Section 7-2-3B the Village Code is hereby amended as follows:

Time Of Payment: All licenses issued hereunder shall be annual licenses and shall expire February 14, following the issuance. The license fee for any license year shall be due and payable in advance, on February 15; provided, when such a

license is issued for less than one year, then such license fee shall be reduced fifty percent (50%) if payable during the second half of the license year; and provided further that when any owner shall fail to apply for and pay for such license when such fee is due the owner shall pay twenty dollars ($20.00) twenty-five dollars ($25.00) in addition to the license fee.
Section 9. Section 6 of Ordinance No. 1371-09, the Annual Fee Ordinance that established the schedule of fees, fines, and penalties for the Zoning Code is hereby amended as follows:

Sec. 9-11-24

Zoning Ordinance, violations

Not less than $25.00, nor more than $750.00, each day a violation exists shall be a separate and distinct offense; provided, however, that, if service of summons is made by certified mail pursuant to 65 ILCS 5/1-2-9.1, the maximum fine shall not exceed $200 for each offense

Section 10: In the event a conflict exists between the terms of this Ordinance and any other ordinance of the Village, the terms of this Ordinance shall govern. Section 11: In the event that any term or provision hereof is found or determined to be invalid, the invalid portion shall be deemed stricken herefrom and the remainder shall be in full force and effect. Section 12: That this Ordinance shall be in full force and effect from and after its passage and approval.
