MOTION TO FOR EXTENSION OF TIME TO FILE RESPONSES

The United States of America, in the Southern District of Iowa, by and through the United States Attorney for the Southern District of Iowa and his Assistant United States Attorney Clifford R. Cronk III moves this court for an extension of time to file responses to motions filed by the defendant to May 3, 2010. As grounds for this request for extension of time the undersigned states the following: 1. The Court previously granted the defendants request for an extension of time to file responses to certain motions to April 29, 2010. 2. Over the past several days, undersigned counsel has been ill. The illness and other health concerns have taken the undersigned out of the office and unable to complete the responses within the courts deadline. 3. Since the original request, a superseding indictment has been returned and a new trial date set for September 13, 2010. An extension should not prejudice the defendant as he is not in custody. 4. The undersigned has exchanged electronic mail with defense counsel on this

issue. He has no objection to an extension of the time to file responses to May 3, 2010. WHEREFORE, the United States respectfully requests that the time within which it must respond to the defendants pending motions be extended to and including May 3, 2010.
