Legal scholars hold the Guidelines a public record that was published with no lawful authority; the Courts Administration refuses to respond on repeated requests for a signed copy of the record, or even refer to it by name. The record should be deemed a simulated, illegal Public Record. The electronic record systems of the Supreme Court, implementation of which was concluded under Beinisch's tenure, undermine the rule of law and Civil Society in Israel, and may impact international good faith and credit, accorded to the judicial records of the State of Israel. Experience in the United States shows that such conditions are also tightly linked to failing banking regulation. Such conditions were not likely to prevail under the tenure of the late Chief Justice Yoel Susman and Clerk of the Court Shmaryahu Cohen of the Supreme Court of the State of Israel.

Jerusalem, January 14 - repeat Freedom of Information requests and a press release, which called upon Chief Justice Dorit Beinisch to eliminate the Guidelines of the Supreme Court (2010), a simulated legal record, [1,2] yielded a response. The Courts Administration of the State of Israel responded on January 10, 2012 - again, never referring to the Guidelines by name. Moreover, the most recent response was communicated in a manner that should raise concerns regarding its validity as a lawful record, in itself. [3] Consequently, Joseph Zernik, PhD, of Human Rights Alert (NGO), filed requests with the Courts Administration for certification of a copy of the Guidelines as a Legal Public Record, pursuant to the Hague Apostille Convention (1961). [4] Similar request was also filed, pertaining to the Ethic Rules for Judges (2007). [5] Both records are published on the web site of the Supreme Court, in a manner that would falsely lead a reasonable person to conclude that both are Legal Public Records. In fact, the evidence so far shows that the Ethics Rules indeed is a Legal Public Record, while the Guidelines is a simulated, illegal one. "The Courts Administration may respond on both, neither, or either of the requests," says Dr Zernik, "Regardless, the ongoing conduct of the Supreme Court and the Courts

Administration in this matter may have significant impact on international good faith and credit, accorded to judicial records of the State of Israel". As has been previously shown, the online publication of simulated records is now enabled and practiced by the Supreme Court, through its electronic record systems, implementation of which was concluded under the tenure of Chief Justice Dorit Beinisch. [6] Dr Zernik's report on this matter was reviewed by a leading Israeli computing expert, and forwarded to a leading Israeli rabbinical authority with request for an opinion, whether the Supreme Court of the State of Israel was engaged in Gneivat Da'at Ha-Tzibur (public deception). Such conduct undermines the rule of law, as most clearly documented by the recent conduct of Justice Yoram Danziger and others in the Supreme Court. [7] As has been repeatedly documented in the United States, where similar electronic record systems had been implemented a decade earlier, such systems open the door for widespread corruption of the courts, which undermines the foundation of Human Rights and Civil Society.[8,9] Moreover, such conduct in the courts undermines effective banking regulation, even under the current financial crisis. [10] Computing experts, who are readily available in Israel, should assist the appropriate State agencies in review and repair of the electronic record systems of the Israeli courts. [11] Additional proposed corrective measures include reform of the office of the Clerk of the Court in the State of Israel. "It is unlikely that these conditions prevailed under the tenure of the late Chief Justice Yoel Susman and Clerk of the Court Shmaryahu Cohen," concludes Dr Zernik. _______

reviewed by the HRC professional staff and incorporated in the official HRC Professional Staff Report with a note referring to corruption of the courts and the legal profession and discrimination by law enforcement in California.
