SCOPE OF WORK The scope of this contract included the provision of labour, materials and equipments for the construction of the Main Contract works of the proposed Rumah Sakit Internasional Bintaro Renovation and Extension, Bintaro, Tangerang, which have a total gross area of approx. 4,012 m2 square metres and the ancillary works. NATURE OF CONTRACT This Contract shall be executed in strict accordance with the Article of Agreement and Condition of Contract as prepared in this Contract Document, Bills of Quantities, Specification and Drawings. DOCUMENT Contract Document shall include the followings : - Letter of Agreement as enclosed in the Bills, Article of Agreement, Condition of Contract, Appendix and Addition to the Condition of Contract, Bills of Quantities, Specifications and Drawings. CONDITIONS OF TENDERING Each Tenderer will be provided with one copy of these Specified Bills of Quantities and one copy of the Tender Form. One (1) original and two (2) copies of the Tender Form and Bills of Quantities are to be filled in, in ink or typed, and sent to the Architect/Owner at the address, time and date as directed in the Tender Form. The Tenderers are to note that the Owner reserves the right not to accept the lowest or any Tender, and in no case will any expenses incurred by any Tenderer in the preparation of this Tender be allowed Tenderers shall submit with their tender a fully priced copy of the Bill of Quantities. Refer also to further instruction under Bill of Quantities' later in this trade. The tender will be checked for Arithmetic errors by the Architects, then will submit a report to Employer before any tender is accepted The only recognized language for all tender and contract documents for this contract will be the English language WORK UNDER A SEPARATE CONTRACT The following work is excluded from this contract and is being carried out by the Owner or under separate contracts : - Mechanical and Electrical Works

BILL OF QUANTITIES The Bills are measured generally in accordance with the Standard Method of Measurement for Building Works in Indonesia, First Edition. No alterations or additions shall be made to the Bills of Quantities without the written consent or instruction of the Quantity Surveyors All items in the Bills shall be priced in detail, not grouped together as total prices for any trade or section. Unless otherwise stated all items in these Bills shall be as supplied and fixed in positions as indicated on drawings and/or Specification. The quantities are taken absolutely net unless otherwise stated and these Bills of Quantities shall not be used as a material ordering list Throughout the Bills the following symbols shall be read as : M3 Cubic metre M2 Square metre M Lineal metre Kg Kilogram No Number Quantities stated as provisional are to be priced in the normal manner and are to be used in whole or in part as directed in writing by the Architect. The final cost to the Contract shall be calculated on a quantum meruit basis multiplied by the unit rate. 5/1

The Bills shall form part of the Contract and become known as the Contract Bills. The priced copy of the Contract Bills is to be available for use of the Architect and/or Quantity Surveyors for the purpose of valuing interim certificates, variations, etc., occuring during currency of Contract and producing the statement of final account. The Contract Bills shall be treated as a confidential document. PROVISIONAL AND PRIME COST SUMS Provisional and/or Prime Cost Sums are provided in these Bills of Quantities. The sum of money so designated shall be inserted in the cash column opposite the item without any alternation and such sums shall be expended as directed by the Architect or deducted wholly or in part if not require the purpose stated. The Contractor will not be allowed profit and/or attendance for items which are not used.

MEASUREMENT OF WORK EXECUTED AND METHOD OF VALUATION All quantities given in these Bills of Quantities have been calculated from information supplied to the tenderer by the Architect and Engineer. The Contractor shall price every item for which he requires remuneration. If any item contained in these Bills is not priced, it shall be deemed that either : (a). The cost has been included elsewhere; or (b). No remuneration is required in respect of that item

All calculations, dimensions, abstracts and any other documents connected with variations, etc., and valuation of the Works shall be made available to the Contractor at the office of the Quantity Surveyor. SPECIFICATION AND BILLS OF QUANTITIES The Specification and Bills shall be read in conjunction one with the other. Any item included in either one and not in the other shall be deemed to be included in the other in the content of this contract. No allowance will be made for non-complience of any item due to lack of understanding. SITE CONDITION The site of the work is located at Jalan M.H. Thamrin Blok B3 No. 1, Sektor 7 Bintaro Jaya, Tangerang 15224. The Contractor is advised that the existing Building at the surrounding area of the site will be in continous operating during the period of this contract and that construction activities must be confined to those areas which will least interference to the Employer. Immediately on taking possession of the site and before commencing work, the Contractor shall check the setting out, the actual levels and contours of the site against those shown on the drawings and in the event of any discrepancy, shall immediately notify the Architect. Unless the above has been complied with, no claims for a discrepancy in the setting out, levels and contours will be considered. The Tenderer is advised to visit all parts of the site and fully acquaint himself with all the conditions likely to effect the works especially the enter ticketing charge for his workmen to the site, the nature of the existing building to be demolished, water sources and levels, position of works, site difficulties, means of access, etc. RESPONSIBILITY Whether expressly stated or not in these Bills, all descriptions, Specifications and Quantities are implied to be directed at or towards the tenderer tendering for and later awarded the Contract. No allowance will be made for non-compliance of a clause due to lack of understanding.

BILL NO. 1 - P R E L I M I N A R I E S - Variation of the quantities given in the BQ - Alteration to the Contract works as and when instructed by Architect. CONDITIONS OF CONTRACT The Contractor shall allow here for any costs involved in complying with the terms of the Conditions of Contract. CONTRACT PERIOD The Tenderer is to tender on the Employer's set time for completion which is 240 (two hundred and forty) calender days from the date of commencement on site whole of the Works or is to state in his tender the time required to complete the work. Extension of the Contract Period for wet weather or Public Holidays will not be allowed and such delays, if then occur, are deemed to be included in the overall Contract Period as given above BONUS AND LIQUIDATED DAMAGES Liquidated Damages will be deducted from amounts due to the Contractor in accordance with the Conditions of Contract at the rate of 0,1 % of the Contract sums per day for everyday that the Contract remains unfinished after the date fixed for completion with the maximum amount would be 5 % of the Contract sum Bonus payments will not be paid The Certificate of Practical Completion will be issued by the Architect and at his sole discretion. DAMAGE TO EXISTING PROPERTY The Contractor shall arrange for the conveyance of materials, plant, etc., so as to cause a minimum of damage to existing conditions area. The Contractor shall be responsible for any damage caused by his carriers or workmen to any existing conditions, etc., from whatsoever cause arising and shall maintain, repair and reinstate same, to their original condition to the satisfaction of the Architect or alternatively shall bear the cost of such maintenance and restoration as a deduction from money due to him under this Contract. The Contractor is to maintain and protect employer property including that of electricity, operational of the existing property and similar undertakings and is to make good or pay for the reinstatement of all damage thereto. RESTRICTED USE OF SITE The Contractor shall be responsible for keeping all persons under his control (including those employed by his own sub-contractors and suppliers) within the boundaries of the site. (refer to Site Conditions).

TEMPORARY ACCESS TO SITE Provide any necessary temporary works for access to and about the site and remove same at completion and make good to the satisfaction of the Architect. SITE VISIT The Contractor shall be deemed to have visited the site before tendering and ascertained exactly the site conditions under which the work would be executed as no claim for extra payment caused by insufficient and inadequate information will be considered. SITE ACCESS Allow for providing and forming any temporary cross-overs and/or unobstructed access and other works necessary for entry to the site and obtaining wayleaves required and subsequently clearing away as and when directed by the Architect and making good all works disturbed or damaged at this own expense to the satisfaction and approval of the Architect. PUMPING AND DRAINAGE Remove all water resulting from any source which may accumulate on the site from time to time by providing sufficient drainage and/or pumping systems to the Architect's approval. The site shall be maintained in a dry condition by the Contractor at all times at his expense. ADJACENT BUILDINGS Before commencement of the Works the Contractor shall take an adequate survey of any adjacent existing condition which may likely be effected by the execution of the works. Such survey should include their conditions, record of defects, extent of voults and under-slab structures and location of existing utility services.

BILL NO. 1 - P R E L I M I N A R I E S The Contractor shall take photographs of existing structures and/ or buildings in the vicinity before commencement of the work to keep as record of evidence of the conditions of these existing structures and/or buildings before the execution of the work. Should damages to the existing structures and/or adjoining building be discovered during the execution of the work, the Contractor shall be responsible to reinstate and make good the damaged works at his own expense with materials and workmanship to match in every aspect with the surrounding works to the satisfaction and approval of the Architect. ORDER OF WORKS The works shall be proceeded with in such an order as the Architect may direct, or in the acsence of such instruction, in the most workman like manner.

VISITORS TO SITE The Contractor shall not allow unauthorised visitors access in the Works. All authorised visitors indentities shall be entered into a visitors book which shall be available for inspection by the Architect at all times Authorised visitors shall be directed to the Contractor's site office, for identification, before being allowed on to the Work. FLUCTUATIONS It is a condition of this Contrac that the Employer shall not become liable for a claim from the Contractor and/or Sub-Contractors and suppliers as a result of changes in the rate of exchange of Rupiahs into foreign currency or rises and falls in the cost of materials, labour, plant, overheads and the like. However, in certain exceptional cases, and only then if the fluctuation should be officially legislated, the Employer may at his own discretion, entertain claims for a loss which the Contractor claims he has incurred due to the change in foreign currency relationship against the Rupiahs which has occured after the date for submission of tenders. In all such cases claims shall be substantiated in detail in writing and agreed in writing by the Quantity Surveyor. WORK PROGRAMME AND PERFORMANCE The Contractor is to allow for the preparation and maintenance of time and progress charts. The time and progress charts are to be delivered to the Architect within one week of the award of the Contract and they are to be checked by and agreed with the Architect prior to commencement of the works. The whole of the works must be proceeded with in such sections and at such times as may be ordered by the Architect. The Contractor must allow in his charts for all days which may become due as a result of adverse weather conditions, public holidays and other similar contingencies. Site meetings will be held to monitor the progress of the work plotted on the Barchart and S - Curve schedule. PAYMENTS TO THE CONTRACTOR The Contractor shall note that the Employer will make payments to him in his representative office location. The Contractor shall prepare a detailed application for progress payments each month and submit them to the Architect/Quantity Surveyor for his approval.

TEST AND SAMPLES After the signing of the Contract the Architect shall be at liberty to call for the submission of samples of materials or the execution of samples of workmanship for approval and for any further samples as are required, until the samples submitted or executed are, in his opinion, satisfactory. The Contractor shall arrange for tests of any materials to be carried out as and when the Architect or Engineer may direct and at such laboratories as instructed. SITE MANAGEMENT AND ESTABLISHMENT COSTS Provide for all on and off site management and establishment costs including cost of Forman-in-Charge referred to in Clause of the Conditions of contract. The Contractor shall submit to the Architect details of the Foreman which he propose to employ for this project. The foreman shall be employed on a full time basis on this project after approval by the Architect. PLANT, TOOLS, MATERIALS, LABOUR, ETC. Provide all necessary plant, tools, materials, labour, etc. necessary for the proper execution of the works. The Contractor is entirely responsible for all labour employed and shall Indemnify the Employer against all obligations and risks. The Contractor must meet all labour regulations in force in the area and provide necessary facilities during the whole period of the contract. The contractor in necessary shall provide sufficient hoisting or lifting plant for proper execution of the works within the programme constraints. Or using the existing sevice lift with keep carefully and maintain as stated in 'Damage To Existing Property' REPORT TO ARCHITECT The Contractor is to deliver daily to the Clerk-of-Works a report as to the number of operatives employed on the works in each trade, etc., and delivery notes for all materials delivered to the site. This is to be done in an approved form of works diary which is to be kept at the job site and accessible to the Architect or his representative for inspection at any working hour and this diary is to be handed over to the Architect on completion of work. SAFE GUARDING THE WORKS Safe guard the Works, materials and plant against damage or theft including all necessary watching and lighting for the security of the Works, and protection of the public, and provide shelter for any watchman and/or security guards so required. The Contractor shall be solely responsible for safety of all his own materials and the materials supllied by the Employer, fixed or unifixed, and all the materials of the Contractor or supplier which are under sub-contract to the Contractor. The Contractor must provide security guards or coordinate with site security for a daily 24 hour security system to ensure complete safety of the works and materials. The Employer shall be indemnified by the Contractor for whatever loss due to damage or theft. OVERTIME AND SHIFTWORK The Contractor is to allow after getting approval from the Employer for any working in shifts and/or overtime and for additional plant, equipment, etc., as, may be necessary for the completion of the works within the stipulated periods. TRANSPORTING MATERIALS Take care in loading and unloading materials for the work that the streets and footpaths are not obstructed or the traffic impeded, and conform with person in charge at the building management regulation for carting, loading and loading all materials plant, earth, etc., to or from the building site. RESPONSIBILITY FOR THE WORKS Keep all persons including those employed by Nominated Contractors and Conrtractors under control and within the boundaries of the site, and be responsible for the care of works generally, and for all works executed and materials deposited on the site by the Contractor and suppliers, together with all risks arising from carelessness of operatieves, damage or loss by theft or any other cause, and make good all such damage or loss, and allow for all necessary watching and protective lighting. SETTING OUT The Contractor is to employ a surveyor approved by the Architect to set out the works. The Contractor is also required to set up leveling which must be tied to an existing level and shall use these level to set out all the works. The marking level positions are to be decided on site and approved by the Architects and must be properly protected. The Contractor will be responsible for the accuracy of all setting out and establishing all levels accurately Any errors in setting out and any consequential loss to the Employer will be made good at the Contractor's expense and to the satisfaction of the Architect. TEMPORARY WORKS Provide, erect and maintain on the site in position directed by the Architect adequate, for use during the execution of this Contract. (a) Consultant's site office and Contractor's site office with separate rooms size 3 x 3 m for all Nominated Sub-Contractors for the storage of materials. (b) Stores for cement and other perishable materials are to have a floor raised above ground level. (c) Sanitary accommodation. (d) Provide other such temporary buildings as may be necessary for the works for carpenters and bar benders, etc. No other temporary buildings will be allowed unless with the written permission of Architect or building management Make proper arrangements for and pay all charges in connection with conservancy. Delays to the Contract Period caused by such work shall not be deemed to require time extentions. These delays shall be absorbed in the Contract Period. CLEARING OF SITE Any demolished materials should be put into sacks and removed from the Project location in a timely manner as they should not be allowed to accumulate. Clear up and remove all rubbish and debrish from the site at regular intervals or as directed by the Architect. On completion of the work, clear up and remove from the site all rubbish, debrish, plant, surplus materials except those materials ordered to be left on site At all stages of the works the Contractor shall be responsible for maintaining the site in a clean and orderly fashion at all time. The Contractor shall be responsible for the daily removal of all rubbish and debris resulting from the above and he shall maintain a safe and clean site for all workman at all times. Should the Contractor fail to maintain the work in a timely and orderly manner to the detriment of the works or to standards acceptable, the Employer may employ such persons considered necessery to clean up the works, and the cost of such persons together with the costs of all necessery plant and equipment will be born by the Contractor or deducted from monies due to the Contractor in interim progress payment. SHOP DRAWINGS Before commencing fabrication or manufacture of any prefabricated or off site manufactured item the Contractor shall submit shop drawings of the item indicating all details and dimensions. The Contractor shall not commence manufacture until the shop drawings have been approved and signed by the Architect. The signing of such drawings by the Architect shall not relieve the Contractor of the responsibility for the correctness of all dimensions.

AS BUILT DRAWING As soon as possible or maximum 30 (thirty) days after the construction of the work have already finished completely, the Contractor shall issue two copies blue print of the as built drawing which showing all deviation made during the executive and send to the Architect/Consulting Engineer for their approval. After approved by the Architect/Consulting Engineer, the Contractor shall issue four copies of the blue print and one tranparant paper print to be submitted to the Architect for the distribution in bundle. The Employer shall not be liable for or in respect of any damages for compensation under the Fatal Accident Ordinance, the Workmen's Compensation Ordinance or at Common Law by or in consequence of any accident or injury to any workman or other person whether in the employment of the Contractor or any Sub-Contractor and the Contractor shall indemnity and keep indemnified the Employer againts all claims, demands, proceedings, costs, charges and expense whatsoever in respect thereof or in relation thereto.

WORKMAN'S COMPENSATION INSURANCES (Cont'd) Maintain and cause every Sub-Contractor to maintain such insurances as are necessary to cover all liability in respect of all workmen and other persons who may be employed on the works including paying all costs. The workmen's compensation insurances are to be taken out with the Insurance Broker or Company to be approved by the Employer and the policies and receipts are to be deposited with the Employer prior to commencement of the work. The policies are to cover the period from the commencement of the contract until the end of the Defects Liability period and until further work of any kind is being carried out. ORDERING MATERIALS Place order for specified materials at the earliest possible date after notification of award of this Contract or at such times as may be specifically state elsewhere herein for any particular materials. TEMPORARY YARDS Arrange for and lease temporary yards as may be required until such times as sheds and stores may be transferred to the site and sufficient working areas are available on the site or lease temporary yards for the duration of the Contract whichever is considered the more convinient. CONTRACTOR TO PROVIDE ALL THINGS NECESSARY Provide all necessary hoists, ladders, scaffolding, staging, tackle, tarpaulins, tools and other plant (mechanical or otherwise) and allow for all labour and materials in installing, operating, moving, adapting and maintaining same as necessary. Provide all necessary transport to and from the site for labour, materials,plant,etc.,for the execution and completion of the works. PROGRAMME OF WORKS/CRITICAL PATH CHART Within fourteen (14) days after acceptance of his tender the Contractor shall submit to the Architect a BAR CHART Programme and Man Power Schedule of all works including nominated sub contractors and supplier's works. As soon as possible but not exceeding 3 weeks after commencement of work the contractor shall submit a CRITICAL PATH CHART for the programme. The CHART shall be revised, modified and adjusted as required to suit his works plan but shall conform to the stipulated completion dates. The Contractor shall discuss and adjust his programme proposals with Architect. Once adjusted they shall not be departed from without the written approval of the Architect The programme shall be planned for early completion of Building, with finishing from top, down to level 1

PROTECTION OF WORK Cover up and protect all the works and materials from the weather and other possible demage and suspend all operations during weather which, in the Architect's opinion shall be detrimental to the works. Case up, cover up and the like during the execution of the works and make good any damage caused by such want of protection until the Employer takes possession after Practical Completion and thereafter also until the Final Certificates is issued if any damage is done by the Contractor's employees or representatives. Extra care and caution to be exercised in regard to manufacturers or Specialists protective wrappings. Such wrapping shall only be remove at final cleaning up of the Building. 5/8

JOB CONFERENCES Site meetings will be held between the Employer's representative, the Architec, Consultants, Contractor and Sub-Contractors at intervals of one week or more or as directed by the Architect. The purpose of these meetings is to assist in attaining full co-operation between all concerned on the job as well as checking the progress of the works. Minutes will be kept by the Builder or by such parties as may be so directed. All necessary accommodation and facilities for the meeting will be provided by the Contractor in the site office. PHOTOGRAPHS Engage and pay an approved photographer to take six (6) nos 6"x4" photographs from view points selected by the Architect each month during the progress of works. Supply four (2) prints of each photograph to the Architest endorsed with the name of the works and the date of photographing. HOURS OF WORK The hours of work shall be between 8 am to 5 pm Monday to Saturday, however between the hours of 8 am to 9 am and after 4 pm non noisy work only shall be carried out. OVERTIME & BONUS PAYMENT The Contractor shall allow for overtime payment if he causes his workmen to work overtime with the written permission of the Architect, in order to complete the works in accordance with his programme and completion dates. All overtime payments to Clerk-of Works and Employer's supervisory staff caused by such overtime work shall be borne by the Contractor. COST OF SAMPLES All samples shall be supplied by the Contractor at his own cost if the supply thereof is clearly intended by or provided for in the Bills if not, then at the cost of the Employer. Approved samples shall be displayed on site as minimum standards of materials and workmanship which will be permitted for this Contract. Make due allowance of time for presentation, inspection and possible rejection of samples. Time extensions will not be entertained on this account. DUST PREVENTION Make adequate provision by spraying, erecting screens or other suitable methods including regularly cleaning out all rubbish and debris at daily intervals againts any nuisance or demage by dust and debris to all work under this Contract or to persons and property in the vicinity and take responsibility for any complaints demage or claim in connection herewith. COST OF TESTS The cost of making any test shall be borne by the Contractor if such test is clearly intended by or provided for in the Bills and (in the cases of test under loads or of a test to ascertain whether the design of any finished or partially finished work is appropriate for the proposes which it was intended to fulfil) is particularised in the Bills in sufficient detail to enable the Contractor to price or allow in his rates. GUARANTEES (Cont'd) The guarantees shall cover the Employer againts all faulty materials and/or workmanship for the periods particularly stated. Where no period is stated the guarantee shall be one (1) year. All guarantee periods shall commence from the date of completion or handing over of building to Employer. ERROR CORRECTIONS Should the Contractor make any errors in his extensions and/or total, such errors shall be so rectified and adjusted that, when correctly calculated, the total of the Final Summary shall represent the same amount as that tendered by the Contractor in Form of Tender. The next aggregate amount of such errors, whether a net deduction or a net eddition, will be calculated as a percentage of the total of the Final Summary of the Bills of Quantities and all unit rates through out the BIlls of Quantities shall be subject to such percentage increase or decrease as the case may be. When it is necessary for the workers to enter the premises of the adjoining existing building for execution of work, written permission must be obtained from the Employer's representative. The contractor shall remove from the site any worker who in the opinion of the Architect misconducts himself or is considered undesirable. GENERAL ATTANDANCE UPON ALL TRADES Allow for the general attendance of one trade upon another. VALUE ADDED TAXES Provision shall be made in the prices for all value added taxes enforced under law for the duration of the contract. Indemnify the Employer against all claims for value added taxes. LIGHTING AND POWER Provide all adequate lighting and power for the works with all temporary wiring and meters; and alter, adapt and maintain as necessary, and pay all charges in connection with same. TEMPORARY FIRE EXTINGUISHERS The contractor shall provide portable fire extinguishers as approved, to be fixed at various locations to be decided by the Architect. The fire extinguishers shall be 2 gallon soda acid type type and fully charged and ready for instant use at all times. The extinguishers are not to be removed unless with the Architect's instructions. The extinguishers shall remain the property of the contractor. When flammable combustible materials are to be stored or used the contractor shall provide protective coverings and to adhere strictly to any instructions given by the Architect concerning the storage of such combustible materials. COMPLETION TESTS Properly ease all doors and casements, remove, oil and replace all locks, latches, hinges, etc., and adjust all ironmongery. SERVICES MANUALS On complettion of this contract provide line drawings of all services showing location of valves, runs, etc., together with any service manuals of equipment installed. Two copies of drawings and manuals shall be forwarded to the Architect one month after date of practical completion. NOMINATED SUB-CONTRACTORS The definition of the term "Nominated Sub-Contractor" shall be a Contractor nominated by the Architect and employed by the Employer for the execution of work of a specialist nature under the direction of the Main Contractor. Tenderers are advised to visit the Architect or Construction Cost Consultants office by prior appointment to study the Contract Documents and Drawings for the Nominated Sub-Contractors Work and thoroughly accquaint themselves with the Conditions of Nominated Sub-Contract. MAIN CONTRACTOR'S RELATIONSHIP TO NOMINATED SUB-CONTRACTORS The Main Contractor shall be fully responsible for the whole of the Contract Works including work executed by Nominated Sub-Contractor nominated by the Architect and employed by the Employer concurrently with the Main Contractor The Main Contractor shall be responsible for ensuring that all Nominated SubContract Works are properly programmed, executed and completed within the contract period for the Main Contract Works. No extensions of the contract period shall be allowable in respect of delay by Nominated SubContractors for any reason whatsoever. All instructions given by the Architect to the Main Contractor referring to the work of the Nominated Sub- Contractor shall be forwarded directly to the Nominated Sub-Contractors without delay and the Main Contractor shall ensure that the instructions are carried out promptly. MAIN CONTRATCOR'S GENERAL ATTENDANCE UPON SPECIALIST CONTRACTORS The Main Contractor shall allow for providing the following general attendance upon the Nominated Sub-Contractor's contract : a) Access for, and facilitating the unloading and taking to store of plant, materials and equipment, providing look-up storage space and working space and facilitating the taking from store and distribution of materials and equipment about the works. b) Free and reasonable use of the Main Contractors plant, particularly hoists and cranes, scaffolding, gantries, ladders, etc. c) Power, lighting, water and other temporary facilities specifically required for the Specialist Contractor Works including facilities for testing and commissioning completed nominated sub-contract works. PAYMENTS TO NOMINATED SUB-CONTRACTORS At the time of every valuation of the Works for certificate purposes for the Nominated Sub-Contractors, the Main Contractor shall sign the Nominated SubContractor's application before each Nominated Sub-Contractors. Each application will showing of : a) The gross amount claimed in the current application. b) The amount received to date The application of Nominated Sub-Contractors will not be considered unless such statements has been signed by the Main Contractor. The Architect will thereafter issue separate certificates to each Nominated SubContractor. DIRECT PAYMENTS TO NOMINATED SUB-CONTRACTORS All certificates for the Nominated Sub-Contract Works, shall be issued by the Architect to the Main Contractor who will forward the certificate to the Nominated Sub-Contractor. NOMINATED SUB-CONTRACT PROCUREMENT CONTRACTS The supply of certain imported materials and equipment required for certain of the Specialist Contract Works may be arranged under Procurement Contracts entered into by the Nominated Sub-Contractor and the Employer in order that facilities available to the Employer are obtained. The existance of such Procurement Contract shall not effect the Nominated Sub-Contractors constructural obligation and responsibilities to the Main Contractor. The Employer undertakes to disclose to, and obtain the agreement of, the Main Contractor to all relevant programming details in respect of Procurements Contract however, it is a condition of this Contract that the Employer shall not be liable to the Main Contractor for any consequences arising out of the Nominated Sub-Contractors performance of Procurement Contracts. PERFORMANCE BOND The Contractor shall provide a performance bond equal to 5 % of the awarded sum in the form of a Banker's guarantee and in the format as shown in the Appendix of this document. Other form of guarantee is not acceptable. FIRE PREVENTION Due to the fire hazard inherent in plywood/timber and fiber reinforced paint, the Contractor shall warn and responsible for his workmen (including those employed by nominated sub-contractor) that smoking is prohibited at all time within the confine of or at job site. The use of welding or torch cutting equipment or flame heating equipment in the above hazardous location shall only be done by prior permission of, and subject to the supervision of the Development Manager. PRICES Rates and prices for all items in the Bills must include for all necessary ordinary outting, waste, labour, hoists, tools, takle, good sufficient, nails, screws, spikes, plugs, glue, putty, tow, solder, carting, hauling, transporting, unloading, storing, crating, hoisting, raking, framing, fitting, fixing and setting complete together with all supervision, profit and establisment charges. All rates and prices unless stated as provisional shall remain fixed for the duration of this contract. The basis of evaluating new rates shall be calculated by inference, pro-rate or reference to other similar items in these Bills of Quantities.

Notes : A Cutting away and making good to other than structural work will be carried out by the Nominated Subcontractors concerned but the Main Contractor shall provide all necessary supervision in connection therewith. The Main Contractors attention is drawn to the the Standard Method of Measurement of Construction Works in Indonesia and in particular the coverage rules for sections 03100, 03200, 03300, 04200 and 09220 in respect of those items which are held to be included in the rates for concrete work, brickwork and blockwork and plaster and render. The Nominated Subcontractors will supply pipe and cable sleeves or conduits for the services they are installing and the Main Contractor shall build in all sleeves supplied by the Nominated Subcontractors. The Main Contractor shall make provision for services through all walls slabs and the like. If a sleeve is not in position at the time of casting / construction the Main Contractor should allow for leaving a hole and for building in a sleeve later. All sleeves will be provided by the Nominated Subcontractors ; these will be either issued to the Main Contractor for him to build in or they will be placed on the service at the point of penetration of the structure for final positioning and building in by the Main Contractor later. The following work packages will be executed by Nominated Subcontractors: Mechanical and Electrical Services Installations

Builders Work in Connection with Nominated Subcontractors A The Main Contractor shall allow for making his own arrangements with Nominated Subcontractors as to the time and manner of the execution of their work and is to obtain full particulars of their requirements with regard to the formation in the reinforced concrete structure of all chases, recesses, holes, openings etc. and shall form these features as the concrete is placed. The Main Contractor shall allow for building in all pipes, pipe sleeves, anchors, brackets and the like sundry items supplied by the Nominated Subcontractors into concrete, reinforced concrete, brickwork and blockwork. The Main Contractor shall be responsible for ensuring that the setting out of items built into the works is correct. In the event of the Main Contractor failing to form chases, recesses, holes, openings, etc. in the structural work he will be required to cut them at his own expense. No cutting, however, shall be carried out without specific approval of the Site Project Management. In the event of pipes, pipe sleeves, anchors, brackets and the like sundry items being incorrectly positioned in the works the Main Contractor shall carry out at his own expense all necessary work to correct the error to the Site Project Managements approval. The Main Contractor shall inform all Nominated Subcontractors of the casting of reinforced concrete, allowing them sufficient time for the laying of their cables, conduit, pipes, etc.
