Strata Titles Act 1985

Strata Titles Act 1985 provides provision for the subdivision of building or land of shared properties. It includes the procedure for the application of subdivision, registration, issuance of Strata Titles, management of the strata scheme after the issuance of Strata Titles and also management of Strata Titles Board. This Act is under the jurisdiction of the Department of Land and Mines, which is under Ministry of Natural Resources and Environment. The Strata Titles Act comes into force on the 1st June 1985. Before its commencement, applications for individual title for parcels within a multi-storey building were done under the provision provided in the National Land Code 1965. Subsidiary Title were issued for these parcels. The Strata Titles Act was created to overcome the weakness and insufficiency of the provision in the National Land Code regarding subdivision of building and also providesother reference related to subdivision and management of multi-storey building in various part, chapter and schedule in the National Land Code. However, the Strata Titles Act contain almost all the provisions in the National Land Code related to the subdivision of building. New elements and general improvement were also made on the application of the Strata Titles process and procedure and also the management of multistorey building. The Strata Titles Act has been amended four (4) times since its introduction that is on the 23rd February 1990 (Act A753), 2nd August 1996 (Act A951), 1st December 2001 (Act A1107) and 12th April 2007 (Act A1290). In the latest amendments, subdivision for land to become land parcel, accessory parcel and common property were introduced. These amendments provide for the application towards new housing development concept known as the Gated Community Scheme. This housing scheme consists of properties such as bungalows, terrace house and semi-detached house that are held in one (1) lot with shared facilities such as club house, swimming pools and open field. It is a closed community with wall or gate around the housing area with limited entrance access.

What is Strata Titles? Strata Titles is a form of ownership for buildings or block with multi-storey or multi-level of land parcel that were built on alienated land. The word Strata refers to the subdivided unit. Strata Titles were initially introduced in 1966 through the National Land Code 1965 to improve the law on ownership of multi-storey building. Before this, it is known as subsidiary title with reference to the building built on alienated land. In the 2007 amendment, the Strata Titles concept is widened to include for its application on land parcels on alienated land.

The Strata Titles Scheme consists of individual parcels and common property that are managed as self-governance by the Management Corporation. Parcels whether apartment, condominium, town house, commercial complex or gated-community scheme were shown in the title as owned by the

parcel owner. Common property is defined as all on the alienated land except for the individual parcels and accessory parcels such as stair, roof, garden and others.

Akta Hakmilik Strata 1985 (AHS), menyediakan urusan pecah bahagi bangunan dan tanah bagi hartanah yang dikongsi. Ia melibatkan permohonan untuk pecah bahagi, pendaftaran dan pengeluaran hakmilik, menyediakan sistem untuk pengurusan skim strata selepas pengeluaran hakmilik dan juga menyediakan sistem bagi menangani yang dikenali sebagai Lembaga Hakmilik Strata. Akta ini terletak di bawah bidangkuasa Jabatan Ketua Pengarah Tanah dan Galian (JKPTG) di bawah Kementerian Sumber Asli dan Alam Sekitar. AHS mula dikuatkuasakan pada 1 Jun 1985. Sebelum ini, permohonan untuk hakmilik individu bagi petak dalam bangunan berbilang tingkat boleh dibuat di bawah peruntukan di bawah Kanun Tanah Negara 1965 (KTN). Hakmilik subsidiari telah dikeluarkan bagi petak-petak tersebut. AHS telah diwujudkan bagi menangani kelemahan dan kekurangan peruntukan di dalam KTN berkaitan pecah bahagi bangunan dan juga membantu dalam rujukan lain berkaitan pecah bahagi dan pengurusan bagi bangunan berbilang tingkat, di mana sehingga kini boleh diperolehi di pelbagai Bahagian, Bab dan Jadual dalam KTN. Walaubagaimanapun AHS mengandungi hampir semua peruntukan KTN berkaitan pecah bahagi bangunan, elemen-elemen baru dan peningkatan umum telah dilakukan kepada proses dan prosedur permohonan hakmilik strata dan pengurusan bangunan berbilang tingkat. AHS telah dipinda sebanyak 4 kali sejak diperkenalkan iaitu pada 23 Februari 1990 (Akta A753), 2 Ogos 1996 (Akta A951), I Disember 2001 (Akta A1107) dan 12 April 2007 (Akta A1290). Dalam pindaan terkini, pecah bahagi tanah kepada petak tanah, petak aksesori dan harta bersama telah diperkenalkan. Pindaan ini memberi ruang kepada konsep pembangunan perumahan baru yang dikenali sebagai Skim Komuniti Berpagar (GACOS). Skim perumahan ini mengandungi hartanah seperti banglo, rumah teres dan juga rumah berkembar yang dibina di atas satu lot dengan kemudahan harta bersama yang dikongsi seperti rumah kelab, kolam renang dan padang terbuka. Ia merupakan komuniti tertutup dengan dinding atau pagar di sekeliling kawasan perumahan dan akses keluar masuk adalah terhad.

Apa Itu Hakmilik Strata? Hakmilik strata merupakan satu bentuk pemilikan untuk bangunan atau blok berbilang tingkat atau berbilang lapisan petak tanah yang dibangunkan di atas sebidang tanah berimilik. Perkataan strata merujuk kepada unit yang dipecah bahagi pada berbilang lapisan. Hakmilik strata mulanya telah diperkenalkan pada 1966 melalui Kanun Tanah Negara Malaysia 1965, untuk meningkatkan perundangan bagi pemilikan bangunan berbilang tingkat. Sebelum ini ia dikenali

sebagai hakmilik subsidiari dengan rujukan bangunan yang didirikan di atas tanah berimilik. Pada pindaan 2007, konsep hakmilik strata telah diperluaskan bagi kegunaan petak-petak tanah di atas tanah berimilik. Skim hakmilik strata mengandungi petak-petak individu dan harta bersama yang ditadbir secara selfgovernance oleh sistem perbadanan strata yang dikenali sebagai Perbadanan Pengurusan. Petakpetak samada apartmen, kondominium, rumah Bandar, kompleks komersil, GACOS dan lain-lain ditunjukkan di atas hakmilik sebagai dipunyai oleh Pemilik Petak. Harta Bersama ditakrifkan sebagai semua di atas tanah berimilik kecuali petak dan petak aksesori seperti tanggan, bumbung, taman dan sebagainya.
