JOINT MOTION TO DISMISS

The parties, by their respective counsels, unto this Honorable Court, respectfully allege:

1.

That the parties had manifested several times in open court that

they intend to settle the above-captioned case amicably;

2.

That after a thorough and detailed evaluation of the parties

respective claims and defenses minded and guided by recent applicable jurisprudence, and in the light of the fact that despite the pendency of the abovecaptioned case the Defendants had paid the amount of TEN MILLION PESOS (Php10,000,000.00) to the Plaintiffs, as a condition sine qua non, the herein

parties have agreed to withdraw and cause the dismissal of the above-captioned case;

3.

That accordingly, the parties hereby waive and discharge each

other from any monetary obligations they have against each other as alleged in their respective pleadings in the above-captioned case.

WHEREFORE, premises considered, it is respectfully prayed of the Honorable Court to order the dismissal of the above-captioned case.
