All students in university housing must comply with and abide by all terms and conditions that appear in this application and contract. At the close of the summer sessions, all summer residents must vacate the halls within 24 hours of their last exams. If a student is only in housing for one particular summer session, they must leave within 24 hours of their last exam for that session. Those students who have stayed all summer are required to move to their fall assignment as directed by the Office of Residence Life. Failure to move at the appropriate time will result in a $50 fine and a $15 charge per day. In addition, checkout damages may be assessed by residence life staff. Students needing to stay on campus for the summer must reside in the designated summer space to which they are assigned. Any student room changes must be addressed with the Office of Residence Life within the first week of moving into a summer assignment. Questions regarding this contract should be directed to the Office of Residence Life or the Dean of Student Development. PFEIFFER UNIVERSITY -- OFFICE OF RESIDENCE LIFE

HOUSING CONTRACT

This contract, for and in consideration of the mutual covenants and agreements hereafter set forth, is negotiated and entered into as of the (current date) _______________________________________ of _______________________________________, _____________________ (Day) (Month) (Year) by and between Pfeiffer University at Misenheimer, NC 28109, hereafter designated as the University, and ___________________________________________________________________________________________________________________ (Last) (First) (Middle) (Student ID No.) at (students home address) ____________________________________________________________________________________________ (Number & Street or PO Box) (City) (State or Country) (Zip) here in after designated as the student. The University establishes policies to inform students of their responsibility for their actions with the residence halls. They are also found in the Student Handbook and are designated to promote and maintain an atmosphere conducive to community living. All residents are responsible for knowing and adhering to the rules and regulations here and in the student handbook. By applying for and accepting a housing assignment, the student accepts the terms of this contract. Violations will result in appropriate disciplinary action. The University does not discriminate on the basis of age, race, color, national or ethnic origin, disability, or gender in the administration of educational policies. TERMS OF CONTRACT 1. The term of this contract is for the first day of the occupancy of a residence hall through the last day of occupancy of a residence hall. The student must be enrolled in summer classes, working on campus in order to be eligible for university housing. 3. The student must have a health form on file with Health Services, including documentation of all required inoculations. 4. The university reserves the right to refuse admission or readmission to the student residence halls if the student fails to meet the University admission requirements or if the student is in violation of current University policies or regulations. 5. The University may terminate this contract for the following reasons: (a.) Failure to pay the room rent; (b.) Violations of Code of Conduct as outlined by the University Student Handbook; (c.) Medical or Psychological condition that cannot be accommodated. 6. The student may terminate this contract for the following reasons: (a.) Graduation; (b.) Failure to enroll for any semester or session on the contract. Documentary evidence may be required by the University to show the right to require changes that it considers necessary or advisable. 7. Returning upper-class students are responsible for finding their own roommates. Private room fees will be charged for those students who do not have roommates. The University will assist with this process only at the students request. OBLIGATIONS OF THE UNIVERSITY The University agrees that: 1. It shall grant the use of the facilities for the published date that residence halls are open, except during official recesses, until the published date that residence halls close. 2. In the event of mechanical, electrical or water difficulties, it shall make all reasonable efforts to restore service but shall give no abatement in room rates because of inability to restore service and shall not be liable for inconvenience. 3. It shall furnish student rooms with bed, chest of drawers, chair, desk and local telephone and cable service. FURNITURE REMOVALS ARE NOT PERMITTED. 4. Room assignments will be made according to date or receipt of the housing application and after the student, and where appropriate, their parent, has signed this contract and paid the required advance room payment. Wherever possible, request for specific buildings, rooms and roommates will be honored but cannot be guaranteed. The University reserves the right to require changes, which it considers necessary or advisable. 5. Returning upper-class students are responsible for finding their own roommates. Private room fees (including additional cost for special private rooms) will be charged for those students who do not have roommates. The University will assist with this process only at the students request. OBLIGATIONS OF THE STUDENT The student shall: 1. Exercise reasonable care in the use of the facilities; care for their room, abide by all University rules and regulations, whether such regulations be now in effect or later enacted, and accept penalties for violation of all University rules and regulations (Infractions of rules and regulations may be dealt with administratively or by the University judicial system). 2. Upon check-in, sign a room condition report accepting responsibility for room furnishings and equipment. 3. Upon termination of occupancy, check out with a Residence Life staff member, who will inspect the room and relieve the occupant of responsibility for the room, its furnishings and equipment, or recommend assessment against the occupant for damages and missing property. Failure to properly check out with a Residence Life staff member will result in a $25 fine. 4. Pay the cost of replacement or repair of any breakage or damage to the students room, its fixtures or appurtenance, (fair wear and tear excepted), and a prorated share of cost for any damages to communal property when the responsible person cannot be determined. 5. Not assign the contract, sub-lease the assigned room to another party, or change rooms without advance approval. A fine of $25 will be levied for changing rooms without permission. 6. Not alter, repair, replace or substitute electrical equipment or fixtures that belong to the University. Defects in electrical equipment must be reported to a Residence Life staff member. 7. Not keep or permit pets of any kind in the residence halls or university property. 8. Abide by the procedures and guidelines in the Visitation/Guest Policy. (See Student Handbook)

9. Abide by the procedures and guidelines of the Alcohol Policy for the University and the Residence Hall. (See Student Handbook) 10. Not exit, prop or open any locked exterior door after the residence hall is locked, unless the door is designated for use. THE STUDENT UNDERSTANDS THAT: 11. The student may be required to pay charges for unauthorized alterations of rooms, equipment (including unauthorized debunking of beds and built in furniture units), or building damages and for special cleaning necessitated by improper care of equipment. 12. When the person(s) responsible for the theft or damage to University property in a common or public area cannot be identified, the cost to replace or repair the damages will be divided equally between the residents of the hallway or in the building. In cases of severe damages, students may be charged with a violation of the Code of Conduct. For further information, please read the appropriate sections in the Student Handbook. 13. The University has the right to take possession of any personal property left in the students room. The University has the right to remove the property. Unclaimed property can be given away, sold or disposed of by the University. 14. The student must make arrangements for long distance service with the institutions Telecommunication Office. 15. Personal electrical equipment authorized for use in individual rooms include TV sets, radios, stereo equipment, compact room refrigerators whose electrical requirements are not more than 120 watts and are not larger than 4.3 cubic feet, as well as microwaves which are not more than 700 watts. Individual air conditioners are prohibited. 16. Due to fire regulations, the following are prohibited: (a.) the use in individual rooms of open-coil or open-plate devices such as hot plates or toaster ovens (b.) smoking is prohibited, also the use of open flame, halogen lamps or ember devices such as candles or incense (c.) any Christmas tree or greenery other than artificial (d.) parking bicycles in the halls or stairwells (e.) bringing motor bikes or any gas-powered or operated equipment into residence halls, stairways, lobby areas or rooms (f.) hanging any objects on or obstructing sprinklers, pipes or smoke detectors. 17. The possession and use of firearms, knives with longer than a 2-inch blade, dangerous weapons, slingshots, explosives, air guns, flammable liquids, kerosene heaters, dangerous chemical mixtures, fireworks or propelled missiles are prohibited. 18. The sounding of false fire alarms and tampering with fire fighting safety equipment including extinguishers, hoses, exit signs, doors and fire alarm systems are prohibited. Such offenses are subject to prosecution in civil court, removal from residence hall, and are cause for separation from the University. 19. The student will vacate the residence hall and cooperate with police and staff members during fire and other safety drills. 20. Roofs and ledges of residence halls are off-limits. Articles are not to be placed on exterior ledges or hung out of windows. 21. Room keys are property of the University and may not be duplicated. If a key is lost or not turned in to a Residence Life staff member when the student vacates a room, the University will re-key the lock and charge the student for the cost. 22. Objects are not to be propelled out of windows. 23. Soliciting, canvassing or the use of residence halls as a location for selling is prohibited unless permission to do so is granted to University student organizations by the Dean of Student Development or the Director of Residence Life. A student may not use their room for commercial purposes. 24. Waterbeds and other pieces of water filled furniture are not permitted. 25. Loft construction must have approval and meet specifications of the University. Lofts are subject to inspection by University staff. Lofts must be removed by the individual responsible prior to the end of the contract period; failure to do so will result in a removal fee. Lofts are prohibited in James Center. 26. Exterior antennas and tampering with cable systems are not permitted. 27. Violations of any housing policies are subject to administrative penalties and/or referral to the University Judicial Board. 28. The University does not provide constant supervision and monitoring of the students residing in the residence halls. SECURITY, INSPECTION AND SEARCHES 1. a. The University shall not be liable for damages to or loss of any property of any kind which may be lost, stolen, damaged or destroyed by fire, water, steam, defective refrigerators or otherwise while on leased properties or in any storage space in the building. b. All personal property in any part of the building within the control of the student shall be at the sole risk of the student. It is the responsibility of the resident to insure their personal property. 2. The University reserves the right to periodically inventory University property and conduct maintenance, safety and health inspection of rooms. The inspections will be held during official recesses and at other times (in the latter case, after twenty-four (24) hours notice when practical, and in the presence of the occupant(s) when practical). 3. The University reserves the right for its officials to search individual rooms. Reasonable effort will be made to notify the occupant(s) in advance of such entry. 4. The University reserves the right for its officials to search individual rooms in cases where there is reasonable cause to believe the University rules/regulations are being violated. 5. The University reserves the right to request a search warrant from the Dean of Student Development when there is probable cause to believe that: (a.) a room is occupied by a nonresident whose presence constitutes a violation of the visitation/guest policy or other appropriate regulations of the University; (b.) there is a violation of municipal or state law; (c.) the occupant has concealed property within the room, possession of which is a violation of municipal, state or federal law; (d.) there is reason for concern about the safety of the resident(s).
