To: Duckhorn Homeowners Association Members The Sonoma Ridge Community has grown very quickly over the past few years and with the increase in residents, many new challenges have arisen in maintaining the safety and integrity of the community. The purpose of the Duckhorn Homeowners Association and its elected Board Members is to enhance and maintain the integrity, value, and desirability of the Sonoma Ridge Community making it a safe, enjoyable place to live. A key responsibility for the HOA is responding to communication from homeowners and Elite Property Management. Numerous topics are addressed including community safety, rules, regulations and alterations. Covenants and Restrictions exist to preserve property values of our homes and prevent nuisance activity and items. Under the direction of the original Board, there were several oversights and violations that our newly elected Board and its Committees are working diligently to address and rectify. While some of these violations were intentional and/or approved by the prior Board, the majority of infractions were due to the vagueness and difficulty of understanding the language of the current Bylaws. Our objective was to develop an easy to read format of our Associations Rules and Regulations. The enclosed document explains the Rules and Regulations of our community for every homeowner and also includes procedures for alterations and enforcement policies. The Rules and Regulations may be modified accordingly by the Board as our community evolves and they will strive to ensure the harmony of our community now and in the future. Our communitys success hinges entirely on our residents and neighbors, and every homeowner shall benefit from the preservation of the value of their residence and character of the community. Duckhorn Homeowners Association Rules and Regulations In addition to those set forth in Section 7 of the Amended and Restated Declaration of Planned Community for Sonoma Ridge Estates, dated January 2005, the following rules and regulations are set forth for the residents of the Duckhorn Homeowners Association (DHA). These rules shall be enforced by the DHA Executive Board, hereinafter referred to as The Board. The owner of each unit shall be responsible for any fines and/or consequences for any violation of these rules committed by the owner or their families, guests or tenants.

SECTION I Alterations* Above-ground pools, sheds, and under-deck enclosures are prohibited. Prior written consent is required from the Committee described in Section 7.1.1.f of the Declaration, which powers have been assigned to the DHA Executive Board, hereinafter referred to as The Board for any other alteration to the exterior of their home or property as to the size, layout, materials, screening or other aspects of construction and design, and as to the impact on neighboring homes and the community in general. The Board may deny any alteration request, at its discretion, for any reason, or based on the objection of any member of the SRMA. Some approvals will require the consent of all neighbors within view of the proposed alteration. Residents will be denied approval for any alteration if they have an unresolved violation of any Sonoma Ridge Master Association (SRMA) or DHA Rule or Regulation, have unpaid penalties or fines, or have unpaid association dues and/or late fees. Any improvement erected on a unit shall not be nearer to the front lot line and any side street than the building setback lines shown on the plots and plans. No improvement or alteration, other than fencing, shall be erected nearer than ten (10) feet to the side-line or rear-line of any unit. No improvement shall be erected on a unit until all required municipal approvals for such construction have been received, in addition to Board approval. If approved, alterations shall be completed within 6 months and all construction materials and debris shall be removed from the premises. Alterations will be inspected to ensure they are constructed as specified. Alterations shall be maintained as required. Alterations requiring prior written consent include, but are not limited to: Fences, Play Structures Custom Play Houses Permanent Basketball Hoops Permanent Sports Nets Outdoor Kitchens Changes to home exterior Driveways Gazebos Outdoor Storage Containers Pools and Spas Solar Panels Satellite Dishes greater than 18 Antennas Additions Flag Poles Decks Patios and sidewalks Driveways Porch Roofs Awnings

Unapproved alterations may be removed by the DHA at the owners expense.

SECTION II - Lawns and Landscaping Front yards and rear yards shall each be at least 75% natural grass turf which shall be regularly mowed, trimmed and edged with no weeds permitted to grow unchecked. Artificial turf and vehicle tires are prohibited. All landscaping shall be maintained as follows: Grass must not exceed 8 in height and all edges and around obstacles must be trimmed to the height of the lawn. Fence owners are responsible for trimming on both sides of their fence. Areas of dead grass must be repaired. Mulch beds shall be natural material in a shade of black or brown which is uniform throughout the unit property. Mulch made of rubber or other man made materials is prohibited. Bushes and flowers shall be neatly trimmed and growth controlled so as not to obscure windows or doors. Weeds and dead plants shall be removed. Mulch shall be replaced or refreshed annually with no large bare spots revealing dirt or plastic. Trees No unit owner may disturb any mature tree on his or her Unit unless the same shall become diseased, fall, or become a safety hazard. Trees shall be trimmed as necessary and large dead areas of branch shall be removed if possible. Gardens and temporary fencing Gardens shall be small, neatly arranged, weeded and maintained as with any other landscaped area. All gardens and mulch beds combined shall not make up more than 25% of the rear yard. Vegetable plants in the front of the home are prohibited. Corn stalks are prohibited. Vegetable plants should not exceed 36 in height. Temporary garden fencing shall be black or green netting and support posts shall be neatly placed so as to maintain a manicured appearance. Plants shall be removed or tilled under as soon as they stop producing and dead or insect- infested plants shall be removed immediately. Garden fencing shall be removed at the end of the growing season. Weedy, overgrown, unmaintained or insect-infested gardens will be considered a nuisance and shall be ordered removed by the Board. Signs and Other Displays No signs, advertising or other displays are permitted on any part of the property, with the exception of political signs during the election period, displayed no sooner than 30 days prior to the election and removed with 3 days after the election by the unit owner. Recreational Fires Fires shall be confined to stone or commercially available fire-pits designed specifically for that purpose. As per Moon Township Ordinance, recreational fires shall be at least 20 from the home, shall be no more than 3 feet in diameter and 3 feet high, and shall be extinguished by midnight. Burning of green wood or other smoke producing materials is prohibited. Lawn accessories (ornaments, fountains, bird baths, statues, etc.) Lawn accessories shall be displayed only in mulch beds and no farther than 6 feet from the front of the home. Lawn items shall not exceed 36 in height. Excessive lawn ornamentation may be considered a nuisance and ordered removed. SECTION III Home and Outbuilding Exteriors Only solid white or off-white draperies, sheers, blinds or plantations shutters may be visible from the outside of the unit in any window or door. Window-mounted air conditioning units or fans are prohibited. No clothes, sheets, blankets, laundry, towels or other articles of any kind shall be hung out or exposed on any portion of the property. The exterior of the home shall be maintained so as to

2 protect the home from the elements and to retain an attractive appearance. Missing/damaged roofing, siding or trim, damaged/falling/leaning gutters, broken windows, stained/faded/chipped paint, broken/torn/falling screens, and damaged mailboxes and lampposts shall be replaced or repaired in a timely manner. Any structure constructed of pressure-treated wood, including but not limited to decks and play structures, will be kept stained with outdoor stain of a natural color such as brown, cedar, or redwood. SECTION IV Outdoor Items and Storage Property shall be kept free and clear of rubbish, debris and other unsightly materials. Except when placed outside for collection, trash receptacles and recycle bins shall be kept inside the home or behind or beside the home and screened from view. Personal items and excess building materials shall be stored inside your home. Temporary pools shall not stand higher than 24 and shall not be more than 10 in diameter. Pools shall be emptied when not in use and removed from the yard at the end of the swimming season. Any pool that utilizes chemicals or a filtration system is considered an above-ground pool and is therefore prohibited. Party tents, play tents or any other temporary shelter may be erected 24 hours before an event and shall be removed within 24 hours after the event. Free standing gazebos shall be kept on an approved hard surface directly behind the home and removed at the end of the outdoor season. Firewood shall be kept in proper holders at least 5 off the ground and at least 30 from any home. Firewood shall be stacked no higher than 48 and the firewood holder shall be level and secured to the ground for safety. Firewood should be rotated and used up yearly. Storage of excessive amounts of firewood (more than can be used in a year) may be considered a nuisance and the excess firewood may be ordered removed by the committee. SECTION V Mailboxes, Lampposts, Exterior Lighting Only mailboxes and lampposts approved by the committee as to the aesthetics and location may be installed on a unit. Exterior lighting shall be kept in working condition. Burned-out bulbs shall be replaced within 7 days. Lampposts shall be illuminated from dusk until dawn. SECTION VI Holiday Decorations Seasonal decorations shall be displayed no sooner than 30 days before the Holiday and removed no later than 30 days after the Holiday. Excessive lighted displays or light and sound displays that attract spectators and vehicle traffic are prohibited and shall be ordered removed by the Board. SECTION VII Parking Owners may only park their automobiles and motorized vehicles in their garages or driveways that serve their unit. No unlicensed or uninsured vehicle shall be parked outside of the unit. There shall be no off-street or lawn parking by unit owners. Motorcycles, recreational vehicles, boats, boat trailers, or utility trailers may not be parked in outdoor areas of the property for more than four (4) hours in any twenty-four (24) hour period. Only minor repairs taking less than twenty-four (24) hours may be performed on automobiles, recreational vehicles or motorcycles in any driveway of a unit. No commercial trucks, trailers or vans may be parked on the Property for more than the time required to make a delivery or pick-up, except for construction vehicles during the reasonable period of construction. 3

SECTION VIII - Operation of Machines and motorized recreational vehicles No unit owner or anyone at a unit with the permission of the owner shall operate any machines, appliances, accessories, equipment or motorized recreational vehicles such as ATVs, quads or dirt bikes in such manner as to cause, in the judgment of the Board, an unreasonable disturbance to others. SECTION IX Use of Unit Units are for residential use only and shall not be used for any prohibited purpose. No business requiring employee or customer parking shall be conducted at any unit. Five (5) or more garage or estate sales in a 12-month period will be considered a re-sale business and is prohibited. No obnoxious or offensive activity shall be carried on in any unit, nor shall anything be done therein, either willfully or negligently, which may be or become an annoyance or nuisance to the other residents. SECTION X Pets Only domestic pets such as cats, dogs, song birds and fish are permitted in a Unit or anywhere on the Property. No chickens, ducks, geese, turkeys, pigs, other farm animals, snakes, reptiles, or insects such as bees may be kept on the Property. No more than two (2) non-aquatic pets are permitted per unit. No unit shall be used for the commercial purpose of breeding any animal. Pets shall be fenced, leashed or otherwise under the control and supervision of the owner at all times. No pet shall be chained, tied or restrained to any portion of the Unit. No line, chain, doghouse, or other pet shelter shall be permitted on any portion of the Unit. All pets must be properly licensed and vaccinated. No pet shall become a nuisance to any other Unit owner. For the complete list of pet rules and regulations, see Section 7.1.1.s of the Declaration SECTION XI Penalties and Fines Owners who are notified that they are in violation of any Planned Community Rule or Regulation will be given a specific number of days in which to rectify the situation as is determined reasonable by the Board. If the violation is not rectified to the satisfaction of the Board within the prescribed time period, a minimum fine of $50 per month will be imposed on the offending unit owner and that owners pool and clubhouse privileges will be suspended. Owners with suspended privileges may NOT enter the pool or clubhouse as a guest of another owner. At any time during this period, the Board may take action to resolve the situation, including removal of unapproved structures or items or any other action necessary to comply with these rules and regulations, and the unit owner will be responsible for reimbursing the Board for any associated costs, including legal fees. SECTION XIII Reporting Violations Any resident or any member of the SRMA may report a violation of these Rules and Regulations to Elite Management at 724-926-3093 or email lou@elitemgtservices.com .All reports are confidential.

4 Appendix A Requirements for Approval of Requests for Alterations For the purpose of this document, directly behind the home will mean in the rear plane on the house and between the two side planes of the home. Approved hard surface will mean a porch, patio or deck. Fences - All fencing will be constructed of maintenance-free black aluminum and will be installed in a professional manner with all posts and gates level and plumb. No fence will be greater than 48 in height unless required by township ordinance for safety purposes. Fences will only be permitted behind the home and only around usable, landscaped areas of the yard and not on steep hills or around wooded areas and weeds. Required Maintenance - Any part of a fence that is damaged, faded, sagging or leaning shall be repaired or replaced. The grass or landscaping on both sides of any fence installed against the property line shall be trimmed and maintained by the unit owner who owns the fence and shall not be the burden of the neighboring unit owner. Play structures Wooden play structures shall be limited in size (max. 20 wide, 8 deep and 10 high), must comply with the building line requirements of Section I, and shall be located directly behind the home. An exception may be made for topography limitations but will require the structure be carefully integrated into the landscaping for minimum visibility from the street. Metal play structures are prohibited. Required Maintenance Play structures shall be kept stained with outdoor stain in a natural color such as brown, cedar or redwood, and shall be kept in safe working condition. Any loose, rotting or splintered wood, broken swings, cracked slides, torn canvas, etc., shall be replaced immediately. Any play structure not maintained, or determined by the Board to be in a state of disrepair, shall be removed. Custom Play Houses - Play houses are restricted in size to a maximum of 6 x 8 in length and width, side walls to 48 in height, peak to 66 in height, and all doors and windows shall be child-sized. The exterior should tastefully portray the character of a house. Required Maintenance The play house exterior shall be stained or painted as needed and the roof, doors and windows maintained and kept in working order. Any play house not maintained, or determined by the Board to be in a state of disrepair, shall be removed. Gazebos Permanent gazebos shall be erected directly behind the home on an approved hard surface or integral decking and shall conform to all building line requirements. Temporary gazebos shall be erected on an approved hard surface directly behind the home and shall be removed at the end of the outdoor season as stated in Section IV. Pools and Hot Tubs Above-ground pools are prohibited. In-ground pools and hot tubs should be located and designed so as not to interfere with the privacy and enjoyment of other residents utilizing their own outdoor areas. In-ground pools shall be located directly behind the home. Hot tubs should be located directly behind the home on an approved hard surface that is against the rear of the home. Required Maintenance Hot tubs and covers shall be kept in good, working condition and shall be free from holes, cracks or fading. In-ground pools must be opened yearly and maintained in good, working condition. Only approved safety covers may be used during winterization and pools not opened or operational for a period of 12 months or more shall be considered non-operational and shall be removed at the owners expense.

Appendix A - Continued Decks, Patios, Sidewalks and Outdoor Kitchens Decks and patios shall be on the rear of the home only. Patios and sidewalks shall be constructed of concrete, brick, pavers or other approved hard surface material. Gravel or packed stone patios and sidewalks are prohibited. Deck surfaces, railings, balusters and trim shall be constructed of a low-maintenance material and shall be held to the same maintenance standards as any other alteration. Decks support posts higher than 5 feet and stair support posts shall be bricked, stained, painted or otherwise covered to coordinate with the deck or home. Outdoor kitchens shall be on an approved hard surface directly behind the home, shall have appropriate built-in cooking and refrigeration units designed specifically for that purpose, and shall be of stone or brick construction that coordinates with the home or patio surface. Additions Additions are added living spaces, porches, and any roof over a porch, patio or deck. Additions shall be on a proper footer with a foundation with matching brick to grade (deck or patio roofs shall not require brick to grade). The exterior shall match the existing exterior of the home and the existing windows. Additions on Estate lots will be bricked on any exterior wall that is part of the front or side of the home. Roofs shall match or coordinate with the existing roof(s) and shall have the same or similar pitch, overhang, soffit and fascia as the existing roof(s). Solar Panels, Satellite Dishes and Antennas. - Approved solar panels shall be installed in an orderly manner on the roof of the home only. Approved satellite dishes larger than 18, and any other satellite dish, along with the associated wiring, shall not be mounted on the front of the unit. Any TV aerial, antenna or wiring will also require approval from the Committee. Unapproved satellite dishes, wiring, TV aerial or antenna installed on any unit may be removed at the cost of the violating Unit Owner, without notice, by the Board Modifications to Exterior Surface of Home Approval is required for exterior modifications including changes in paint color, siding color, brick style, roofing material, shutters, doors, windows or garage doors. Awnings Aluminum, plastic, vinyl and fiberglass awnings are prohibited. Canvas awnings shall be installed over decks, porches or patios on the side or rear of the home. Awning Maintenance Awnings shall be properly maintained and shall be repaired or replaced when they become torn, faded, worn or hold water due to stretching or sagging. Awnings not installed for a period of 12 months shall be considered no longer in use and the existing metal support structure shall be removed. Driveways All driveways will be composed of asphalt, concrete or other equivalent material. Driveways shall be repaired or replaced when they become unsightly or dangerous. Flag Poles Flag poles will be considered for approval on an individual basis and the Committee will strongly consider size and location.
