Narrative
On 3/9/2012 at approximately 2004 hours, I (Officer Kirshbaum) responded to a tone alert from Boulder Police Dispatch to 1940 Tincup Court in the City and County of Boulder, State of Colorado, regarding a report of felony menacing involving a twelve year old victim. Dispatch advised that the victim, later identified as Benjamin Sidwell (DOB 1/8/2000), had been grabbed by a male party with grey hair and had a gun pointed at him. Dispatch advised that the suspect had possibly left westbound from the location. As I entered the neighborhood, I did so from the west, and I observed no pedestrians or vehicles coming from the area of the call. Upon arrival I met with Benjamin, as well as with Julie Gerster, the resident of 1940 Tincup Court. Gerster informed me that she was the one who had called 911, and that there was a birthday party occurring at her residence for her son and that Benjamin was there for the party. I asked Benjamin to tell me what had happened, and he told me that he and the other boys at the party (there were approximately seven or eight of them) were in the cul de sac playing tag, and that he was "it". He told me that he was in the "yard on the corner, and an old man came from behind and grabbed me by the arm". Benjamin said the man was white, had short grey hair and wore glasses. He said that the man pulled him around to face him and at that time Benjamin saw what he believed was a handgun pointed at him. He told me that the man yelled at him repeatedly, "you could be dead!", and that he (Benjamin) repeatedly yelled "I'm sorry!". Benjamin said that the man then dragged him off of the front lawn and into the street and led him about halfway back to the house that the party was in, and then let go of his arm, kicked him in the back, and yelled "get out of here!". Benjamin told me he then ran the rest of the way back to the party (at 1940 Tincup) and thought the man walked back to his house (westbound). Gerster told me that she was upstairs at her residence watching out the window as the boys played tag in the cul de sac, and she said she could not see the corner yard that Benjamin was in, but that she heard Benjamin "bawling and crying" as he came back to the driveway of her house. When she went down to see why he was crying, Benjamin told her what had happened, and she called 911.

I asked Benjamin if he could walk me to the yard that this had occurred in, and he told me yes. Gerster told me she thought it was the man who lived on the southwest corner, as she knows him to have yelled at other children for walking on his yard in the past. Benjamin walked me to the front yard of 1915 Tincup Court, and pointed to the area he was in when he was grabbed from behind and saw the man point a gun at him. He then walked me back through the center of Tincup Court in the direction of Gerster's house, explaining again that the man had dragged him out into the center of the street and then kicked him in the back and let go. I asked Benjamin to describe the gun that he saw, and he told me it was "a revolver". I asked him if he meant one that had a wheel in the middle of it, and he said "yes". I asked him if he saw what color it was, and he told me no. I asked him if it was long or short, and he told me "medium". I asked Benjamin if he saw the man's face, and he told me "it was dark". I asked him where the gun was pointed, and Benjamin said "at me", and pointed to his upper chest area. I asked Benjamin how he felt when he saw that the man was pointed a gun at him and he told me "really, really scared". I asked him if the man had said anything else to him, and he told me no. Gerster told me that on a previous occasion she had seen the man on the corner yell at one of the other boys that was present at the party. That boy is Bailey Gimpel, a friend of Gerster's son and Benjamin. Officer McNalley and I spoke with Gimpel and he told us that sometime last year he, his brother, and one of his brother's friends were all playing in the cul de sac and that his brother and his friend had been in the grass of the corner house and an "old man" came out and yelled at them. The house on the southwest corner of Tincup Court and Lehigh Drive that all involved people referred to is 1915 Tincup Court. According to the Records Division of the Boulder Police Department, that house is owned by Paul Staffin (DOB 9/17/1944). McNalley, Officer Perea and I canvassed the houses in the cul de sac, and although no one heard anything other than boys playing, we were informed that other neighbors have observed Staffin to yell at anyone who enters onto his yard, to include his own grandchildren. We also were told that Staffin has gotten into verbal yelling matches with construction contractors doing work on houses near to Staffin's. Neighbors also stated Staffin is an anthropologist and is away for extended periods of time, but is currently in town. The neighbors knew him by name, and provided the same phone number for him as the Boulder Police Records Division. There were no lights on at Staffin's house (not when I drove past it, nor at any time while I was on scene). There was no answer at his door after repeated attempts. There was no answer on the telephone listed for Staffin. Dispatch left a message, and I left a message as well advising Staffin to contact me as soon as possible. I gave Gerster my business card with this case report number on it, and I gave Benjamin my card with this case report number on it. McNalley contacted Benjamin's father, James, and advised him of the situation and the case report number. Boulder Police Records Division confirms no criminal history for Staffin. University of Colorado Police Department confirmed that Staffin is a Continuing Education/Non Credit Student in Anthropology. Detectives and Staff Duty Officer notified, as well as on duty personnel for extra patrol at Staffin's address for continued attempted contact. This case status is open, to be investigated.

On 03/10/12 at approximately 1236 hours, I Officer Burick received a phone call from Detective Sergeant Hartkopp. He requested that the Boulder Police Department Target Crime Team meet him at 1915 Tincup for a "knock and talk". Myself, Officer Niedzielski, and Officer Parch responded to the area and met with Sergeant Hartkopp. We were all in plain clothes and driving un-marked vehicles. On 03/10/12 at 1315 hours, Officer Parch and I approached the front door, while Sergeant Hartkopp and Officer Niedzielski watched the back door. I knocked on the door and eventually a male, now known to me as the arrestee, Paul Staffin, answered the door. I identified myself as a Boulder Police Officer and asked him if he was "Paul". He stated that he was. I asked him if he minded if we stepped inside and spoke with him. He stated: "sure, come on in". We stepped inside and told Staffin that we were there to speak with him about the incident last night. Staffin replied: "you mean the prowler". I then asked him what he meant by "prowler". He then stated that he was inside his house last night when he heard someone knocking on his door. He stated that he has had trouble with prowlers at his house, so he did not answer the door. I asked him if he called the police about the prowler and he stated that he did not. I asked him why he did not call the police if he thought a prowler was knocking on his door. He hesitated, then said: "well, I don't know". I then explained to Staffin that the reason we wanted to speak to him was because a 12 y/o juvenile had a gun pointed at him last night by a person who came from his front yard. I asked Staffin if he knows anything about that incident. He stated: "no, absolutely not". He then proceeded to tell me how he has experienced unknown people/prowlers going between his and the neighbors house at night and it could have been anyone. I asked Staffin if he was aware of the police activity in the neighborhood last night and he stated: "no, I was upstairs and had the television on". I then asked him how he heard the "prowler" knocking on the door if he was upstairs and had the television on. He stated: "I don't know". I then asked Staffin if he had a confrontation with a juvenile outside last night. He said: " I already told you, absolutely not". I then asked Staffin if he owns a gun. He responded by telling me no. I asked him again and he stated: "well, I have a .22 rifle, I can show it to you if you want". He explained that he has had the rifle for a long time and that someone had given it to him as a gift. I asked him if he has a revolver handgun in the house. He said: "no, I don't even like guns, they scare me". I asked him one more time if he has a revolver and he stated: "absolutely not". As I was speaking to Staffin, I noticed that his left hand and wrist was wrapped in a large bandage/splint. I asked Staffin how he injured his wrist. He stated that he fell on the ice a few days ago. I asked him if he got treated by a doctor. He stated: "yeah". I then asked him where he was treated. He hesitated for a few seconds, then stated: "Louisville emergency, no, I, I, mean...the one in Lafayette". I asked him if it was at Exempla Hospital and he stated: "yeah, that's the one". As he answered questions he was indirect and failed to maintain eye contact. He appeared nervous and uncertain of his answers. I then asked him if he had medical papers documenting his

injury and treatment. At first he did not answer, but when asked again, he stated: "well yeah, somewhere". I then told Staffin that I do not believe that he injured his wrist. I told him that I thought that bandage was fake and that he wrapped himself up in that bandage to make his story believable and make us believe that he did not point a gun at the juvenile. I then told Staffin that we need to recover the handgun. I told him that we just want to make the neighborhood safer and that by him giving me that handgun, the neighborhood would be safer. Staffin then stated: "you just want the handgun?" and I replied: "yes". He then stated: "okay, I have to tell you something: You are very good at your job, I will show you where the handgun is." He then stated: "it is just a pellet gun and I never was going to hurt anyone". He stated: "those kids harass me, they throw snowballs at my house and bother me. I know it was stupid and I am embarrassed. I want to tell you what happened. I just went out there with the gun to scare him from my yard, so I pointed it at him, and I took a swipe at him with my foot, but I don't think I even connected." He then asked: "Am I going to jail?". I responded by asking him what he thinks should happed to an adult who points a gun at a 12 y/o boy? He stated: "Well, I know it was wrong and I am extremely sorry for that. I was hoping that you could just warn me and I will apologize to the neighbors". As he was speaking, Staffin ripped off the fake bandage/splint and stated: "you are right, this was just part of the hoax". I asked Staffin if we could retrieve the pellet gun and he stated: "yeah, its downstairs". He then lead us down stairs and pointed to a compartment underneath an indoor spa. Officer Parch asked him if he may retrieve the gun and Staffin replied: "yeah, go ahead". Officer Parch retrieved the pellet gun from the compartment under the spa. The pellet gun is a Crosman .177 cal 357 pellet gun with a black barrel and plastic wood handles. It is a revolver style replica. The gun was photographed and placed into BPD Property/Evidence. I advised Staffin that he was under arrest for Felony Menacing and Harassment. Officer Xiong responded to the scene and transported Staffin to the Boulder County Jail.

Narrative
On 03-10-2012, I, Ofc. Niedzielski, accompanied Sgt. Hartkopp, Ofc. Burick and Ofc. Parch to 1915 Tincup Ct. to attempt contact with Paul Staffin reference a felony menacing call from 03-09-2012. Sgt. Hartkopp and I provided perimeter security while Ofc. Burick and Ofc. Parch attempted contact at the front door. Ofc. Parch advised me that they were in contact with Staffin at approximately 1315 hrs. Sgt. Hartkopp and I then went to the front porch to provide cover if necessary. Ofc. Burick and Ofc. Parch spoke to Staffin inside the residence. After speaking to Staffin, Ofc. Burick asked if I could arrange for patrol to respond to the residence to transport Staffin to the jail. Staffin had led Ofc. Burick and Ofc. Parch to a pellet gun in his residence. Ofc. Parch had the weapon, and I received the weapon from Ofc. Parch to be placed into evidence. Ofc. Xiong arrived to transport Staffin to jail. I returned to the police department with the weapon. The weapon was a Crosman 357 .117 caliber pellet gun. The pellet gun was charged by a small carbon dioxide canister in the grip of the weapon. The weapon was photographed at the police department. The carbon dioxide canister was removed from the weapon to render the weapon safe. The weapon and the empty carbon dioxide canister were packaged in the same box. The weapon
