Fiveyearsago,onMartinLutherKingJr.Day,Iwasarrested fordrivingwithoutaseatbeltandadefectivetaillight,inthe parkinglotattheHomeDepotshoppingcenterinElmontNewYork,by officerMagnusonaWhiteformerNewYorkCityPoliceofficer, currentlyemployedbytheNassauCountyPoliceDepartment.He confiscatedmyvehicle,tools,andmedication,inadditionto threateningmewithadditionalchargesforarrangingthemedication intopillpouches.(PeopleofTheStateofNewYorkvHolmes, Docket#2007NA001345) Inordertoprovidealawfulbasisforthearrest,heprepareda policereportandtheaffidavitsupportingthecriminalcomplaint, containingstatementsheknewtobefalseabouttheeventsleadingup tothearrest.Specificallythathepersonallyobservedmeoperating myvehicleonHempsteadAvenuewithoutaseatbelt,andadefective taillight,eventhough,priortothearrest,Iwassittinginmy parkedvehicleforseveralminutesbeforeIwasconfronted,and interrogated,bytwouniformedBlackofficerswhoorderedmetomove. Duringthebookingprocessmymedicationproblemcametothe supervisingofficer'sattention,andofficerMagnusontransportedme totheNassauCountyMedicalCenterforanexamination.Iwas transportedtotheMedicalCenterforfurtherexaminationbyanother officerbelievedtobeThorn,priortomyarraignment.Inorderto justifythehospitalvisitsandtransportationcosts,Thornprepared asuicidereportcontainingstatementsheknewtobefalseaboutthe reasonforthehospitalvisitsandtransportationcost.Specifically thatIwasreferredtothehospitalbecauseIwasadrugaddict,and analcoholic. FollowingmyarraignmentIwastakenintocustodybytheNassau CountySheriff'sDepartment.John/JaneDoeanemployeeoftheNassau CountySheriff'sDepartmentresponsiblefortakinginventoryof prisoner'spropertyatthecorrectionalfacilityinEastMeadow, preparedaninventoryreportcontainingstatementstheyknewtobe falseaboutmyproperty.Specificallythatmymoneyandmedication wasreturned,eventhoughofficerMagnusonconfiscatedmymedication, andtheystillhavemymoney. OfficersMagnuson,Thorn,andJohn/JaneDoe,whileactingunder thecolorofLawdidwillfullydeprivemeoftherighttobefree fromthedeprivationoflibertyandpropertyinviolationof;a)the DueprocessclauseoftheFourteenthAmendment,whichincludesthe rightnottohavefalseinformationpresentedagainstmebyanyone actingunderthecolorofLaw,b)theFourthAmendment,andc)Title 18,UnitedStatesCode,Sections241,and242.Ihavebeeninjured. OnApril24,2007,NassauCountyExecutiveThomasSuozziasked PoliceCommissionerLawrencetoinvestigatethematter.(Seeattached letter)Theyarestilllookingintothemattertoday. Livingonthestreetforoverfiveyearshastakenit'stollon myhealthandsafety.Mylifehasbeenthreatened.Ihavebeenrobbed onnumerousoccasions.Ihavedevelopedhypertension,chestpains, pedaledema,athlete'sfoot,conjunctivitis,inadditiontoother conditionsthatmaybelifethreatening.RightnowIamhavingchest pains.Thepainisrelatedtolivingonthestreetforsolongand notbeingabletosleephorizontally.WheneverIdo,Igetthis excruciatingpainontheleftsideofmybody,Iurinateprofusely, myfeetshrinks,andtheswellingcausedbypedaledemasubside.I havebeentoemergencyrooms,andtheresultsofthetestsperformed, showsnothingabnormal.Someemergencyroomrefusetotreatme. Ineedtogetacompletephysicalexamination,includinga colonoscopy,bymyownphysician.

    Ineedmydriver'slicense.Ineedmyvehicle.Ineedtogoback towork.Whensomeoneisdeprivedofmedicaltreatmentandtheir livelihood,it'stantamounttokillingthem.Homelessnessisadeath sentence.IfIamtreatedonanequalbasisasothervictimstoday,I willnotbehomelesstomorrow. BeingacrimevictimasdefinedbyFederalandStateLaws,Iam entitledtotherights,assetforthintheJusticeforAllActof 2004,18U.S.C.3771.IamrequestingyourhelptoensureIamnot treateddifferentlyfromothervictims,myrightsguaranteedbythe Actarenolongerdenied,andbringclosuretomyself,myfamily,my friends,andmycommunity.
