FREMONT In February, Spectrum
Health Gerber Memorial employees had the
opportunity to test computerized manikins
that function in many ways like real people.
The manikins were provided by Region 6
ASPR/Homeland Security Bio Defense Net-
work. The manikins are reproductions of the
human body and can be programmed to re-
fect certain physical scenarios.
Lung and heart sounds can be replicated
and treated by the EMT or physician and the
manikin will in turn react to the treatment.
The manikins can be adjusted to simulate
several different physical problems. During
a two-day period over 100 Spectrum Health
Gerber Memorial employees and Life Am-
bulance EMT-P staff came to the hospital to
learn about and test the educational purposes
these manikins provide. The reviews were ex-
ceptional as everyone felt they could beneft
from the scenarios offered through these com-
puterized manikins.
This technology was made available
through a grant from the Fremont Area Com-
munity Foundation in Collaboration with
by Region 6 ASPR/Homeland Security Bio
Defense Network. Spectrum Health Gerber
Memorial is planning to send fve RN clini-
cal coordinators and four EMT -P from Life
Ambulance to the Region 6 Simulation Lab in
Muskegon.
They will be trained to operate these com-
puter manikins and bring education back to
Spectrum Health Gerber Memorial regularly.

ton, RN and Tonda Brayfeld, RN, BSN, Educational Manager at

Tri County Area Schools Extends
Community Survey Deadline
Survey to Gather Budget and Planning Input
The Tri County Area School District is extending the deadline for the
community survey from March 30th to April 15th.
Due to circumstances beyond the districts control, a delay occurred
in the mailing of the Community Survey reecting a March 30 due
date. Therefore, the district is extending the due date to April 15th.
The District is facing many challenges in the coming years and we
want to be sure that everyone in our community has an opportunity
to participate in the decision making process. Therefore, well be
extending survey deadline two weeks to make sure everyone has
sufcient time to respond.
The survey asks residents to help develop specic solutions to bud-
get shortfalls, as well as facility and technology needs. The survey
also address topics such as budgeting and board planning, district
communications, programs, facilities and overall satisfaction.
The goal of this process is to create a plan that reects the goals
and priorities of our taxpayers, said Cumings. We want to under-
stand what people really want for our students and schools, and
look forward to this process.
A report on the survey results will be presented to the Board of Edu-
cation this spring. A compilation of survey questions and results will
also be posted on the District website. If you have questions regard-
ing the survey, please contact us at 616-636-5454.
We appreciate the communities continued support to Tri County
Area Schools in our vision to help every child achieve his/her best
future.

A Bittersweet GoodBye
It is with a lot of mixed emotions that I write this letter. I have
lived in Howard City for almost 13 years and have worked at Powells
Excavating for nearly 12 years. I am sad to say it is time for me to
move on. I will be moving to Pennsylvania. We have sold our home
and will be leaving April 13. I have made so many good friends and
have met such nice people that it makes it very hard to say goodbye.
All the guys at work are like my extended family to say the least
about everyone at the hardware store and of course my family at
First Baptist Church, I love you all. I will be working a few days the
frst week of April, if you get a chance stop by and say goodbye, I
would like that very much. Thank you to everyone who so gracious-
ly helped me out while I was by myself and thanks to all for making
my past 12 years ones I will never forget. I will miss you all.

LETTER TO THE EDITOR
8
The weekend pole barn project. Your buddies are
coming over to help build your new pole barn. Very
nearby, the hole where the old septic tank was located
is still visible. Should you worry that someone might
fall in and hurt themselves? Well, its obviously a deep,
dangerous hole to be avoided, so your buddies will walk
around it, right? And if a buddy falls in, how could it be
your fault when its obviously a hole and she shouldnt
have walked so close? Besides, you dont really have the
money for the ll dirt right now.
Hottman versus Hottmanwas a 1993 case in which
2 of 3 judges on a Court of Appeals panel reversed a
lower court that had ruled in favor of the homeowner
who didnt put up scaffolding for himself and his
brothers when they came to help him reroof his 12/12
(!) pitch roof. One brother had fallen off the roof. The
homeowner had maintained that they all knew it was a
dangerous roof before they got on it, so how could it be
his fault? The trial court had agreed and threw the case
out. The Appeals Court disagreed.
The facts. In the fall of 1993 Richard Hottman was
remodeling his Oxford home. Richard enlisted the help
of his brothers, Randall and Robert, to reroof. Because
of the 12/12 (every 12 inches on the slope, the roof rose
12 inches up) roof pitch, Randall proposed they should
use roof jacks and build a temporary walkway to stand
on while working. However, Richard didnt have enough
jacks and wouldnt spring the money for more. So the
brothers nailed 2x4s to the plywood roong to provide
a foothold and set to reroong. Randall fell off the roof,
broke bones, but lived.
Admittedly foolish. During a deposition Randall agreed
that he wasnt paid for his services and hadnt expected
to be paid. He agreed that the family members regularly
helped one another with projects. In fact, Richard had
helped Randall work on his home. Randall admitted
knowing this was a dangerous job. Randall even
admitted he had been lets say - foolish, to get up on
the roof without scaffolding.
Still, Randall had sued, claiming that Richard had owed
him a duty of care, which Richard breached by failing
to maintain the premises in a reasonably safe condition.
The lower, Circuit, Court judge had concluded that the
roof was such an open and obvious danger, what was
Randall thinking blaming Richard?
Wrong Reasons. As precedent for overthrowing the
Circuit Court judges decision, the Appeals Court
relied upon a famous case, Bertrand v Alan Ford, Inc,
a 1995 Michigan Supreme Court decision. In that case
the Supreme Court had stated that if the risk of harm
remains unreasonable, despite its obviousness or despite
knowledge of it by the invitee (Randall in this case),
then the circumstances may be such that the invitor
(Richard was the invitor as Randall was his visitor with
his permission) is required to undertake reasonable
precautions anyways.
So while Randall wasnt the smartest for getting up on his
brothers roof, Randalls own negligence didnt negate
Richards duty to take reasonable care for Randalls
safety. The Court of Appeals sent the case back for a
jury to decide whether Richard had taken reasonable
care for Randalls safety.
My brothers keeper? I think the high court wanted
some teeth in the notion that we are our brothers keeper.
Just because Richard has two brothers who would walk
on a 12/12 pitch roof with him without scaffolding and
without complaint, foolishly, doesnt mean Richard
should have allowed it, especially when he had the power
to improve the safety of the situation. Richard knew it
was a bad deal for his brothers. But his pocketbook was
more important to him than they were. Not what some
would call reasonable care of ones brother.
Interestingly, one judge dissented. Judge Sawyer: If
Randall believed that those footholds did not adequately
alleviate the danger of working on the roof, he could
have declined to work on the roof unless a different
safety measure was utilized, such as the roof jacks that
he now argues should have been used. And I see his
point. In Judge Sawyers mind, there comes a time when
a situation can be so open and obvious that no sensible
person can be blamed for anothers foolishness.
If good sense was common sense, wed all have it.
Then again, seems to me these three brothers all had
the foolish gene, not just Randall. Wasnt a sensible
brother among them.
