RE: Reply on the April 22, 2012 Response (1973/12) by the Ministry of Justice on a) Notice of criminal fraud complaint against Chief Clerk of the Supreme Court SARAH LIFSCHITZ, and b) Request for correction of false Apostille certification procedures, published online with no lawful authority. Dear Attorney Teneh: Thank you for your expedient response, referenced above. I write to request a direct response on the request for correction of false Apostille certification procedures, and to inquire regarding the delayed response on the Freedom of Information Act Request (T-6). Upon review of the April 22, 2012 response (1973/12), [1] it appears to confuse two unrelated issues: a) April 16, 2012 Copy of the Criminal Fraud Complaint against Chief Clerk of the Supreme Court SARAH LIFSCHITZ, which was filed with the Israel Police, addressed to Minister of Justice Yaakov Neeman. [2] The complaint originated in a non-Apostille certification of various decisions of the Supreme Court. The courtesy copy was forwarded to the Justice Minister, given the seriousness of the matter. However, no action on behalf of the Minister of Justice was requested on this matter. Your response on this matter, indicating that the matter did not fall within the authority of the Minister of Justice, is not disputable. b) April 18, 2012 Request for correction of false, unsigned, undated Apostille certification procedures, published online by the Judicial Authority with no lawful authority. [3] The request for correction of the Apostille certification procedure surely falls within the authority of the Ministry of Justice, since: i. The procedure, published online, amounted to promulgation of Regulations of the Courts. The authority to promulgate such regulations is vested in the Minister of Justice. ii. The procedure, published online, invoked the authority of an unnamed Minister of Justice, with no reference to any legal foundation. iii. The April 2, 2012 Response [4] by the Ministry of Justice on the March 3, 2012 Freedom of Information Act request (T-6) [5] sought extension on the 1/1

time provided by law for such responses, but never claimed that the matter did not fall within the authority of the Ministry of Justice. Therefore, I would be grateful if you could provide direct responses on the matters pertaining to the Apostille certification procedure, published online by the Judicial Authority: i. The April 18, 2012 Request for correction of the procedure, and ii. The March 3, 2012 Freedom of Information Act request, (T-6), pertaining to the identity of the unnamed Minister of Justice, and the legal foundation of the procedure.
