What is a Patent? Explain the procedure for applying and granting patents. Why one should go for a Patent? Why does the Government encourage filing of Patent? What are the rights conferred on patent holder? Can a scientist get a patent on the invention, which he has already published in the form of a paper in a National / International Journal? Mention any three inventions which does not qualifies for the grant of a Patent? B Files an application for a patent for an invention which he made on his return from USA. While in USA he had read about the invention in a journal in a library there. The Controller accepts the application but on examination he finds that the invention had been described earlier in the journal published in USA. He accepts the application stating that since the invention has not been published in India, there is no prior publication of the invention in India. Is the Controller right or wrong?
