Spain borrowing costs soar as EU ponders bank aid

By Paul Day and Jan Strupczewski MADRID/LUXEMBOURG| Thu Jun 21, 2012 9:31am EDT (Reuters) - Spain's medium-term borrowing costs spiraled to a euro -era record at an auction on Thursday, hours before an independent audit was due to reveal how big a capital hole in Spanish banks needs to be filled by a euro zone bailout. Euro zone finance ministers will discuss later in the day how to channel up to 100 billion euros ($126 billion) in rescue loans to Spanish lenders weighed down by bad loans from a burst property bubble. Many in the markets see the package as a mere prelude to a full program for the Spanish state. Spain's financial weakness is in focus a week before a European Union summit tackles long-term plans for closer fiscal and banking union in an effort to strengthen the euro's foundations, after bailouts for Greece, Ireland and Portugal failed to end a 2-1/2-year old debt crisis. To pave the way for that, the leaders of Germany, Italy, France and Spain will meet in Rome on Friday. Madrid sold 2.2 billion euros in medium-term bonds and attracted

strong demand. But yields on 5year paper rose to a 15-year high of 6.07 percent, a level regarded by analysts as unaffordable for any prolonged period. The runaway Spanish yields contrasted with a French auction in which the yield on 5-year benchmark paper hit an all-time low of 1.43 percent. "The first worry is can they (Spain) fund from the markets? They raised 2.2 billion versus a 2 billion target, so they can raise the money," said Achilleas Georgolopoulos, a strategist at Lloyds in London. "Then the (question is), are the yields threatening for the medium term? And yes, clearly they are much higher than the previous auction ... But still they can continue for a few months to fund at these levels." Two independent auditors are due to deliver a report to the Spanish government later on Thursday on the recapitalization needs of the banking sector following last month's sudden nationalization of Bankia, the fourth biggest lender. Economy Minister Luis de Guindos will present the findings to euro zone colleagues meeting in Luxembourg from 1200 EDT. Banking sources believe the report will say the lenders need to raise a further 60-70 billion euros.

However, a formal request for assistance may only come on Friday when Prime Minister Mariano Rajoy meets German Chancellor Angela Merkel, French President Francois Hollande and Italian Prime Minister Mario Monti. "NO DEBT MUTUALISATION" The finance ministers will discuss which of the euro zone's rescue funds - the temporary European Financial Stability Fund or the permanent European Stability Mechanism - will lend Spain the money. This matters to investors because ESM loans would be senior to other Spanish borrowing, meaning private bondholders would face first losses in any debt writedown. The ministers are also expected to ponder the next steps with Greece, following the formation of a coalition of mainstream parties committed to the country's 130 billion euro EU/IMF bailout but determined to renegotiate some of the terms. Athens will ask lenders for two more years to hit fiscal targets and an extension to unemployment benefits as it seeks to soften the punishing terms of the bailout saving the country from bankruptcy, a party official said. Greek officials have said this would entail an extra 16-20 billion euros in foreign funding. It

sets up a showdown with Greece's euro zone partners, in particular paymaster Germany, which have offered modifications but no radical re-write of the conditions attached to the lifeline agreed in March. "We can always discuss conditions of the loan. But let us not forget one thing: This is not one-way development aid," Luxembourg Finance Minister Luc Frieden told Reuters Insider television. RESCUE FUND TO THE RESCUE? The German government and opposition reached a deal on growth that will allow parliament to approve the euro zone's permanent bailout scheme next week, but Germany's top court may delay the rescue fund's start date scheduled for July 1, saying it needed time to study the treaty. The ESM cannot go into effect without approval by Europe's biggest economy. Ratification also requires the signature of the president and a nod from the constitutional court in Karlsruhe. The euro zone ministers may also consider a suggestion by Monti, made on the sidelines of this week's G20 summit, to use the euro zone's rescue funds to buy the bonds of Spain and Italy in the secondary market to bring down their borrowing costs.

Merkel has played down the idea, which investors said might be counter-productive unless the ECB stepped in decisively in support. Any cash injection would come with strings attached, equivalent to the sort of bailout programs that Italy and Spain are trying to avoid because of the stigma attached. "Right now we have no requests to buy via the EFSF/ESM, Spanish or Italian bonds," Frieden said. But he added: "We have funds available if necessary to help those countries in need ... We will do whatever is necessary to make sure that this zone, which is in trouble, will remain in the medium and long term a stable monetary union." Given the limited capacity of the temporary EFSF and planned permanent ESM rescue funds, with at most 500 billion euros available, a senior EU source said such intervention would make sense only if the ESM had a banking license enabling it to borrow from the ECB. Johnson WASHINGTON| Thu Jun 21, 2012 9:15am EDT (Reuters) - Manufacturing grew in June at its slowest pace in 11 months and hiring in the sector slowed as overseas demand for U.S. products waned, an industry survey showed on Thursday. The number of Americans filing new claims for unemployment benefits was also little changed last week, according to the U.S. Labor Department. Financial information firm Markit said its U.S. "flash" manufacturing Purchasing Managers Index fell to 52.9 from 54.0 in May. The June reading was the lowest since last July although it stayed above 50, indicating expansion in activity. For the second straight month, weaker demand from Europe and large emerging markets such as China dented sales. Markit said U.S. manufacturers reported the second largest decline in new export orders since September 2009. The index's new orders component fell to 54.1 from 54.6.

Manufacturing has been one of the strongest links in an otherwise frail U.S. economic recovery, but Markit said weaker overseas demand may be starting to slow hiring in the sector. The employment component fell in June to 53.1, reflecting the weakest rate of hiring in eight months. It stood at 54.3 at the end of May. "The impact of weak sales on employment is a key concern," said Markit chief economist Chris Williamson. "The close fit of the survey data with non-farm payroll number suggests that the official (employment) data for June will show a further weakening of the labor market." Job growth in the United States slowed sharply for a third consecutive month in May and the unemployment rate rose for the first time in nearly a year. The "flash," or preliminary reading, is based on replies from about 85 percent of the U.S. manufacturers surveyed. Markit's final reading will be released on the first business day of the following month. The Institute for Supply Management, which publishes a separate monthly manufacturing survey, releases its June index on July 2. ISM's May index showed slower growth in the sector despite a sharp rise in new orders.

JOBLESS CLAIMS SHOW US L A B O R M A R K E T S T R U G G L I N G In other data on Thursday, the number of Americans filing new claims for unemployment benefits was little changed last week, according to government data on Thursday that suggested the labor market was struggling to regain momentum. Initial claims for state unemployment benefits slipped 2,000 to a seasonally adjusted 387,000, the Labor Department said. The prior week's figure was revised up to 389,000 from the previously reported 386,000. Economists polled by Reuters had forecast claims falling to 380,000 last week. The four-week moving average for new claims, considered a better measure of labor market trends, increased 3,500 to 386,250 - the highest level since early December. The claims data covered the survey week for June's nonfarm payrolls and the report pointed to little or no improvement on the paltry 69,000 jobs added in May. Claims rose 15,000 between the May and June survey periods. "This confirms the weak labor market we have. I suspect we would see a modest rebound in payrolls in June but it would still be below 150,000. It's going to be another month of sub-par jobs

data," said Sam Bullard, a senior economist at Wells Fargo Securities in Charlotte, North Carolina. U.S. stock index futures were little changed on the data, while Treasury debt prices slightly trimmed earlier gains. The euro pared losses versus the dollar. Labor market weakness prompted the Federal Reserve on Wednesday to ease monetary policy further by extending a program to re-weight bonds it already holds toward longer maturities to hold down borrowing costs. The so-called Operation Twist, which was due to expire this month and will now run through the end of the year, was expanded by $267 billion. Fed Chairman Ben Bernanke said the U.S. central bank had considerable scope to take further action and that a lack of sustained progress in the labor market would require it. Much of the recent weakness in the labor market has been due to a decline in hiring, rather than increased layoffs. Data on Tuesday showed job openings dropped to a five-month low in April, spread across all sectors of the economy. There are no jobs for more than two out of every three unemployed Americans.

New applications for unemployment benefits have barely budged since April. A Labor Department official said there was nothing unusual in the state-level data and only claims for New Jersey had been estimated. The number of people still receiving benefits under regular state programs after an initial week of aid was unchanged at 3.30 million in the week ended June 9. The number of people on extended benefits fell 24,638 to 110,864 in the week ended June 2, the latest week for which data is available, as more states lost eligibility for extended benefits for the long-term unemployed. Only six states and the District of Columbia were offering extended benefits during that period. Economists expect that as more people fall off the unemployment benefit rolls, that will push down the jobless rate as they are forced to take up jobs they would not normally have considered or drop out of the labor force. Rep. Trey Gowdy, a feisty Republican lawmaker from South Carolina, challenged during Wednesday's committee meeting on Holder. "If (Obama's) part of it, then we've had a series of witnesses that have misled this

WPP CEO Martin Sorrell sat down with The Guardian at Cannes and reiterated his concerns over Facebook, while giving few details into the world's largest advertising firm's spending plans for 2012. "I believe Facebook is the best or one of the best branding mechanisms in the world but I don't think it is necessarily an advertising medium." said Sorrell. Sorrell once again said WPP plans to spend about $400 million on Facebook this year, double what it spent in 2011. But even WPP acknowledges doubling spending still doesn't it bring it to any major level for a company that spends $65 billion annually, or almost one third of all ad agency spending.

The Guardian quoted one WPP senior exec saying, "The $400m on Facebook might look big but it is pretty small change, entry level spending for WPP." Sorrell said WPP plans to spend $2 billion with Google this year, up from $1.6 billion this past year. WPP's spending accounts for roughly 5% of the revenue for both companies.

Trey Gowdy, R-S.C., shouted while rattling off his complaints against the Justice Department. On the other side, Rep. Elijah Cummings, D-Md., ranking Democrat on the committee, offered an impassioned defense of the attorney general even as he and other Democrats acknowledged Fast and Furious was severely flawed. "I don't think he's hiding a damn thing," Cummings said of Holder shortly before the contempt vote. Democrats roundly voiced disappointment with the proceedings, describing them as politically motivated and avoidable. They pleaded with Issa to seriously consider Obama's executive privilege claim -- the first Obama has asserted -- while some said Holder was being punished for withholding internal documents he shouldn't be turning over anyway. Republicans praised Issa for pressing ahead, describing the vote as entirely unavoidable considering the department's alleged refusal to cooperate. They frequently invoked the name of Border Patrol agent Brian Terry -Fast and Furious-linked guns were found at the scene of Terry's murder in 2010. And Issa indicated he was waiting for a

more detailed explanation from the White House, and a letter from Obama himself, before even considering changing course based on the executive privilege claim. Issa also accused the Justice Department of trying to compel the committee to close its investigation in exchange for documents it hasn't yet seen. "I can't accept that deal. No other committee chairman would," he said. But Cummings fired back that Holder never made such a demand -- a Justice official also refuted Issa's claim -- and said the attorney general had come to the committee in "good faith" to try and work out an agreement. Cummings said the contempt vote has "diminished" the prestige of the panel. "For the past year, you've been holding the attorney general to an impossible standard," he said, addressing Issa. "Mr. Chairman, it did not have to be this way. It really didn't." Rep. Carolyn Maloney, D-N.Y., added that she was "horrified" by the panel's looming vote, calling it a "political witch hunt" and accusing Republicans of "overruling" the president. The House Oversight and Government Reform Committee was first informed of the president's decision to assert executive privilege over the disputed Fast and Furious documents in a letter Wednesday morning, shortly before the contempt vote was scheduled.

Issa said the committee's staff was evaluating the letter but described the move as too little, too late, as he and other GOP lawmakers questioned the basis for the assertion. "This untimely assertion by the Justice Department falls short of any reason to delay today's proceedings," Issa said. The committee, while voting down several Democratic amendments to the resolution, later approved a GOP amendment designating Obama's executive privilege claim as inappropriate. The move by Holder and Obama to lock down some requested documents only complicates the fight between the legislative and executive branches over the botched anti-gunrunning operation. After Holder made the request to Obama via letter on Tuesday, Deputy Attorney General James Cole wrote to Issa on Wednesday informing him that the president had granted the request. "We regret that we have arrived at this point, after the many steps we have taken to address the committee's concerns and to accommodate the committee's legitimate oversight interests regarding Operation Fast and Furious," Cole wrote. "Although we are deeply disappointed that the committee appears intent on proceeding with a contempt vote, the department remains willing to work with the committee to reach a mutually satisfactory resolution of the outstanding issues." Obama's decision pertains to

documents from February 2011 and afterward examining how Justice officials learned about the Fast and Furious probe. Holder, in his letter to Obama requesting he assert executive privilege, said those documents pertain to the "deliberative process" on how to respond to congressional and media inquiries. In a statement released late Wednesday, Holder accused Issa of rejecting all efforts to "reach a reasonable accommodation." "Instead, he has chosen to use his authority to take an extraordinary, unprecedented and entirely unnecessary action, intended to provoke an avoidable conflict between Congress and the Executive Branch," Holder said. "This divisive action does not help us fix the problems that led to this operation or previous ones and it does nothing to make any of our law enforcement agents safer. It's an election-year tactic intended to distract attention -- and, as a result -- has deflected critical resources from fulfilling what remains my top priority at the Department of Justice: Protecting the American people." Holder said claims that his department was unresponsive are "untrue." White House Communications Director Dan Pfeiffer also called the vote "a politically motivated, taxpayer-funded election-year fishing expedition." But Issa countered with a statement asserting the vote was

"not the outcome I had hoped for." He said it "would not have occurred had Attorney General Eric Holder actually produced the subpoenaed documents he said he could provide." Wednesday's developments follow a flurry of activity Tuesday, as Holder tried to negotiate a way to avert the contempt proceedings. Issa had earlier indicated a willingness to postpone the vote after Holder indicated a willingness to make compromises and supply some documents in response to House Republicans' subpoena. But Issa told reporters after a roughly 20-minute meeting with Holder on Tuesday that the attorney general instead briefed them on the documents in lieu of delivering them. Issa told Fox News that Holder didn't provide "anything in writing." Issa further said during the committee meeting Wednesday that the purpose of the probe "has never been to hold the attorney general in contempt." He said the committee had an aide on Capitol Hill all night in the hope that the Justice Department might send over documents to the panel. The failed Fast and Furious operation attempted selling thousands of guns to arms dealers along the U.S.-Mexico border to trace them to leaders of drug cartels. By Paul Day and Jan Strupczewski MADRID/LUXEMBOURG| Thu Jun 21, 2012 9:31am EDT (Reuters) - Spain's medium-term borrowing costs spiraled to a euro -era record at an auction on Thursday, hours before an independent audit was due to reveal how big a capital hole in Spanish banks needs to be filled by a euro zone bailout. Euro zone finance ministers will discuss later in the day how to channel up to 100 billion euros ($126 billion) in rescue loans to Spanish lenders weighed down by bad loans from a burst property bubble. Many in the markets see the package as a mere prelude to a full program for the Spanish state. Spain's financial weakness is in focus a week before a European Union summit tackles long-term plans for closer fiscal and banking union in an effort to strengthen the euro's foundations, after bailouts for Greece, Ireland and Portugal failed to end a 2-1/2-year old debt crisis. To pave the way for that, the leaders of Germany, Italy, France and Spain will meet in Rome on Friday. Madrid sold 2.2 billion euros in medium-term bonds and attracted

strong demand. But yields on 5year paper rose to a 15-year high of 6.07 percent, a level regarded by analysts as unaffordable for any prolonged period. The runaway Spanish yields contrasted with a French auction in which the yield on 5-year benchmark paper hit an all-time low of 1.43 percent. "The first worry is can they (Spain) fund from the markets? They raised 2.2 billion versus a 2 billion target, so they can raise the money," said Achilleas Georgolopoulos, a strategist at Lloyds in London. "Then the (question is), are the yields threatening for the medium term? And yes, clearly they are much higher than the previous auction ... But still they can continue for a few months to fund at these levels." Two independent auditors are due to deliver a report to the Spanish government later on Thursday on the recapitalization needs of the banking sector following last month's sudden nationalization of Bankia, the fourth biggest lender. Economy Minister Luis de Guindos will present the findings to euro zone colleagues meeting in Luxembourg from 1200 EDT. Banking sources believe the report will say the lenders need to raise a further 60-70 billion euros.

However, a formal request for assistance may only come on Friday when Prime Minister Mariano Rajoy meets German Chancellor Angela Merkel, French President Francois Hollande and Italian Prime Minister Mario Monti. "NO DEBT MUTUALISATION" The finance ministers will discuss which of the euro zone's rescue funds - the temporary European Financial Stability Fund or the permanent European Stability Mechanism - will lend Spain the money. This matters to investors because ESM loans would be senior to other Spanish borrowing, meaning private bondholders would face first losses in any debt writedown. The ministers are also expected to ponder the next steps with Greece, following the formation of a coalition of mainstream parties committed to the country's 130 billion euro EU/IMF bailout but determined to renegotiate some of the terms. Athens will ask lenders for two more years to hit fiscal targets and an extension to unemployment benefits as it seeks to soften the punishing terms of the bailout saving the country from bankruptcy, a party official said. Greek officials have said this would entail an extra 16-20 billion euros in foreign funding. It

sets up a showdown with Greece's euro zone partners, in particular paymaster Germany, which have offered modifications but no radical re-write of the conditions attached to the lifeline agreed in March. "We can always discuss conditions of the loan. But let us not forget one thing: This is not one-way development aid," Luxembourg Finance Minister Luc Frieden told Reuters Insider television. RESCUE FUND TO THE RESCUE? The German government and opposition reached a deal on growth that will allow parliament to approve the euro zone's permanent bailout scheme next week, but Germany's top court may delay the rescue fund's start date scheduled for July 1, saying it needed time to study the treaty. The ESM cannot go into effect without approval by Europe's biggest economy. Ratification also requires the signature of the president and a nod from the constitutional court in Karlsruhe. The euro zone ministers may also consider a suggestion by Monti, made on the sidelines of this week's G20 summit, to use the euro zone's rescue funds to buy the bonds of Spain and Italy in the secondary market to bring down their borrowing costs.

Merkel has played down the idea, which investors said might be counter-productive unless the ECB stepped in decisively in support. Any cash injection would come with strings attached, equivalent to the sort of bailout programs that Italy and Spain are trying to avoid because of the stigma attached. "Right now we have no requests to buy via the EFSF/ESM, Spanish or Italian bonds," Frieden said. But he added: "We have funds available if necessary to help those countries in need ... We will do whatever is necessary to make sure that this zone, which is in trouble, will remain in the medium and long term a stable monetary union." Given the limited capacity of the temporary EFSF and planned permanent ESM rescue funds, with at most 500 billion euros available, a senior EU source said such intervention would make sense only if the ESM had a banking license enabling it to borrow from the ECB. On a tape edited and played on the Today show, Zimmerman was heard calling Martin suspicious and volunteering that he was black. But the full, unedited tape showed that Zimmerman only mentioned Martins race when asked by the dispatcher. The result made it sound like Zimmerman was racially profiling Martin. Manufacturing growth slows, labor market struggling

Johnson WASHINGTON| Thu Jun 21, 2012 9:15am EDT (Reuters) - Manufacturing grew in June at its slowest pace in 11 months and hiring in the sector slowed as overseas demand for U.S. products waned, an industry survey showed on Thursday. The number of Americans filing new claims for unemployment benefits was also little changed last week, according to the U.S. Labor Department. Financial information firm Markit said its U.S. "flash" manufacturing Purchasing Managers Index fell to 52.9 from 54.0 in May. The June reading was the lowest since last July although it stayed above 50, indicating expansion in activity. For the second straight month, weaker demand from Europe and large emerging markets such as China dented sales. Markit said U.S. manufacturers reported the second largest decline in new export orders since September 2009. The index's new orders component fell to 54.1 from 54.6.

Manufacturing has been one of the strongest links in an otherwise frail U.S. economic recovery, but Markit said weaker overseas demand may be starting to slow hiring in the sector. The employment component fell in June to 53.1, reflecting the weakest rate of hiring in eight months. It stood at 54.3 at the end of May. "The impact of weak sales on employment is a key concern," said Markit chief economist Chris Williamson. "The close fit of the survey data with non-farm payroll number suggests that the official (employment) data for June will show a further weakening of the labor market." Job growth in the United States slowed sharply for a third consecutive month in May and the unemployment rate rose for the first time in nearly a year. The "flash," or preliminary reading, is based on replies from about 85 percent of the U.S. manufacturers surveyed. Markit's final reading will be released on the first business day of the following month. The Institute for Supply Management, which publishes a separate monthly manufacturing survey, releases its June index on July 2. ISM's May index showed slower growth in the sector despite a sharp rise in new orders.

JOBLESS CLAIMS SHOW US L A B O R M A R K E T S T R U G G L I N G In other data on Thursday, the number of Americans filing new claims for unemployment benefits was little changed last week, according to government data on Thursday that suggested the labor market was struggling to regain momentum. Initial claims for state unemployment benefits slipped 2,000 to a seasonally adjusted 387,000, the Labor Department said. The prior week's figure was revised up to 389,000 from the previously reported 386,000. Economists polled by Reuters had forecast claims falling to 380,000 last week. The four-week moving average for new claims, considered a better measure of labor market trends, increased 3,500 to 386,250 - the highest level since early December. The claims data covered the survey week for June's nonfarm payrolls and the report pointed to little or no improvement on the paltry 69,000 jobs added in May. Claims rose 15,000 between the May and June survey periods. "This confirms the weak labor market we have. I suspect we would see a modest rebound in payrolls in June but it would still be below 150,000. It's going to be another month of sub-par jobs

data," said Sam Bullard, a senior economist at Wells Fargo Securities in Charlotte, North Carolina. U.S. stock index futures were little changed on the data, while Treasury debt prices slightly trimmed earlier gains. The euro pared losses versus the dollar. Labor market weakness prompted the Federal Reserve on Wednesday to ease monetary policy further by extending a program to re-weight bonds it already holds toward longer maturities to hold down borrowing costs. The so-called Operation Twist, which was due to expire this month and will now run through the end of the year, was expanded by $267 billion. Fed Chairman Ben Bernanke said the U.S. central bank had considerable scope to take further action and that a lack of sustained progress in the labor market would require it. Much of the recent weakness in the labor market has been due to a decline in hiring, rather than increased layoffs. Data on Tuesday showed job openings dropped to a five-month low in April, spread across all sectors of the economy. There are no jobs for more than two out of every three unemployed Americans.

New applications for unemployment benefits have barely budged since April. A Labor Department official said there was nothing unusual in the state-level data and only claims for New Jersey had been estimated. The number of people still receiving benefits under regular state programs after an initial week of aid was unchanged at 3.30 million in the week ended June 9. The number of people on extended benefits fell 24,638 to 110,864 in the week ended June 2, the latest week for which data is available, as more states lost eligibility for extended benefits for the long-term unemployed. Only six states and the District of Columbia were offering extended benefits during that period. Economists expect that as more people fall off the unemployment benefit rolls, that will push down the jobless rate as they are forced to take up jobs they would not normally have considered or drop out of the labor force. A total of 5.83 million people were claiming unemployment benefits during the week ending June 2 under all programs, down 1,164 from the previous week. Just before vacationers and locals had enough time to lay out their beach towels and apply sun block, researchers near Cape Cod, Mass., warned swimmers to be on the lookout for great white sharks. There have been no great white sightings, but earlier this month scientists received radio signals from two sharks looming off the coast of Chatham, Mass. These sharks, along with six others, were tagged by researchers last summer to help study their migratory habits. To add to scientists earlier suspicions, an injured seal with large gashes on its torso was spotted floating in nearby waters. Great whites are famous for their

appetite for seals and theres nothing short of a seal buffet at the tip of the Monomoy National Wildlife Refuge, which is east of Chatham. The Chatham harbormaster told MyFoxBoston.com that he has been monitoring the situation, but says theres no immediate danger for swimmers. Stuart Smith, the harbormaster, said nearby Nantucket Sound beaches never had a shark detected. He said the focus is mainly on the beaches that sit along the ocean. In past years, beaches in the vicinity have been closed due to shark sightings. Last year alone, there were 35 great white shark sightings off Cape Cod. So researchers have decided to begin studying their habits. For example, these signals were picked up by strategically placed acoustic receivers last week, Cape CodOnline.com reported. These receivers were designed to enable researchers to determine when sharks enter or leave the waters. "The more tags we put out, hopefully the more we will be able to start seeing patterns and preferences in what these sharks

Apple is again trying to keep the U.S. Patent and Trademark Office busy with several new patents just revealed today. One patent dubbed"Securing the Implementation of a Cryptographic Process using Key Expansion" covers a method of improving the security behind encryption keys, as documented

by PatentlyApple. Another patent, known as"SpatioTemporal Color Luminance Dithering Techniques" addresses a way for dithering an image, or scattering their pixels, by tweaking the overall luminance. And a third patent called"Systems and Methods for Streaming Compressed Files via a Non-Volatile Memory" points to a way for non-volatile memory to decompress and directly stream

media files. Though perhaps not too sexy on the surface, these patents expose some of the many details that drive Apple's products. Apple and Google are rushing to bring 3D aerial views to their respective mapping solutions. While many view this as a good thing, some people like Senator Charles Schumer of New York are concerned about privacy and security issues that arise when people are photographed from the sky without their consent. As reported by MacObserver, Schumer sent an open letter to both Google and Apple asking them to notify residents before a planned flyover by their jets. Blizzard has run into trouble in South Korea in the past with certain game content coming under scrutiny, but now it looks like Sony is the latest to tangle with the law. The company has had to take down the PlayStation Store in South Korea due to the

new Game Industry Promotion Act. Starting from July 1st, it will be illegal for online services to ask those under the age of 18 to verify their account with a real name or date of birth. As a result, Sony has removed access to the PlayStation Store in South Korea so that it can comply with the new law. Gamers need not worry about this affecting the

PlayStation Network, with full multiplayer capabilities still in

place, but additional content will be unable to be purchased or downloaded until Sony rectifies the situation. It looks like the move only affect PlayStation 3 users, however, as the PS Vita and PSP stores will remain open. OWC posted up a photo that is every Mac user's dream. The photo shows a MacBook Pro with Retina Display powering not one, not two, but three external displays in addition to the notebook's own monitor. OWC lists the attached computers which includes the Retina display on the MBP set at its "best for Retina" setting; two 2560 x 1440 iMacs connected via the Thunderbolt

and the Thunderbolt/DisplayPort; and a 1920 x 1200 LG monitor connected via HDMI. OWC says the performance was smooth and claims "moving

images and media didn't create any lag." They also say they "were able to play video on all four displays simultaneously." As noted by MacRumors, Apple's

Headline: The FHFA house price index climbed 0.8 percent monthover-month in April. Last month's number was revised down to a 1.6 percent gain. The U.S. index is 17.6 percent below its April 2007 peak. The monthly HPI Index is now at the same level it was in May 2004.

One word to explain the Philly Fed which just printed at -16.6, or the weakest since August 2011, on expectations of an unchanged print: abysmal. Basically every subcomponent of the index was negative except for number of employees, although luckily we already know that US jobs (even part-time ones) are collapsing too. In short: if this horrendous print does not boost stocks higher, nothing can. Oh and the market continues to be bathed in hopium. While the current conditions cratered, the 6 month forward looking index... rose. From the Survey: Indicators Suggest Decreases in Activity The surveys broadest measure of manufacturing conditions, the diffusion index of current activity, fell from a reading of ?5.8 in May

to ?16.6, its second consecutive negative reading (see Chart 1). Nearly 40 percent of the firms reported declines in activity this month, exceeding the 22 percent that reported increases in activity. Indexes for new orders and shipments also showed notable declines, falling 18 and 20 points, respectively. Indexes for current unfilled orders and delivery times

Overnight, the WSJ had an interesting article starting with "Italy, France and Spain are trying to take a united stand against Germany in finding new ways to fight the euro-zone debt crisis." This merely confirms what Greece has been trying to tell us for months: that beggars can be choosers. Well, turns out they can't, because at the end of the day, the only thing that does matter is the Golden Rule as Mark Grant reminded us earlier. Which is why trying to force Germany to do anything will backfire massively - as a reminder: it is in Germany interest to keep Europe weak, the EURUSD low, and the periphery on the edge of insolvency(just memorize the bolded sentence - it is all you need to know about Europe). Case in point: " Germany's

constitutional court said on Thursday it will need time to study the euro zone's permanent bailout mechanism after its expected approval in the German parliament next Friday, which could delay its scheduled start date on July 1." In other words, the bailout fund on which Europe's entire rescue dreams lie (and which will gladly subordinate European creditors) and which still does not exist, is now being delayed. The year was 1999, and Steven Spielberg was preparing to turn Philip K. Dicks short story The Minority Report into a $100 million action movie starring Tom Cruise. He wanted the world of the movie to be different from our own, but he also wanted to avoid the exaggerated and often dystopian speculation that plagued most science fiction. Coupland: There was a bit of everyone trying to please the teacher, offering more up-to-date information, but it was very goodnatured and highly competitive. Peter Calthorpe (architect, urban planner): I had a big interest in going there and saying to Spielberg, Dont make everything look like a science fiction novel. Garreau: They had DC and the Mall with all these high-rises around it. And Im like, You dont understand. Washington is

not California with more neckties, and its sure as shit not New York. McDowell: People from DC were saying that you cant build anything higher than the Capitol building, and youll never be allowed to, even in 50 years time. So we moved all of our architecture across the Potomac River and developed a vertical city, although there was a lot of resistance to that from the group. Garreau: I know you urbanists love to think differently, but dream on. They needed the highrises for the chase scenes. Schwartz: Steven wanted to make it very realistic, but there were a couple of things he really wanted that were not realistic. The most obvious was the jet packs. But the director gets what he wants! McDowell: There was a guy from Darpa who was ultimately the most useful because we were dealing with weaponry and police tactics. He was the kind of guy who would say, If I told you that, Id have to kill you. Jones: At the time I was working for the US governments science fiction agency, running several programs. I think I was useful because my job wasnt only to envision the future. "The devil is standing over to the side because we have taken our focus over what Christ tells us our clear mission is and that is the Great Commission and he is going to be laughing, and he's going to be mocking and he's going to be rejoicing that we're no longer interested in rescuing

Special Ops Commander Sacked After Tiltrotor Crash

Photo: Air Force The head of the Air Forces Osprey tiltrotor squadron has reportedly been fired following the near-fatal crash of one of the units aircraft on June 13. The commander of the 8th Special Operations Squadron was relieved because of a loss of confidence in his ability to effectively command the unit, Col. James Slife, 1st Special Operations Wing chief, told Inside Defense(subscription required). Slife did not give the squadron commanders name, but an Air Force press release identifies him as Lt. Col. Matt Glover of Austin, Texas. Glover assumed command of the flying branchs first Osprey squadron in May last year. His goal, he said at the time, was to grow and improve the CV-22 force, using the designation for the Air Force version of the tiltrotor. The challenges of the 8th Special Operations Squadrons demanding mission require new leadership to maintain the highest levels of precision, Slife told Inside Defense. The implication is that the Air Force is attributing the crash to squadron procedures or the readiness level of its

aircrews. The 1st Special Operations Wings public affairs office did not answer a phone call on Thursday morning. An email to the office also went unanswered. If confirmed, Glovers sacking would make him at least the second tiltrotor commander relieved of duty since the controversial hybrid aircraft, made by Bell and Boeing, entered testing in the 1990s. In 2001 the

Marine Corps commandant fired Lt. Col. Odin Lieberman, head of the Corps Osprey training squadron, after Lieberman was accused of falsifying maintenance records in order to mask the tiltrotors design flaws. An early version of the V-22, which takes off and lands like a helicopter but cruises like an airplane, crashed four times during testing between 1991 and 2000, killing 30 people. Since

entering frontline service in 2009, three of the Air Forces roughly 20 V-22s have been destroyed or badly damaged in accidents at the cost of four lives. Likewise, in the last 10 years the Marines fleet of some 200 Ospreys has suffered around a dozen major accidents resulting in several destroyed aircraft and no fewer than three deaths. The Marines, who tout the Osprey as their safest tactical

rotorcraft, have used semantic games and fudged statistics to obscure the V-22s true safety record. The V-22s rotating engine nacelles are notoriously complex, its engines hot and over-powered and its aerodynamic qualities unforgiving compared to a traditional aircraft. According to Russian news wire RIA Novosti, the Chechen president created a Twitter account Wednesday after meeting with Dmitry Medvedev, Russias prime minister and former president. ( Medvedev is an advocate of social media.) Kadyrov only sent two tweets the first day under the handle@RKadyrov. The first announced that Kadyrov was preparing to meet with young people, with no word on the results. Several hours later, Kadyrov announced he was taking questions. Kadyrov also apparently had a problem with Twitter impostors. A statement from the Chechen government said the account is official, and has nothing to do with other accounts in social networks attributed to the head of

the Chechen Republic. It could also be an attempt to rebrand an image tainted by allegations of widespread human rights abuses, including using death squads to carry out abductions, torture and the killing of dissidents. Chechnya is also particularly mean to women, and Kadyrovs public persona is less than desirable. Hes known for his taste (or lack of) in fast cars and gold pistols. His 35th birthday party was held on a floating stage on the River Sunzha,

Last Friday, Kadyrov was the target of a suspected assassination plot that ended when two militants carrying firearms and explosives were reportedly killed by Chechen police while entering Grozny from a nearby forest. The militants were said to be carrying o u t o r d e r s from separatist leader Doku Umarov. Though there are questions the two militants may have just been on a routine mission. Maybe someone should ask Kadyrov about that. Kadyrov is already up to around 6,000 followers, but it looks like only a few people have fielded him questions. During the stunt, Wallenda who is the first person to walk across Niagara Falls on high wire frequently mentioned God and Jesus, such as one line where he stated "Praise You, Father God! Praise You Jesus!" However, in an ABC News live blog written up by Ali Gazan, no mentions or acknowledgements were made of these remarks. Gazan's live blog posted updates starting at 9:00 PM Eastern Time, with a countdown until the tightrope walk was to begin, and concluded around 11:00 PM. During the posts, Gazan wrote updates on what was taking place as well as quotes from Wallenda and others. One update did mention the Wallenda family praying together for the safety of Nik. The comments section for the live blog included expression of disappointment that Wallenda's

religious remarks made during and after his historic stunt were omitted. "How come this blog leaves out the part about him praising Jesus? All the details are complete, except this is noticeably left out. Are you that uncomfortable typing the name of Christ?" wrote a commenter identified as "Country Girl." Morning Bell: President Obamas Fast and Furious Scandal Grows

On the night of December 15, 2010, U.S. Border Patrol Agent Brian Terry was shot and killed by an untraceable assault weapon that was deliberately handed to Mexican drug lords by U.S. officials via Operation Fast and Furious. Ever since, the Terry family and Americans across the nation have asked how this could have happened. And ever since, Attorney General Eric Holder has stonewalled Congress in its attempts to find these answers. Yesterday, President Obama joined this stonewalling effort, asserting executive privilege over many of the documents about the operation that Congress had subpoenaed but still had not received. Executive privilege is legitimate when properly invoked. But even then, the Supreme Court has maintained that it is not absolute. The Department of Justice (DOJ) must provide a compelling rationale for each assertion. Shielding wrongdoing has never been a qualifying rationale. Heritage legal expert and former Department of Justice counsel Todd Gaziano explains: First, the Supreme Court in United States v. Nixon(1974) held

that executive privilege cannot be invoked at all if the purpose is to shield wrongdoing. The courts held that [President] Nixons purported invocation of executive privilege was illegitimate, in part, for that reason. There is reason to suspect that this might be the case in the Fast and Furious cover-up and stonewalling effort. Congress needs to get to the bottom of that question to prevent an illegal invocation of executive privilege and further abuses of power. That will require an index of the withheld documents and an explanation of why each of them is covered by executive privilegeand more. It is now up to Congress to ascertain the specific reasoning for executive privilege with every withheld document. Even in the unlikely case it is determined that this was a proper invocation of executive privilege, the administration is still not off the hook to inform Congress of what they know. Gaziano explains further: [T]he President is required when invoking executive privilege to try to accommodate the other branches legitimate information needs in some other way. For example, it does not harm executive power for the President to selectively waive executive privilege in most instances, even

if it hurts him politically by exposing a terrible policy failure or wrongdoing among his staff. T h e h i s t o r y o f executivecongressional relations is filled with accommodations and waivers of privilege. In contrast to voluntary waivers of privilege, Watergate demonstrates that wrongful invocations of privilege can seriously damage the office of the presidency when Congress and the courts impose new constraints on the Presidents discretion or power (some rightful and some not). President Obama now owns the Fast and Furious scandal. It is entirely up to him whether he wants to live up to the transparency promises he made four years ago, or further develop a shroud of secrecy that would make President Richard Nixon blush. If the stonewalling continues, and the privilege is not waived, it will be up to the American people and the media to demand the reasoning for the cover-up. It is also time for the media to begin responsibly covering this scandal. For more than 16 months, only a handful of reporters have appropriately researched the facts and sought answers. Most members of the national media would not even acknowledge the existence of the

scandal. Reportedly, NBC Nightly News ran its first story on the scandal just this past Tuesday. The national media must now follow the lead of their colleagues CBS reporter Sharyl Attkisson or Townhalls Katie Pavlich and investigate the specific facts and details of the operation and administration involvement. Attkisson, as you may remember, was screamed and cussed at by White House spokesman Eric Schultz in October for asking questions about Operation Fast and Furious. Answers must be demanded. When was the first time President Obama was briefed on this operation? Given his previous conflicting testimony, when in fact did Attorney General Eric Holder become involved? What exactly did he know and when did he know it? Despite the fact that Mexico was left in the dark by the Obama administration, this was still an international operation. If Secretary of State Hillary Clinton must approve the Keystone pipeline, wouldnt she also be consulted on this cross-border operation? Liberals will try and pretend this operation that began in mid-2009 is connected to former President George W. Bushs administration. The media should challenge this

false assertion. Operation Wide Receiver in 2006 did not remotely resemble Fast and Furious, as National Reviews Andrew McCarthy has ably examined. Mexico helped coordinate it, and there was traceable controlled delivery. Even Holder admitted in testimony that you cannot equate the two. We will also hear that this is election-year politics. The problem with that refrain is that this investigation has been ongoing since early 2011, well before campaign season started. It has been Attorney General Holders evasiveness that has dragged this process closer to Election Day. If it were not for conservative media outlets, bloggers, a few dogged reporters and the steadfastness of House Government Reform Chairman Darrell Issa (R-CA), this troubling scandal would have been buried long ago. A brave American border agent is dead. At least 200 Mexicans have been slaughtered with these weapons. Drug violence on the border remains unabated. Now, President Obama is attempting to conceal the facts of what happened. This is an opportunity for Congress and the media to MORNING page 59

Andrew Sullivan complained yesterday that I had engaged in a McCarthyite attack on Ron Paul by writing the following: A politician isnt answerable for the antics of every one of his supporters. But theres surely a reason, isnt there, that racists, anti-Semites, 9/11 Truthers, and Holocaust deniers are so strongly attracted to the Paul campaign. They hear something. They continue to hear it too, no matter how firmly Ron Pauls more mainstream supporters clamp their hands over their own ears. Andrews riposte: Notice how pure the smear is, enabled and not diminished by the first sentence. Notice the key concept of Beltway ideological policemen: there is a mainstream and a non-mainstream. Dabble with the latter at your peril. Since David has perished by the cult of the mainstream, its odd he should deploy it against others. But to throw in Holocaust denial and 9/11 Truthers for good measure! Really. And notice how particularly cheap and easy it is to use such tactics against a libertarian. The traditional left is often based on collective associations, building a movement out of oppressed groups and their grievances, whether it be class or race or even

sexual orientation. Libertarianism is the opposite. Its about dis associating. When you listen to Paul saying he will not turn anyone away from supporting his platform regardless of their motives or beliefs, you are hearing a reflection of his libertarianism, not his bigotry. He will accept support from any quarter and compared with the corporate money flowing into the other candidates coffers, he is about as independent as a presidential candidate can be. Because he is a radical individualist, he doesnt even understand why he should somehow explain the belief of others, or justify their support. You should ask them, not him. This kind of gotcha-association game is particularly easy because libertarians favor liberty above all, and that will necessarily mean liberty for bigots as well as others. A principled belief in states rights will doubtless lead to more racist and homophobic policies in many states but also, of course, more enlightened and successful inclusive states like Oregon or New York or Massachusetts or California. A rejection of statism might lead to more discrimination in the private sector. But it doesnt mandate it. And it need not encourage it. A noninterventionist foreign policy will allow evil to triumph elsewhere in

the world, because it believes its none of our business or too riddled with unintended consequences to try extirpating. That may be right or wrong, but it is not an approval of the evil of Assad or Ahmedinejad or the North Korean junta. And again, it is actually much deeper an American tradition than permanent warfare. But if you can trot out David Duke or Ayatollah Khamenei as potential Paul supporters, you have a very easy, cheap and essentially McCarthyite target. It saddens me that this kind of tactic works. I still believe that the newsletters, because they were in Pauls name, require a clearer explanation from Paul than the muddled ones he has given. He should not be left off the hook. And his proposals deserve a thorough vetting and discussion. But there is something awry when a candidate is assessed not on his arguments and proposals but on the shadiness and ugliness of some of his fringe supporters. Ron Pauls supporters ask that their candidate not be judged by his associates. Or by the people he chose to employ. Or by the newsletters he published. Or by the book he wrote. Or by the way he earned the largest part of his living when out of office in the 1990s. Or by his purchase of the mailing list of the Holocaust-

denying Liberty Lobby. Or by the radio shows he chooses to appear on. Or by his strategic decision to reach out to racist voters. Or by the conspiracy theories to which he lends credence, from government creation of AIDS to Israeli culpability for the 1993 bombing to a putative 9/11 coverup. And here I thought that libertarianism was a doctrine of personal responsibility? May Ron Paul at least be judged by the words he has spoken with his own mouth within the current campaign? The supporters say no again. When Ron Paul tells an interviewer that the Civil Rights Act of 1964 made race relations worse, were not supposed to consider what he might mean by better. When Ron Paul warns that a border fence would be used to prevent fleeing American citizens from exiting the country, were not supposed to conclude that hes a paranoid crank. Andrew deploys what might be called the ontological defense of Ron Paul, as follows: 1) Ron Paul is a libertarian. 2) Libertarians espouse individualism. 3) Racism is a form of antiindividualism. 4) Therefore Ron Paul cannot be a racist. That is a demonstration of what

might be called the deductive method of reasoning. But theres another way to study reality: induction. Like this: 1) Ron Paul has again and again exploited bigotry, paranoia, and hate as fundraising devices. 2) Ron Paul is a libertarian. 3) So yes, I guess it is possible for a libertarian to do that. Heres my question for Ron Paul supporters: why the denial of the undeniable? Perhaps you like Pauls message of legalized marijuana? Why not just say so? You dont think its important to stop Iran from gaining nuclear weapons? Argue it forthrightly. If you regard Social Security and Medicare as literally the moral equivalents of slavery, go ahead, make your case. But all this excuse-making, special pleading and jiggering of the rules of evidence so as to exculpate Ron Paul from the record of his whole political life? For what? How to Reform Food Stampsand Improve the Farm Bill

The farm bill is currently making its way through the Senate amidst heated debate. But dont let the title fool you. Nearly 80 percentof the bills spending goes toward the nations fastest growing welfare program: food stamps. Since 2000, the cost of food stamps (now known as the Supplemental Nutrition Assistance Program) has nearly quadrupled, with much of that growth taking place over the last four years. But as large as the program is, its only part of a federal welfare system consisting of roughly 70 programs costing taxpayers nearly $1 trillion annually. Earlier this month, Senators Rand Paul (RKY) and Jim Inhofe (ROK) introduced an amendment to the farm bill (subsequently voted down) to scale back the skyrocketing costs of food stampscosts that have outpaced the increase in participation rates. Senator Jeff Sessions (RAL) introduced

another amendment (also voted down) that would eliminate loopholes that allow states to boost their food stamp roles. Stemming the rising cost of the food stamps program and eliminating loopholes are both crucial steps in restoring fiscal sanity to the program. But such reforms must be coupled with those that promote personal responsibility through work. Food stamps is an old and fossilized program, say The Heritage Foundations Robert Rector and Katherine Bradley in a forthcoming paper. Aside from enormous increases in cost, food stamps has remained basically unchanged since its creation in the 1960s. It remains a program that discourages work, rewards idleness, and promotes long-term dependence. The best course of action to reduce spending, explain Rector and Bradley, would be to roll back food stamp spending to prerecession levels once the economy recovers, or by 2013. In subsequent years, the maximum allocation to states should grow no faster than inflation and population growth, although

temporary increases above that maximum could be permitted in periods of high unemployment, they add. Additionally, instead of recruiting participants, as current policies encourage, there should be an effort to return food stamp caseloads to normal, pre-recession levels or to the even lower levels that occurred during the Clinton presidency. When the program began in the 1960s, roughly one in 20 Americans participated. Today, that number is about one in seven. Part of the recent growth in program participation is due to policies that make it easier for individuals to enroll in the program and remain on the rolls. Application loopholes that permit food stamp recipients to bypass income and asset tests, note Rector and Bradley, contribute to this problem and should be eliminated. Perhaps most critical to reform is restructuring food stamps to a program that encourages selfreliance through work. Going forward, all able-bodied recipients should be required to work, prepare for work, or at least look

for a job as a condition of receiving aid. Additionally, reforms that require participants to receive a drug test prior to receiving aid are an important step in promoting greater personal responsibility among recipients. The welfare reforms of 1996, which inserted work requirements into the largest cash assistance welfare program, succeeded in helping individuals move from welfare to work. As a result, millions of Americans left welfare for jobs, and the child poverty rate dropped substantially. The food stamps program can similarly be transformed into one that helps individuals transition back to selfreliance. If you appreciate the ability to worship freely where you choose, to teach your children what you think is true, and to remain true to your convictions in your place of work, you have reason to celebrate the Fortnight of Freedom. Why make special effort to defend religious freedom now? Simply put, because recent policy actions of the Obama Administrationand in particular the Obamacare anti-conscience mandatehave undermined religious freedom in a striking and unprecedented way. The mandate upsets the kind of freedoms that Americans enjoy. It imposes a fine on faith by penalizing employers who choose to follow certain teachings of their church. Even though half of Americans report being pro-life, the mandate would punish employers who refuse to provide group health insurance covering abortion-inducing drugs. Policies like the mandate imperil religious identity; they encourage individuals and organizations to suppress who they are and what they stand for. By threatening

their core sense of identity and inspiration, such policies undermine the ability to serve God and others freely and effectively. After all, its often a groups religious faith that makes it so effective in serving people in need. Moreover, the mandate sets a bad precedent with the narrowest definition in federal law to date of what groups qualify for a religious exemption. To qualify, an organization must hire and serve only members of its own faith. This means that most churches are protected, but religious hospitals, schools, soup kitchens, and other ministries are not. Finally, the anti-conscience mandate attempts to remake civil societyincluding religious institutionsin the governments image by forcing them to adopt its values. By exercising this kind of role, the Administration places the federal government at the center of societys focus and expectations. It claims responsibility for more and more of Americans needs, and it asksand demandsmore and more from citizensincluding money, authority, and trust. In so doing, the HHS mandate, and Obamacare in general, directs to

pensions was agreed four years ago. All non-urgent work would be postponed, the BMA said, adding that although the action will be disruptive, doctors will ensure patient safety is protected. Doctors will see anyone who is ill, or who believes they are ill, but will not do paperwork. Accident and emergency departments and maternity services are running as normal, and tests for critical conditions such as cancer are still available. But some non-emergency hospital clinics, outpatient appointments and planned surgery may have been be postponed. GP practices remain open but some may have postponed routine appointments which can be rearranged for another day. According to Mr Lansley, the planned action could see up to 30,000 operations cancelled, 58,000 diagnostic tests postponed and 200,000 outpatient appointments rescheduled. I will explain why momentarily, but first this observation: if an opposing party requests documents that plainly are protected by a privilege, a lawyer will routinely assert the privilege, on principle, even though there is nothing hurtful to his case in those documents. On the other hand, a lawyer will not assert a lousy claim of privilege unless he badly wants to keep the documents in question out of the opponents hands because of their damaging nature. If I am correct that the administrations assertion of executive privilege is baseless, it is reasonable to infer that the documents, if made public, would be highly damaging to President Obama, Attorney General Holder, or other senior administration officials. [T]he case that is most directly pertinent to Holders assertion of executive privilege is In re Sealed Case (Espy), 121 F.3d 729 (D.C. Circuit 1997), which, along with Judicial Watch v. Department of Justice, 365 F.3d 1108 (D.C. Cir. 2008), cites and relies upon Espy, contains the most up to date judicial exposition of the doctrine of executive privilege. Unbelievably, Holders letter never cites or mentions the Espy case. If a first-year associate

wrote a memorandum for me in which he failed even to mention the most significant case, I would fire him. But Holders letter completely fails to acknowledge what a weak reed the deliberative process privilege is in the circumstances of this case. In Espy, the court said: The deliberative process privilege does not shield documents that simply state or explain a decision the government has already made or protect material that is purely factual. The deliberative process privilege is a qualified privilege and can be overcome by a sufficient showing of need. For example, where there is reason to believe the documents sought may shed light on government misconduct, the privilege is routinely denied, on the grounds that shielding internal government deliberations in this context does not serve the publics interest in honest, effective government. As John notes, Darrell Issa narrowed his document request in the subpoena in question to issues and documents relating to false testimony given by DoJ officials in Congress. That is specific to government misconduct, which also means Espy applies and the privilege doesnt exist, especially the deliberative process brand of privilege. Former DoJ attorney J. Christian Adams declares the assertion of privilege flat-out illegal, quoting from a statement by former House Judiciary Chair James

Sensenbrenner, speaking about Espy(cited as Sealed Case) as well: It continued: Moreover, the privilege disappears altogether when there is any reason to believe government misconduct occurred. In Re: Sealed Case, 121 F.3d 746 (D.C. Cir. June 17, 1997, No. 96-3124). The First Circuit agreed. It found that, where there is reason to believe the documents sought may shed light on government misconduct, the privilege is routinely denied, on the grounds that shielding internal government deliberations in this context does not serve the publics interest in honest, effective government. Texaco Puerto Rico, Inc. v. Department of Consumer Affairs, 60 F.3d 867, 885 (1 st Cir. 1995); see also In re Comptroller of the Currency, 967 F.2d at 634 (the privilege may be overridden where necessary to shed light on alleged government malfeasance.) The Department literally asserted this privilege in the face of Congressional contempt proceedings. It clearly cannot argue that there is no reason to believe that government misconduct occurred. The assertion of the privilege was therefore illegal. Clearly, Obama wont win the legal argument. What about the political argument? The White House is certainly trying to shrug this off as a partisan election strategy on the part of House Republicans, but the connection

of Operation Fast and Furious to the deaths of two American lawenforcement officers makes that a very risky strategy. Until the assertion of privilege, most of the media had ignored the story but asserting executive privilege, especially on the 40th anniversary of Watergate, has forced everyone to start reporting on OF&F. They acted despite worries inside and outside the Fed that the central bank already has done all it can do to invigorate the disappointing economic recovery. The Fed said Wednesday it would extend through the end of the year a program known as Operation Twist, which aims to

drive down long-term interest rates and reduce borrowing costs for businesses and households. Under the program, the Fed sells short-term securities and uses the proceeds to buy longer-term securities. Fed Chairman Ben Bernanke made clear in a news conference after the policy makers meeting that he is prepared to take further action if he doesnt see progress on bringing down unemployment, which was 8.2% in May. They wont be the only ones twisting, either. Knitters were supposed to compete in their events while watching the actual Games on TV. But that was before the U.S. Olympics Committee got wind of it and sent Ravelry a cease & desist, for making a mockery of the Games with their needlework. That article covers some of the basic facts, but gets quite a few more wrong. It seems nobody at Ravelry was making money off the Olympic brand, nor were they mocking the games. They were encouraging their members to watch the games and knit at the same time, challenging

themselves to exceed their personal best for the most projects finished while the games went on. They also make another ironic statement toward the end. The USOC is demanding Ravelry change the name to the Ravelry Games, but we say: Why not make knitting an Olympic sport instead? Pair up knitting a baby sweater with target shooting and make it the summer version of the biathlon. Those would be some Nike ads. Why is that ironic? Because knitting actually was an Olympic event at one time. Be that as it may, Ravelry is largely though not entirely composed of ladies ladies who habitually carry sharp pointy things. And now theyre angry. So who is conducting the war on women now? Operation Fast and Furious, initiated in 2009, was the largest and last of these gunwalking stings, involving more than 2,000 firearms. It was a monumental failure: Only about a third of the guns have been recovered, and two weapons involved were found where U.S. Border Patrol agent Brian Terry was fatally shot on Dec. 14, 2010. The only way to salvage something positive from this fiasco is to investigate what went wrong and learn from the mistakes. Instead, the Justice Department seems intent on burying the past. The DoJs refusal to cooperate,

especially on a probe of false testimony given by government officials to Congress, makes it clear that the administration thinks it has something to hide from Obama on down. He might get a day or two of sympathy about having to deal with big meanie Republicans, but the hundreds of deaths that occurred in this operation and the dishonesty from Obamas administration during the probe will erode that very, very quickly. Both sides of this arguments are losers, and the White House would probably be better served by tossing Holder and his crew under the bus and releasing

everything in a single Fridaynight document dump this week. If they do that now, whatever embarrassing materials that do arise have a few months to lose their sting before the election.
