TBR further requests that the foregoing addresses be added to the Court's Master Mailing List and to the mailing list of each party in interest where such addresses do not already appear, and requests that Messrs. Caplan and Gross be identified as representatives of TBR on all such lists. Finally, this Notice of Appearance and Request for All Notices shall not be deemed or construed to be: (1) a consent by TBR to the personal jurisdiction of the Bankruptcy Court; (2) a waiver of TBRs right to have final orders in non-core matters entered only after de novo review by the District Court; (3) waiver of the right to trial by jury in any proceeding so triable in this case or any case, controversy, or proceeding related to this case; (4) consent to have the District Court withdraw the reference in any matter subject to mandatory or discretionary withdrawal; or (5) waiver of any other rights, claims, actions, defenses, setoffs, or recoupments to which TBR is or may be entitled, in law or in equity, all of which rights, claims, actions, defenses, setoffs, and recoupments TBR expressly reserves.
