To date, there is NO Temporary Restraining Order (TRO), NO Writ of Preliminary Injunction (WPI or Injunction) and NO Constitutionality Question on ANY Provision of R.A. No. 9266, (Architecture Act of 2004), its Implementing Rules and Regulations (IRR) and Derivative Regulations Issued by the PRBoA and the PRC in Support of R.A. No. 9266 or the Predecessor Architecture Laws
(R.A. Nos. 1581 of 1956 and R.A. No. 545 of 1950)

The Writ of Preliminary Injunction (WPI or Injunction) secured by the PICE on 24 May 2005 only covers Sections 302.2 and 302,4 of the 2004 Revised Implementing Rules and Regulations (R-IRR) of the 1977 National Building Code of the Philippines or NBCP (otherwise known as P.D. No. 1096), which are
MERE LISTS of documents to be submitted to the Office of the Building Official (OBO) as part of an application for a building permit.

The Injunction secured by the PICE on 24 May 2005 covers only PORTIONS OF A MERE EXECUTIVE ISSUANCE (IRR). It
does NOT apply to R.A. No. 9266, a STATUTE or LAW (of national application).

Laws do not Operate in Isolation but in Full Interaction with Other Laws that are in Place.

NEITHER THE 03 MAY 2005 PICE PETITION FOR TRO/ WPI NOR THE 24 MAY 2005 INJUNCTION MENTIONS R.A. No. 9266. THE INJUNCTION DOES NOT
APPLY TO R.A. 9266, ITS IRR NOR TO ITS DERIVATIVE REGULATIONS.

To date, it has been almost TWO (2.0) YEARS since the UAP-IAPOA filed a MOTION TO LIFT the Writ of Preliminary Injunction (WPI or Injunction) and ABOUT ONE AND ONEHALF (1.5) YEARS since the time the DECISION in the Manila RTC Branch 22 Case should have been PROMULGATED. There is already need for ample explanation concerning this delay. The Supreme Court Administrator needs to be notified asap.

To date, ANY Registered and Licensed Architect (RLA), particularly if a UAP-IAPOA Member, can bring a verified complaint (based on ones direct and personal knowledge) against ANYONE for the willful violation of R.A. No. 9266, its IRR and derivative regulations i.e. specifically against National Government Officials, Governors, Mayors, Building Officials, Municipal/ City Engineers, CIVIL ENGINEERS and the like .

To date, at least four (4) civil and criminal cases involving the PICE and the UAP-IAPOA are already being heard :
1) PICE, Gamolo vs. DPWH Secretary (for declaratory relief/ TRO/ injunction issuance vs. Secs. 302.3 & 4 of the 2004 Revised IRR of P.D. No. 1096) ; 2) PICE vs. EM Florentino, UAP National Board & Officers, etc. for indirect contempt; 3) Archt. Winstoney Salceda vs. CE Don Emmanuel Santy for the illegal practice of architecture; and 4) PICE vs. Archts. Armando Alli (as public respondent) & Winstoney Salceda (as private respondent) for indirect contempt.
