IMPLEMENTING
GUIDELINES
ON
THE
ACTIVATION OF THE WOMEN AND CHILDREN
CONCERN DIVISION NOW RENAME AS WCPC
UNDER THE DIRECTORATE FOR INVESTIGATION
AND DETECTIVE MANAGEMENT.

II. BACKGROUND:
The Directorate for Plans in its mandate to
continuously conduct study to upgrade the
functional organization of the entire PNP in
coordination with the Directorate for
investigation
and
Detective
Mgt
recognizes two concerns in the recognition
of woman in Nation Building Act of 1992.
Among these are (1) gender sensitivity
program for the protection of women and
children against violence and abuse.

The CPNP, approved the recommendation and DPL Go


No. 02-03 was issued mandating
DIDM to issue
detailed implementing guidelines on the organizational
level from the National Headquarters down to the
Regional, Provincial, City and Municipal Station and
National Support Unit engaged in investigation.

III. OBJECTIVE:
This
implementing
guideline
will
prescribe the creation and organizational
composition of the Women and Children
Concerns Division now rename as Women
and Children Protection Center (WCPC)
from National Headquarter (Camp Crame)
under DIDM down to the City/Municipal
DNPPO Women and Children Protection
Station level and

command relationship of each in the Implementation of


all laws and procedures related to the investigation of
Cases of violence against women and children report
and case monitoring feedback mechanism from the field
investigation office to DIDM to effectively carryout the
WCCD now renamed as WCPC.

IV. General Function of WCPD


a. Enforce all penal laws related to the protection of
women and children from abuse, exploitation,
discrimination and neglect including but not
limited to operation against white slavery,
prostitution, obscene publication, lewd shows,
trafficking of women and children, child labor
etc
b. Receive and make appropriate action on
complaint and conduct investigation and filing of
cases against offenders committing violence
against women and children.

c. Provide necessary assistance to


women and children in need of
special or witness protection.
d. Observe and comply with all judicial
processes in addressing cases of
violence against women and children
that were filed in court to ensure
justice and conviction.

V. IMPLEMENTING GUIDELINES:
The WCCD now WCPC Women and Children
Protection Center (Amending NHQ- PNP General
Orders No. DPL 07-03)
A. Complaint Investigation and Action
Section (CIAS)
-. Receive and act on all written complaint and or
referrals of individuals or private/ government
agencies or institution delivering delving on
cases involving women and children addressed
to NHQ, PNP and subsequently direct
respective Woman and Children Offices in the
PROs or NSUs and monitor compliance of
action taken by such concerned offices.

- Handle all records on matters pertaining to


investigation and monitoring of cases on complaint of
abuse discrimination, exploitation and/or violence
against women and children.
- Conduct Investigation on complaints/reports on cases
involving women and children that are not properly
and judiciously acted upon by concern PROs/NSUS.
B. Women and Children Welfare Services Section
Coordinate with proper agencies to attend to the
welfare services needed or requested by any person or
group persons, government and/or private entities
concerning the welfare of women and children who are
victims of violence and abuses;

- Coordinate
and
Monitor
the
rehabilitation and treatment of women
and children referred to welfare service
of government line agencies or nongovernment organizations institutions
whose cases were handed by WCCD.
- Liaison with concerned agencies for
guidance counseling of mentally and
physically disturbed or abuse women
and children whose cases were referred
to WCCD now WCPC.

- Attend to the care and protection of


children need special assistance by
referring
their
needs
with
other
concerned government institution as an
alternative to investigation.
- Assist in the determination of the needs
of women and children whose cases
were referred to WCCD whether victim/s
need protection , physical/ psychological
treatment and/ or rehabilitation.

C. Detection and Operation Section.


- Supervise and control all operational activities of
the division.
- Gather all types of relevant information of value
required to support successful operation.
- Updates information on organized crime group
engaged in the trafficking and abuse of women
and children and initiate case build-up that are
necessary to support police operation.
- Conduct special detective investigation of cases or
complaint referred for prompt and speedy solution.
- Prepare reports for TDIDM on all operations
conducted.

D. Research, Monitoring and Records Section.


- Prepare appropriate policy guidelines in the
investigation of cases involving women and children
who are victims of abuse, violence, including policies on
children in conflict with the Law (CICL).
- Maintain a Data base and Profiling of Crimes against
Women and Children.
- Conduct study in improving the skills of WCPD officers
in the area of investigation and detection and in the
development of equipment necessary for the
disposition of crimes against women and children.
- Create and maintain a network with other agencies
both local and foreign to jointly address cases of
exploitation and abuse women and children.
- Formulate and develop procedure of instruction in the
training and investigation interest of WCPD personnel.

The following shall be the functions and
responsibilities of the WCPD in every police stations:
1) Enforce laws for the protection of women and children from
abuse, exploitation, discrimination and neglect, including
children who are in conflict with the law;
2) Investigate cases of women and children who fall victim to
physical/sexual abuse and other gender-based crimes.
3) Participants in the legal and judicial process of addressing
cases of violence against women and children
with
purpose of serving the ends of justice for the victims;
4) Coordinate with other government agencies, NGOs, and
community in pursuing an interdisciplinary and multijurisdictional response to the rights and needs of victims
of abuse and violence;

5) Initiate crime prevention programs aimed at
reducing and eliminating the victimization of
women and children at home, in the
neighborhood, in the workplace, and in society;
6) Extend necessary assistance to women and
children in need special protection from the
police;
7) Conduct projects and activities related to
women and children protection;
8) Perform analogous responsibilities.

UNDER THE
JURISDICTION OF THE WCPDs
The cases involving crimes against women and primarily referred to
as gender-based violence, which means violence that is directed
against a woman because she is a woman or that affects women
disproportionately2. The special protection of children, on the other
hand, is from all forms of abuse, neglect, cruelty, exploitation and
discrimination, and other conditions prejudicial to their development 3 .
Not all cases involving women fall under the jurisdiction of the
WCPC/WCPD. However, all cases involving children, whether they
are victims or suspects, are cognizable by the WCPD/WCPC since
our laws provide for their special protection.

UNDER THE
JURISDICTION OF THE WCPDs
Cases falling under the jurisdiction of WCPD:
In all cases of Parricide, Murder and Homicide, the general
investigation shall take cognizance although the victim maybe a woman
or a child, unless the offense is for Violation of Republic Act 9262. Check
Violation of Section 5(a) penalized by Section 6(a) of RA 9262.
Where there is a dating and/or sexual relationship between the
woman and the offender, it is highly encouraged that the offense charged
be a violation of any penal provision of Republic Act 9262, or if the
violation of an article of the RPC is in relation of RA 9262, that such case
be indicated. For example, Grave Threats in statistician the information
that the provisions of RA 9262 applies to the case. However, in the same
example above, it is preferred that a case for Violation of Section 5(b) of
RA 9262 (Threatening to Cause the Woman or her Child Physical Harm) be
the charge.

CONFIDENTIALITY OF
REPORTS
The police officer shall all times respect the right
to privacy of the child and shall confidentiality of
information and records pertaining to child rights
cases he/she investigated or is investigating
,from the beginning of the investigation and/or
initial custody of the child-victim and at all times
thereafter, except when the release of any
information about the childs case is pursuant to
an Order issued by the court.
All reports involving Women and Children should
always treated with confidentiality.
