Introduction

• The Minimum wage Act was passed


in 1948 enabling the central and
state government to fix minimum
wages payable to employees .
• It is the fixation of the minimum
wages which the employer must pay.
• The Act was amended in
1954, 1957, 1961, 1982, 1983,
1987,1990 and 1993.
Object of the Act
• The object of Act is to secure the
welfare of the workers in a
competitive market by fixing the
minimum rates of wages in certain
employments.
Fixation and Revision of Minimum
Rates of Wages (sec-3)
Under sub- section (2) the minimum rate of wages
may be fixed by the Government for
(a) A minimum rate of wages for time work know as a
minimum time rate.

(b) A minimum rate of wages for piece work know as a


minimum piece rate.

(c) Over time work done by employee known as over


time rate.
• Different rates of wages may be
fixed for-
(i) Different scheduled employments;
(ii) Different classes of work in the same
scheduled employment;
(iii) Adults, adolescents, children,
(iv) different localities;
(v) minimum rate of wages may be fixed by any
one or more for these wage periods
(i) by the hour,
(ii) by the day,
(iii) by the month
Advisory Board (Sec 7)
The act empower the government to constitute
advisory board comprising equal number of
representative of the employer and employee in
the scheduled employment , to coordinate the
work of committee and sub committee appointed
by it for fixing and revising minimum rates of
wages.
Central Advisory Board (SECTION 8)
The central government is empowered
to constitute a central advisory board
for advising the central and state
government in the matter of fixation
of minimum wages and to co-
ordinate the work of advisory boards.
Wages for Overtime (SEC 14)

Where an employee in any schedule


employment works for more than
prescribed hours of work he shall be
entitled to over time wages. An
employee entitled to over time must
be one who is getting wages as
prescribed by the act.
PENALITIES (SECTION-22)

An employer who pays to any


employee less than the prescribed
minimum rate of wages or infringes
any order rule may be punished with
imprisonment up to six month and
fine up to five hundred rupees or
with both.
CONCLUSION

• The minimum wages Act has been


formulated for the welfare of the
workers or the employee. It is for
fixing the minimum wages and
employer must pay.
