Any person, natural or juridical,


domestic or foreign, who carries
on in the Philippines, any trade, business,
industry or activity of any kind and uses the
services of another person who is under his orders
as regards the employment, except the
government and its instrumentalities.

 Any person who:
- performs services for an employer in which
either or both mental and physical efforts are
used;
- receives compensation for such services;
and
- there is an employer-employee relationship.

What are the elements of an ER/EE
relationship?

- ER has the right to hire and fire;

- payment of wages; and

- with control and supervision.

Coverage shall be compulsory upon all
employees, including house helpers,
who are:
- not over 60 years of age (if initial coverage);
and

- regardless of citizenship, duration and status


of employment.

Overseas Filipino Workers
 Who are the OFWs?

- A Filipino recruited by a foreign-based ER


for employment abroad; or
-One who has a source of income in a
foreign country; or
-A permanent resident of a foreign country.

coverage).
- Minimum MSC is at P5,000.00.
- If with existing SS number, need not
register thru SS Form OW-1.
Non-Working Spouse
• Who are the non-working spouse?
- Legally married to a currently
employed and self-employed
member; and
- Devotes full time in the
management of the
household and family affairs.

Requirements/highlights:
- never been a member of
the SSS.
- not over 60 years of age.
- with consent of the working spouse.
- must register through SS Form NW-1.
- contribution will be based on 50% of the
working spouse’s last posted MSC but in no
case should it be lower than P1,000.

EFFECT OF NON-REPORTING
Effect of Non-Reporting
 EMPLOYEE : Still entitled to benefits even if his
employer fails or refuses to report him for coverage or
remit his contributions.

 EMPLOYER : Liable to his employees and must:


pay their benefits
pay all unpaid contributions plus penalty
held liable for criminal offense punishable by
fine and/or imprisonment
SELF-EMPLOYED : In the event that he does not realize
earnings in a given month, he is not required to pay
contributions for that month.

• Are Catholic priests subject to coverage?


Yes. Either as employee or self-employed.

 Is the coverage of foreign government entities
and international government organization
voluntary or compulsory?

Voluntary. The foreign entities or international


organizations have the option to enter into an
Administrative Agreement (AA) with SSS. Once
the AA is approved, the coverage of the
employee/s becomes compulsory.

What are the conditions for exemption from coverage of
Regional or Area Headquarters of multinational companies in
the Philippines?
•That the regional or area headquarters do not earn or
derive any income from the Philippines and all their
expenses are financed by their parent companies;
•That the area or regional headquarters act as supervisory
communications and coordinating centers only for
their affiliates, subsidiaries or branches; and

• That they are exempt from all forms of local licenses


fees, dues, imports or any other taxes or burdens.
Frequently Asked Questions
• When a member loses his SS ID card or cannot
remember his SS number, should he secure
another SS number?
No. The SS number assigned to a member is his
lifetime number which must always be used in all his
transactions with the SSS. He should not secure another
number at any other time.
• Does SSS issue temporary SS number?
No. The SS number assigned to a member is his
lifetime number. The “temporary SS no.” flag is simply an
indicator that the registrant did not submit the required
document/s at the time of registration.

 Can employers hire employees without SS
numbers ?
No. Section 24 (e) of the SS Law requires the presentation
of SS number as a condition for employment. However,
lack of SS number should not prejudice a qualified member
from availing SS or EC benefits.
 Can anybody secure copies of records submitted to SSS
by members ?
No. Section 24 © of the SS Law provides for their
confidentiality. Records can only be obtained, by
persons other the member, in compliance to a subpoena
duces tecum or the authority by the SSS President.

 Is it mandatory for married female members to use their
married name ?

No. Article 370 of the Civil Code of the Philippines provides


that:
"A married woman may use:
(1) Her maiden first name and surname and add her
husband's surname; or
(2) Her maiden first name and husband's surname;
or
(3) Her husband's full name, but prefixing a word
indicating that she is his wife, such as "Mrs."
