Revised Leave Rules 1980
Rule -2 When leave is earned?
Leave is earned by the period of duty we
perform . It shall not be earn during the period
of leave.
Rule-3 Earning of leave. 4 days in a
calendar month.
Rule-3(3) If a civil servant proceeds on leave
during a calendar month and returns from it
during an other month and the period of duty
in either month is more than 15 days , he will
get credit for one full credit month only.

Can we claim the leave as a matter of
right?
No. leave can not be claimed as of right (FR67)
Can nature of leave applied for be
changed?
No. The nature of leave due and applied for
by a Government servant can not be altered
at the option of the sanctioning
authority.(FR-87(a)
Refusal of leave on medical certificate.
Leave applied for on medical certificate shall not
be refused. 3

Leave during Foreign Service?
A Govt. servant will not earn leave under the
Government during Foreign Service.
Can count on re-instatement after
dismissal or removal?
Yes, he is entitled to count his previous service
for leave.
Employment during leave?(FR-69).
No he cannot seek any employment during
leave.

Reasons for leave(Rule-20)
No reason is necessary to specify.
Lapse of leave? Rule-31 /(FR-86)
When he quits the service / compulsory
retirement.
Return from leave on medical
certificate?(Rule-38(3A)/(FR-71)
Cannot be permitted to join with out medical
fitness certificate.

Overstay of sanctioned leave. (rule-
23),(FR-73)
On over stay after sanctioned leave, double
period of such absence shall be debited to his
leave account.
Leave Account.(Rule-30) and FR-76.
(Gazzeted & Not Gazzeted)
In case of Gazetted Officer no leave can
be granted until title of leave has been
obtained from the Audit Office.

Authorities empowered to sanction leave
Authorities empowered to grant leave (SR 206-
207)i. To non gazzeted officials: The authority
who is empowered to fill up the post. ii. To
gazzeted officer H.O.D/P.A.O.
Counting of leave (Rule-7) it is always
applied in terms of days

KINDS OF LEAVES
DISABILITY LEAVE: (Rule 14) It is granted to a
government servant who is disable by injury,
ailment or disease contacted in course or in
consequence of due performance of his official
duty or official position
 Maximum period 24 months.
 Not debit able tohis leave account.
 Leave Salary:
 Full pay for 180 days.
 Half pay for remaining period.
 Leave will be granted on the certificate
issued by the Medical Board.

STUDY LEAVE (FR-84)
Granted to a Government Servant to enable him to study
scientific, technical or similar problems or to under go
special course of Instructions.
• Maximum period (4 years).
• Not Debitable to leave account.
• Leave salary.
 Half pay.

 All compensatory allowances ,which are other wise


admissible to a civil servant during leave on half pay ,
will be payable during study leave (F.D OM No.
F.12(3)-R.13/81 dt.21.3.1981.)
 Study Allowance.

CASUAL LEAVE
 Maximum period (20 days)
 C/L not treated as absence.

 Lapsable.

 Can’t be combined with


other type of leave or
joining time.

QUARANTINE LEAVE(Rule-37)

 It is granted to a government
servant on account of absence from
duty necessitated by order not to
attend office in consequence of
infectious disease in the family like
Cholera, Smallpox, plague, typhus
fever, meningitis or any other
disease declared as infectious.

 This is extra Casual Leave.
 Period of Leave (21 days –30 days)
 Treated as duty.
 Can be combined with other type of
Leave.
 May not be debited to his Leave
account.
 Can be granted on the certificate
issued by the AMA.

Leave on Full Pay (LFP) Rule-5

 4 Days a month.
 Duty period more than 15 days in a
month.
 Maximum period.
 Without Medical Certificate 120 days.
 With Medical Certificate 180 days.

 On Medical Certificate from leave account


in entire service 365 days.
• May be converted into leave on half
pay.
• No limit for half pay. 13
Leave on Half Pay (L.H.P)rule-6
 LFP on the option of the Civil
Servant may be converted in to
LHP.
 Debit to leave account will be
rate of one day of the former for
every two days of the latter.
 There is no limit on half pay
subject to availability of leave
at his credit.

LEAVE NOT DUE(rule-11)
 May be granted on full pay to be
offset against leave to be earned in
future.

 Maximum period – 365 days, in the


entire service.

 First 5 years – 90 days.

Continued

 May be converted in to LHP.


 May be granted when there are
reasonable chances of the Civil
Servant resuming duty on expiry of
leave.
 Not admissible to temporary
Government Servant.

REST & RECREATION LEAVE
(R & R)-Rule-10)

 May be granted for 15 days in


a calendar year.
 Debit to leave account be for
10 days leave on full pay.
 Not admissible to a Civil Servant in a
vacation Department.

EXTRA ORDINARY LEAVE(Rule-9)

 Without pay.
 Maximum period 2– 5 years.
 Length of Service – 10 years.
 Can be granted to a permanent or
temporary Government Servant.
 EOL can be granted retrospectively
in lieu of absence without leave.

Conversion of EOL in to an other kind
of Leave
 The powers of President laid down in
proviso FR 26 have not been delegated to
any authority to convert the EOL in to an
other kind of leave
 (No F.1(4)R-4/2004(Vol.II) Dt.7.10.2008)
SPECIAL LEAVE(Rule-12)
• To a female servant on the death
of her Husband.
• Leave Salary – Full pay.
• Period 130 days.
• Not debitable to her leave
account.
• Death certificate may be required
for sanctioning leave. 20
MATERNITY LEAVE(rule-13)
 To a female servant.
 Period – 90 days.(45 days before
the date of confinement and 45
days after the date of
commencement.)
 Three times in the entire service.

 May be granted in combination


with other type of leave. 21
LEAVE EX-PAKISTAN(Rule-15)

 Who proceeds abroad during leave,


or takes leave while posted abroad.
 Period – 120 days in one
occasion.
 Leave salary shall be payable in
Pak Rupees irrespective of the
country where they spend leave.

L.P.R(Rule-16)
 Leave Preparatory to Retirement

 365days subject to availability of


leave at his credit.

 May be taken partly on full pay or


half pay.

 Encashment(Rule-17) :- on
completion of 30 years Q Service 365
days.
 Can be refused partly and sanctioned
partly.
 Leave salary : either at the retirement
or month wise.

 For lump sum payment only senior post
allowance will be included in leave pay.

 When a civil servant dies before


completing of 365 days, his family will be
entitled to lump sum payment equal to the
period falling short.

Powers to refuse L.P.R.(Rule-18)

 Ordinary LPR can not be refused.


 All orders refusing LPR & re-calling from
LPR should be passed as under:
 BPS-20 & above - Chief Executive / P.M.
 BPS- 17-19 - Appointing authority
as prescribed in
APT Rules
 BPS- 1-16 -do-

Option for encashment of
leave
 15 months before the date of
superannuation or completing 30 years
qualifying service.
 If a government servant option for pre-
mature retirement after completion of
31 years qualifying service 3 months
notice would be required for
encashment of LPR.

 Pay
 Qualification pay
 Personal pay/annual increment beyond
scope pf pay scales.

 Note :-Senior post allowance is also


reckonable for encashment during LPR
because it is treated as part of pay for
drawal of leave salary. ( MOF No
F.2(11)Imp.1/77 dt.3.7.1977)
