QUASI CONTRACTS

What is a quasi contract?

It is an obligation which the law creates in absence of an


agreement.
“Quasi” means-having some resembelence,
therefore it can also be described as certain
contracts resembling those created by the
contract.

The basis of quasi contract is that no man shall be allowed to


enrich himself at the expense of other.
Kinds of quasi • Section68: Claim for supply
contract of necessaries to a person who
are incompetent to contract.
• Section69: Right to recover
money paid for another person.
• Section70: Obligation of
person enjoying the benefits of
non-gratuitous act.
• Section71: Responsibility of
the finder of the goods.
• Section72: Payment of
money or delivery of goods by
mistake or under coercion.
Section68: Claim for supply of necessaries to a
person who are incompetent to contract.
Sometimes a person supplies necessaries
to another person incompetent to enter into
a contract(.i.e. minor, person of unsound mind etc).

In such case the person supplying the necessaries is entitled to


recover the cost of the necessaries from the property of such
incompetent person even if there is no valid contract between
them.
ILLUSTRATION
A supplies B-a lunatic with necessaries suitable to his condition of
life. A is entitled to be reimbursed from B’s property
Section69: Right to recover money paid for another person.

A person who is interested in payment


of money which another person is bound
by law to pay, and who therefore pays it, is
entitled to be reimbursed by the other.
ILLUSTRATION
B holds a land in Gujarat, on a lease granted by A-the zamindar. The
revenue paid by A to the government being in arrear, his land is
advertised for sale by the government. In order to prevent the sale,
B pays the sum due from A.A is bound to reimburse the amount
paid by B.
Section70: Obligation of person enjoying the benefits of non-gratuitous act.

When a person lawfully does anything for


another person, or delivers anything to him
not intending to do so gratuitously and the
other person enjoys the benefit of it, the
latter is bound to make compensation to the former in respect of,
or to restore, the things so done or delivered.
ILLUSTRATION
A, a tradesman, leaves goods at B’s house by mistake. B treats goods
as his own. He is bound to pay A for them.
Section71: Responsibility of the finder of the goods.

A person who finds goods belonging to another, and takes them in


to his custody, is subject to the same responsibility as a bailee. He
should not capture or consume the goods and when the owner is
traced,he should restore the good to the owner.

ILLUSTRATION
Section72: Payment of money or delivery of goods by mistake or under coercion.

A person to whom the money has been


paid, or anything delivered, by mistake or
under coercion must repay or return it.

ILLUSTRATION
A railway company refuses to deliver up a certain goods to the
consignee, except upon the payment of an illegal charge for the
carriage. The consignee pays the sum charged in order to obtain
the goods. He is entitled to recover so much of the charge as was
illegally excessive.
