PAKISTAN CLIMATE CHANGE

ACT 2016 & 2017


PAKISTAN CLIMATE CHANGE ACT

 lt extends to the whole of Pakistan


 lt shall come into force at once
 ln this Act, definitions of specific words used have been mentioned unless
there is anything repugnant in the sublect oI context
The expressions and words used bul not defined in this Act shall have the
same meaning as in the Pakistan Environmental Protection Act, 1997 (Act
No. XXXIV of 1997
ESTABLISHMENT OF THE PAKISTAN CLIMATE
CHANGE COUNCIL

The Prime Minister shall, by notification, establish a Council to be known as the


Pakistan Climate Change Council that will consist of a Chairperson; the Prime
Minister or other person he may nominate on his behalf and the other members
including ministers and experts

At least two meetings to be held in a year

Prime Minister, AJK and Chief Minister, Gilgit- Baltistan to participate in the
meetings of the Council as and when required
FUNCTIONS & POWERS OF THE COUNCIL

co-ordinate and supervise enforcement of the provisions of this Act


Monitor implementation of several plans and agreements
Coordinate, supervise and guide mainstreaming of climate change concerns
into decision-making
Approve and monitor implementation of comprehensive adaptation and
mitigation policies and other measures
Approve guidelines covering different areas of concern
Consider the National Climate appropriate directions thereon
ESTABLISHMENT OF THE PAKISTAN CLIMATE
CHANGE AUTHORITY

The Minister-in charge of the Federal Goverment shall establish


the climate change authority
The Authority shall be a body corporate with perpetual succession
and a common seal and shall, in the said name, be capable of
performing certain actions
 The headquarters of the Authority shall be in Islamabad and may
establish offices in other cities
COMPOSITION OF THE AUTHORITY

The Chairperson, Member (Adaptation), Member (Mitigation), Member


(Climate Finance), Member (Coordination) and one Member from each
province to be nominated by the respective Provincial Ministers-in-
charge
Shall be appointed by PM , can be from different fields with at least
fifteen year's experience in fields related to clmate change and
environment, with a distinguished service record
No seat to be left vacant
Assistance of any governmental or NGO person can be taken
FUNCTIONS OF THE AUTHORITY

Formulate, comprehensive adaptation and mitigation policies, plans etc


For implementation establish institutional and policy mechanisms
Prepare suitable adaptation and mitigation project
prepare Adaptation Plans
Carry out Technology Needs Assessment and prepare Climate Change
Technology Action Plan
Prepare projects for funding under the REDD+ Mechanisms
Prepare the National Climate Change Report for consideration of the Council
Formulate and coordinate implementation of low carbon and green growth
strategies
Formulate guidelines and advise the Government regarding appropriate
legislative, policy and implementation measures and other actions

design, establish and maintain a national registry and database on greenhouse


gas emissions
Assist federal government for international conferences and treaties
Coordinate conduct of research on current and emerging issues of climate
change and undertake education and awareness campaigns
Design programmes providing for incentives relating to matters of climate
change
mobilize resources
Regularly publish update and disseminate, through means, climate change
strategies, policies plans, programmes and other information
Perform functions assigned by the Council or by the Government for this Act
Establishment of advisory committees and authority to be guided by advices
ANNUAL REPORT

At the end of each financial year, the Authority shall prepare an annual
report, which shall include
a description of its activities
Progress of implementation of ma]or climate change actions and difficulties
relating thereto
Its plans for the next financial year
Audited accounts of the Authority, and
Any other relevant information relating to functions of the Authority.
Report prepared under shall be laid by the Minister-in-charge of the
Government before the Parliament
POWERS OF THE AUTHORITY

The Authority shall have all the powers necessary to execute its functions
under this Act.
The Authority shall have power to
1. Manage, control and administer assets of the Authority as to best serve
functions and the purposes of this Act
2. With approval of the Government enter into contracts or establish
partnerships or associate with entities and organizations
3. Provide services or give guidance to public and private entities in
relation to climate change matters
4. Gather, obtain and verify any relevant information and data in
connection with the performance of the functions of the Authority
FUNCTIONS AND POWERS OF THE CHAIRPERSON

The Chairperson shall be the chief executive of the Authority


Perform the functions and exercise the powers of the Authority
and perform such duties as are assigned by the Council or by the
Government
Until the Council is duly constituted, the Chairperson shall,
subject to such directions as the government may give from time to
time, perform the functions and exercise the powers of the Council.
The Chairperson may, by general or special order, delegate any
of his functions or powers to officers or staff appointed under
section 7.
PAKISTAN CLIMATE CHANGE FUND

There shall be paid into the Fund:


1. Money received as donations, grants etc
2. Monies raised by authority
3. Dues payable to fund
FUND TO BE USED FOR

1. expenditure incurred by the Authority in performance of its functions


2. Operational and administration expenses of the Fund
3. Financial assistance
4. Any other purpose which in the opinion of the Council shall help achieve
the purposes of this Act.

The funds shall be managed by authority


MANAGEMENT OF THE FUND

The Authority may constitute committees of its members to undertake


regular monitoring of projects financed from the Fund and submit
progress reports to the Authority.
The Authority shall prepare an annual report incorporating its annual
audited accounts and performance evaluation based on the progress
reports mentioned in sub-section

Note: Invest money held in the Fund in such profit-bearing


Government bonds, savings schemes and securities as it may deem
suitable
