EJECTMENT:
FORCIBLE ENTRY & UNLAWFUL DETAINER
In forcible entry, the possession is illegal from the
beginning and the only issue is who has the prior possession
de facto. One is deprived of physical possession of any land
or building by means of force, intimidation, threat, strategy,
or stealth.
FORCIBLE ENTRY
In unlawful detainer, possession was originally lawful but
became unlawful by the expiration or termination of the
right to possess and the issue of rightful possession is the
one decisive, for in such action, the defendant is the party in
actual possession and the plaintiff’s cause of action is the
termination of the defendant’s right to continue in
possession. One unlawfully withholds possession thereof
after the expiration or termination of his right to hold
possession under any contract, express or implied.
UNLAWFUL DETAINER
It is a delay or suspension of an activity or a law. In
a legal context, it may refer to the temporary suspension of
a law to allow a legal challenge to be carried out.
EASEMENT
Art. 638 of the Civil Code of the Philippines
The banks of rivers and streams, even in case they are of
private ownership, are subject throughout their entire length
and within a zone of three meters along their margins, to the
easement of public use in the general interest of navigation,
floatage, fishing and salvage.
National roads shall have a right of way of not less than twenty
(20) meters, provided that such minimum width may be reduced
at the discretion of the Minister of Public Highways to fifteen
(15) meters in highly urbanized areas, and that a right of way of
at least sixty (60) meters shall be reserved for roads constructed
through unpatented public land and at least one hundred twenty
(120) meters reserved through naturally forested areas of
aesthetic or scientific value.
REASON:
By existence of an opening, the presumption of “party wall”
is defeated. [Art. 660 (1)] The side which benefits from
opening will now be presumed to own that wall.
Prescription will lie (10 years) on circumstances under Art.
668.
