The Philippine Civil Code of 1950

 Environmental protection was manifested in the


Philippine statutory provisions in which case it dealt
with pollution together with land use issues under
such headings as property, trespass, nuisance and
riparian rights.
RA 3931 (June 18, 1964)

 Established the National Air and Water


Pollution Control Commission under the
Office of the President and was tasked to
combat air and water pollution.
 The commission has no jurisdiction over
waterworks operated by NAWASA. This
was revised by PD 984.
PD 984 (August 18, 1976)

 Revised RA 3931 which resulted in a much


stronger National Pollution Control Commission
(NPCC).
 NPCC was under the Office of the President,
and the sole primary agency responsible for the
prevention, control and abatement of air, land
and water pollution. However, it has no
jurisdiction over waterworks and sewerage
system of MWSS and areas under Tondo
Foreshore Development Authority and LLDA.
P.D. 1121 (April 18, 1977)

 Created the National Environmental


Protection Council (NEPC) which served
as the central authority to oversee, unify
and integrate the planning, management
and implementation of the government’s
environment program.

Right to a Healthy Environment

The Government recognizes the right


of the people to a healthful

responsibility to contribute to the
preservation and enhancement of the
Philippine environment;

environment and natural resources;

P.D. 1152 Philippine Environmental
Code (1977)

Prescribes management guidelines aimed


to protect and improve the quality of the
environment particularly the Philippine
water resources through:

a. Classification of Philippine waters;


b. Establishment of water quality standards;
c. Protection and improvement of the
quality of Philippine water resources;

d. Responsibilities for surveillance and


mitigation of pollution incidence.
P.D. 1586 (June 11, 1978)

 Established the Environmental Impact Statement


system based on the requirements under Section
4 of PD 1151
 Under this decree no person, partnership or
corporation has to undertake or operate any
such declared environmentally critical project or
area without first securing an Environmental
Compliance Certificate (ECC)
The Philippine Constitution of 1987

provides the overall tenor for


environmental policies as it affirms the duty
of the State “to protect and advance the
right of the people to a balanced and
healthful ecology in accordance with
the rhythm and harmony of nature.”
EXECUTIVE ORDER NO. 192:

Provides for the reorganization of the


Department of Environment, Energy
and Natural Resources, renaming it as
the Department of Environment and
Natural Resources (DENR) , & for
other purposes
EMB MANDATE
The EMB shall be the primary government
agency under the Department of
Environment and Natural Resources
(DENR) to formulate, integrate,
coordinate, supervise and implement all
policies, plans, projects and activities
relative to the prevention and control of
pollution as well as the management and
enhancement of environment.

the pursuit of sustainable
development, for a clean and healthy
environment that enhances the
Filipino quality of life for present and
future generations.

To restore, protect and
enhance environmental
quality towards good
public health,
environmental integrity
and economic viability.
MANDATE
 The EMB is mandated to implement on a nationwide scale the
following environmental laws:

 PD 1586 (Environmental Impact


Statement System)
 RA 6969 (Toxic Substances and
Hazardous Waste Control Act of 1990)
 RA 8749 (Clean Air Act of 1999)
 RA 9003 (Ecological Solid Waste
Management Act)
 RA 9275 (Philippine Clean Water Act)
 RA 9512 Envtl. Education Awareness Act
Under E.O. 192, EMB is also mandated to conduct education and
information services; provide research and laboratory services; and
serve as secretariat in the adjudication of pollution cases.
