General Instructions

A Presentation Guide to Introducing COMELEC Resolution No. 10460 to the Electorate

2019 National and Local Elections


Who are the members of the Electoral Board?

The members of the Electoral Board are those


who are duly constituted by the Election
Officers pursuant to Resolution No. 10460
dated December 6, 2018 in connection with
the May 13, 2019 National and Local Elections.

The EB shall conduct the process of testing and


sealing of the VCM as well as the process of
voting, counting and transmission of election
results in the polling places where they are
assigned.

QUALIFICATIONS OF WATCHERS:

A registered voter of the city/municipality where


he/she is assigned;
Of good moral character;
Must not have been convicted by final judgment
of any election offense or of any other crime;
Knows how to read and write Filipino, English or
the prevailing local dialect; and
Is not related within the 4th civil degree of
consanguinity or affinity to any other member of
the EB in the polling place where he/she seeks
appointment as watcher.
DUTIES OF WATCHERS:
 Upon entering the polling place, the watchers shall present
to the chairman of the EB their appointments as watchers.
Their names shall be recorded in the Minutes with a
notation under their signatures that they are not
disqualified to serve.

Appointments of watchers shall bear the signature of ---


• candidate or duly authorized representative of the party,
organization or coalition of parties

At least 15 days before Election Day, independent


candidates and duly registered parties, organizations or
coalitions shall:
• Provide the Election Officers with the names and signatures
of their representatives authorized to appoint watchers.
RIGHTS OF WATCHERS:
 Stay in the space reserved for them inside the polling place
 Witness and inform themselves of the proceedings of the EB
 Take a note of what they may see or hear
 Take photographs of the proceedings during the testing, and sealing
of the VCM, and voting, counting and transmission of election
results, as well as of the printed election returns and the ballot box
 File a protest against any irregularity or violation of law which they
believe may have been committed by the EB or by any person
present
 Obtain from the EB a certificate as to the filing of such protest
and/or the resolution thereof
 Position themselves behind the chairman of the EB in such a way
that they can read the election returns while the chairman is
publicly announcing the precinct results.

CHALLENGE AGAINST Any voter or watcher may challenge any
ILLEGAL VOTERS person offering to vote for:
• Not being registered;
• Using the name of another; or
• Suffering from an existing disqualification

ACTION TO BE TAKEN BY Require proof of registration, identity or qualification. In case the identity
THE EB is challenged, identify the voter through his/her picture and specimen
signature in the EDCVL. Absent any proof of identity, any EB member
may identify under oath a voter personally known to him. Such act of
identification shall be recorded in the Minutes. The EB shall likewise
record in the Minutes all the challenges and oaths taken, and its decision
in the case.
CHALLENGE BASED ON Received or expects to receive, paid, offered or promised to
pay, contributed, offered or promised to contribute money or
ILLEGAL ACTS
anything of value as consideration for his vote or for the vote
of another.
Made or received a promise to influence the giving or
withholding of any such vote; or
Made a bet or is interested directly or indirectly in a bet that
depends upon the results of the election.

ACTION TO BE TAKEN BY Take an oath before the EB that he has not committed any of the

and he will not be allowed to vote. In case the voter refuses to take
such oath, the challenge shall be sustained, and the voter shall
not be allowed to vote. The EB shall record in the Minutes all the
challenges and oaths taken, and its decision in the case.
Rules to be Observed

 Voters shall vote in the order of their arrival in the polling place. No
priority numbers shall be given
 Watchers shall NOT enter the place reserved for the voters and the EB,
or mingle and talk with the voters;
 Persons carrying any firearm or any deadly weapon shall NOT enter
the polling place, EXCEPT jail/prison escorts or those expressly
authorized by the COMELEC;
 Crowding of voters and disorderly behavior inside the polling place
will not be tolerated.
Rules to be Observed
 The ballot box shall remain locked during the voting.
• If it should become necessary to make room for more ballots, the
EB shall, in the presence of the watchers and the public:
o Remove the VCM from the top of the ballot box and shake the ballot
box to wobble the contents therein, and make room for ballots.

o If still the ballot cannot go through the ballot box, the ballot box may
be opened. The chairman shall press down with his hands the ballots
contained therein without removing any of them. After which, the EB
shall close the box by sealing it.

Persons allowed inside polling place

 Watchers in the space reserved

 COMELEC Representatives;
 Technical support personnel;
 Voters casting votes;
 Voters waiting to cast vote;
 Jail/prison escorts escorting
detainee voters;
 Other persons authorized by
the COMELEC.

EXCEPT TO VOTE:

 Officer/Member of AFP or PNP;


 Peace Officer/armed person belonging to any extra-legal police agency,
special forces, reaction forces, strike forces, CAFGU, barangay tanods, or other
similar forces or para-military forces, including special forces, security guards,
and special policemen;
 All other kinds of armed or unarmed extra-legal police forces; and
 Elected or appointed Barangay official.

NOTE: By a majority vote of the EB, order in writing, policemen/police officers may be detailed
outside the polling place near enough to be easily called by the EB for protection.
PROHIBITIONS ON VOTING
 To bring the ballot, ballot secrecy folder, marking pen or voters receipt outside of the
polling place;
 To speak with anyone inside the polling place;
 To prepare ballot without using the ballot secrecy folder, or to exhibit its contents;
 To fill out ballot accompanied by another EXCEPT if voter is illiterate/persons with
disability (PWD);
 To erase any printing from the ballot, or put any distinguishing mark on the ballot;
 To use communication devices while voting, e.g. digital cameras, cellular phones with
camera, or other means to copy the contents of the ballot, or other scheme to identify
vote;
 To intentionally tear or deface the ballot;
 To disrupt or attempt to disrupt the normal operations of the VCM.
PREPARATION OF BALLOTS FOR THE ILLITERATE AND FOR PWDs
 Voter may vote as an illiterate or a PWD only when so indicated in the EDCVL.
 Assistors must be of voting age, and is a:
a) Relative within the 4th civil degree of consanguinity or affinity; OR
b) Person of his confidence who belongs to the same household; OR
c) Member of the EB.
 EB member or support staff may, upon request of a physically impaired person, assist
in feeding the ballot into the VCM.
 Only an EB member can assist more than 3 illiterate or PWD voters.

NOTE: Person assisting the illiterate/PWDs shall bind himself in writing and under oath to fill out
the ballot strictly in accordance with the instructions of the voter and not to reveal its contents.
Express Lanes

• INDIGENOUS PEOPLES

PROHIBITION AGAINST PREMATURE ANNOUNCEMENT OF VOTING

EB are prohibited to announce the following during the voting period:

Whether a certain registered voter has already voted or not;


Number of voters who have already voted or failed to vote thus far; or
Any other fact tending to show or showing the state of the polls.

NOTE: EB cannot make any statement at any time EXCEPT as a


witness before a court or body as to how many persons voted.
DISPOSITION OF UNUSED BALLOTS
After the voting, the EB shall:
a. Record in the Minutes the quantity of unused ballots
b. Tear the unused ballots in half lengthwise
c. Place one half of the torn ballots in the envelope for rejected ballots, half
of torn unused official ballots and other half of torn unused official ballots
(CEF No. A15), and submit said envelope to the EO for safekeeping.
d. Place the other half in another envelope for rejected ballots, half of torn
unused official ballots and other half of torn unused official ballots (CEF
No. A15), and then deposit the same inside the ballot box. Such fact shall
be entered in the Minutes.
DISPOSITION OF ELECTION RETURNS

After printing the election returns, the EB shall:


a. Sign and affix thumbmarks in the certification portion of all copies of the ERs
b. Post 1 copy of the ERs in a conspicuous place inside the polling place.
c. Fold ERs.
d. Seal the first 8 copies of the ERs with serially numbered paper seals and place in
their respective envelopes (CEF No. A17)
e. All envelopes containing the ERs shall be sealed with serially numbered paper
seals.
f. Affix signatures on the paper seals and envelopes on the space provided.
g. The watchers present shall likewise affix their signatures, giving preference to
the dominant majority party, dominant minority party and the PPCRV.

COMMON PROVISIONS
OMISSION OR ERRONEOUS INCLUSION OF DOCUMENTS IN BALLOT BOX
 If after sealing the ballot box, the EB discovers that some documents or articles
required to be placed inside the ballot box were not placed therein, the EB, instead of
opening the ballot box to place therein said documents or articles shall deliver the
documents or articles to the EO.
 The EO shall take appropriate measures to preserve the integrity of the documents.
(Sec. 32)
 The ballot box shall not be reopened to place in or to take out from it any document or
article EXCEPT upon prior written authority of the COMELEC for the purpose of
retrieving copies of the election returns or main SD card needed for canvassing of
election returns.
 The EB, treasurer and the watchers shall be notified of the time and place of said
opening of the ballot box.
PRELIMINARIES TO VOTING
The EB shall:

Show to the watchers and the public present that:

• VCM box is sealed;


• Ballot box is empty and thereafter, lock with 4 seals; and
• Package of official ballots is duly sealed, and thereafter break the seal.
MANNER OF OBTAINING BALLOTS
The VOTER shall:
• Look for his/her name in the
PCVL posted near the door of
the poling place, and
determine his/her precinct
number and sequence number.

• Approach any member of the


EB or its Support Staff, if any,
and state his/her name,
precinct number and sequence
number.
MANNER OF OBTAINING BALLOTS
The EB shall:
• Verify if the name of the voter is in the EDCVL; if verified, check for indelible ink
• Establish the identity of the voter through the ff:
• His/her photograph or specimen signature in the EDCVL or in any other
authentic identification document EXCEPT barangay certificate/CTC
• In absence of proof, EB or any registered voter of the precinct/clustered precinct
may identify under oath the voter.
• The name of the voter shall be distinctly announced in a tone loud enough to be
heard throughout the polling place.
• Require the voter to sign in the EDCVL, if the voter is not challenged or having
been challenged, the question has been decided in his/her favor. In case of
illiterate voters/PWDs who cannot sign, require said voters to affix their
thumbmarks in the EDCVL.
MANNER OF VOTING
